新时期我国法制建设的历史进程与基本经验

以1982年宪法的公布实施和1997年依法治国基本方略的确立为标志,新时期我国法制建设的历史进程可分为三个阶段:从1978年到1982年为恢复阶段;从1982年到1997年为全面发展阶段;1997年以来为全新发展阶段。新时期我国法制建设的基本经验主要有:必须正确处理党的领导与法制建设的关系;必须正确处理法制建设与经济建设的关系;必须把民主建设与法制建设结合起来;必须把立足中国国情与借鉴外国经验结合起来;必须不断完善法律监督体系。

The Historical Process and Basic Experience of China's Building of Legal System in the New Era

Marked by the promulgation and enforcement of the 1982 Constitution and the establishment of the basic principle of running the country according to law, the historical process of the building of legal system in China in the new era may be divided into three stages: the restoration stage from 1978 to 1982, the stage of full development from 1982 to 1997 and a completely new stage from 1997 onwards. The basic experience of China's building of legal system in the new era consists of the following: The relationships between the Party's leadership and the building of legal system and between building of legal system and economic construction must be handled well; the construction of democracy must be combined with the building of legal system; basing ourselves on Chinese conditions must be integrated with using the experience of other countries for reference; and the system of legal supervision must be constantly improved.
