| 摘 要： | 商标——国家经济发展的“名片”，是一个国家经济实力强弱的标志。近代以来由商标纠纷引发的案件层出不穷，因此有关商标保护的法律也就应运而生。早在1904年清政府就颁布了我国近代以来第一部商标法《商标注册章程》。自此有关商标法研究的相关学术成果便相继出现。本文拟通过对近代以来商标法研究成果的梳理，来探寻近代以来商标法研究的发展方向、发展状况和不足。
