Despite collaborative governance's popularity, whether collaboration improves policy performance remains uncertain. This study assesses the link between collaborative decision making and licensed environmental management protocols in the Federal Energy Regulatory Commission's (FERC's) process for licensing hydropower facilities in the United States. Using results from a previous study of FERC relicensing (Ulibarri, forthcoming), one high‐, one medium‐, and one low‐collaboration case were selected. Using documents including meeting minutes, public comments, and issued licenses, I assessed collaboration and license outputs, then conducted process tracing to examine whether and how differences in collaboration produced differences in license quality. High collaboration resulted in jointly developed and highly implementable operating regimes designed to improve numerous resources, while low collaboration resulted in operating requirements that ignored environmental concerns raised by stakeholders and lacked implementation provisions. These results support the hypothesis that collaboration can improve environmental outcomes, revealing the pragmatic value of collaboration. 全球博物馆在技术发展的加持下进入了新的发展阶段,数字化建设、藏品资源分享以及文创产品开发成为博物馆“角色转变”的新标杆。然而,现有的版权例外规则并不能满足博物馆的发展需求,更无法契合博物馆开放的馆藏作品的传播姿态,无力贴合博物馆文创产业发展的诉求。基于此,有必要通过适当放宽博物馆数字化建设的版权例外空间、合理延伸博物馆藏品传播的版权例外适用范围以及高效运用法定许可规则助推博物馆文创产业发展等措施,实现我国博物馆版权例外制度在数字时代下的良性变革。  相似文献

Two seasoned observers of the Russian oil industry analyze the country's policy response to developments in its mineral resources base (often perceived as an exploration crisis), with a focus on oil. The authors review and discuss trends in exploration (including its organization and efficiency), recent developments in its financing, and the reorganization of exploration activity. The evolution of Russia's licensing system is presented, drawing attention to changes that have affected incentives, risks, and barriers to potential resource users, both Russian and foreign. This article engages with recent work on the nature of the press in the late 17th and early 18th centuries that has emphasized that print, and more specifically printed news, came to dominate religious and political affairs. Recent scholarship has suggested that political elites embraced the new opportunities that the lapse of licensing (1695) offered by reading and buying newspapers and periodicals in ever greater numbers. Inherent in this portrayal of news culture is a sense that censorship had little effect on news‐writers. Journalists, so it is claimed, were left alone to pursue their trade free from any consistent interference. This article, by contrast, argues that scribal news – handwritten newspapers – continued to be important in the 18th century. The reason for the survival of scribal news‐writers such as John Dyer can be found, I argue, in understanding the complex relationship between press and parliament. Far from embracing the press, most members of parliament were, in fact, reluctant to allow unhindered publication of their discussions. While recognizing the importance of news to political debate, this article insists that the continued production of scribal news is indispensable for understanding both the nature of censorship and the power of the press in post‐licensing England.  相似文献

In Canada, Crown copyright permits government to assert control over its works. These Crown rights have often been justified on the basis that government must assert intellectual property rights so as to be better able to control the accuracy, integrity and quality of any information that reaches the public through Crown works. In this article, the authors examine GeoConnections' template agreements for the licensing of government geographic data. They argue that not only is the basis and scope of claims to intellectual property rights uncertain, the objectives of quality control, data integrity and accuracy do not appear to motivate the licence terms. The uncertainty as to the legal basis of the intellectual property claims is significant, as licences of this kind may give support to otherwise weak downstream claims by third parties to copyright in data products generated through the use of geographic data provided by the Crown.  相似文献

Do finite time horizons constrain a legislature's ability to control the bureaucracy? I argue that legislators subject to legislative term limits enact legislation with less statutory discretion today to ensure that their preferences are implemented by the bureaucracy tomorrow since most legislators will not be around to monitor the bureaucracy over the long term. Although past works suggest that legislative term limits decrease legislatures' rate of bureaucratic oversight, I find that term‐limited legislatures use ex ante means of bureaucratic control to a greater extent by granting less statutory discretion to the bureaucracy.  相似文献

Abstract

This paper will focus on the wreck of the Stirling Castle, which was one of four ships of the line to perish on the Goodwin Sands during the Great Storm of 27 November 1703. The Goodwin Sands lies off the south-east coast of Kent between Dover and Ramsgate. These sands are famously known as the ‘Ship Swallower’. This paper will discuss what has been learnt from the site’s investigations, the heritage management issues of preservation in situ, and offer a strategy for the future management of the site.  相似文献
