从祁门县“谢氏纷争”看明末徽州的土地丈量与里甲制

本文以徽州祁门县谢氏《万历状稿供招》为主要研究资料 ,全面梳理了谢氏同一宗族内部的不同支派 ,在土地丈量中因产权不清而产生纷争的全过程 ,并对参与丈量的人役组成进行分析。证明徽州土地清丈人役的佥选是利用原有的里甲组织与人员 ,而不是重新建立新的组织和任命新的成员 ;清丈的单位是原有的里 ,也不是新划分的地域或行政单位。徽州的土地清丈和里甲制密不可分

Land Measuring in Huizhou Toward the End of the Ming and the Li Jia System As Seen from the Internal Disputes in the Clan of Xie

Making use of Plaints and Confessions from the Wanli Reign, legal documents of the case of Xie vs Xie of the Qimen County of Huizhou, the present paper sorts out and presents from beginning to end the disputes between branches of the clan of Xie, which had arisen during the process of land measuring owing to ambiguous property rights. It also analyses the composition of the personnel responsible of the measuring. From the above the article establishes that the measuring was done by persons from the local Li Jia system rather than a separate group made up of other persons, or by another administrative unit.
