Abstract:The right to safety submits the State to the law even when it can legitimate attacks on liberties apparently contrary to the State of law. We propose to analyze here the mutations of the State of law, notably since the externalisation of the state of exception after 2001 and the appearence of regimes of suspicion such as the expression of three legal processes distinct from suspension, skirting and diversion. It is a question of recalling how, beyond the distinction between authoritarian and liberal policy, a double movement, internal and international, of constitutionalisation and internationalisation of the systems of law constitues a ferment of resistance, limited but already effective to all reasons of State.
