北洋政府对司法官考试的制度设计

民国初年,北洋政府继承了清末和南京临时政府有关法官考试的设计,根据时世的变化,不断进行修改、补充,增设了专门的考试机构,提高了应试人员的资格,调整了考试科目,严格了考试程序,从而为保障司法官的良好素养和司法独立的精神起到较大的作用,成为民初司法进步的重要表现。但是由于北洋政府对司法官考试制度的理想化设计明显多于对实施该项制度的真实考虑,使得该项制度收效甚微,没有也不能彻底改变当时的司法状况。

Comment on Frame of Beiyang Government about Exam System of Law-officer

In the early days of the Republic of China, Beiyang government inherited the frame of judge examination in the late Qing dynasty and Nanjing temporary government, then complemented it, including the setup of the special examination institution, the adjustment of examination subject, stricting of examination program, and so on. The examination system of law-officer of Beiyang government played an important role in ensuring the law-officer good accomplishment and the spirit of judicial independence. But Beiyang government focused more on the frame of Examination System of Law-officer than the studying on political and economic circumstance, which made it obtain little effect. It can not improve judicial circumstance completely at that time.
