| 摘 要： | 随着国际范围内国家补偿制度的兴起,我国也出现了构建国家补偿制度的需求。从控制犯罪和保障人权的角度看,我国有必要在借鉴国外立法和司法制度的基础上,结合国情,建立具有中国特色的国家被害人补偿制度。
