Though the evolution of prisons and the prison system in medieval Europe is a well-developed field in the history of law, little attention has been paid to prisons and incarceration on the frontiers of Latin Christendom. The present study makes use of archival and literary sources in order to examine how prisons functioned in Venice's most important colony, the island of Crete. As there has been no previous study of prisons and incarceration in medieval Greece, the article's first aim is to establish some basic facts about the prisons of Crete, such as their locations, their organization and their system of administration. More importantly, however, the study investigates the role that incarceration played in the legal system of the Venetian colony and attempts to set this role within the context of the juridical developments of the Late Middle Ages. Of particular interest is the question of how closely the legal system of the Venetian colony followed the judicial practice of the metropolis and whether it was influenced by the pre-existing legal institutions of Byzantium. Finally, the study also examines how the jurisprudence of the colonial regime dealt with offenders of different ethnic background and legal status.  相似文献

This discussion explores what difference a feminist perspective makes in our understandings of the past in two ways. The first section examines to what extent feminist research questions were asked in the preceding papers by Lu Ann De Cunzo, Eleanor Casella, and Susan Piddock. The second section shows what difference feminist theory has made in asking new questions that have produced new gendered understandings of the global historical context of these papers. As a whole, this discussion shows how feminist theoretical approaches change our understanding of the lives of historic women and men in nineteenth century reform institutions within their larger gendered cultural context. While the introduction to this volume presents the broader ungendered historical context, this discussion focusses on the gendered cultural context that was foundational to the gender relationships embodied in the arrangement of architectural spaces and material culture at the sites in the preceding three papers.  相似文献

The ‘conflict between politics and justice’ has been a central feature of the Italian ‘transition’ for reasons that touch on the essence of the so-called Second Republic. Apparently dominating the political agenda, it also functioned as a cover for a resurgence of coercive forms of social control in Italy. In response to the social transformations taking place throughout the western world, from the late 1980s the Italian prison system had been expanding and was used to target social marginal groups, especially foreigners and drug addicts. This paper examines how these changes took place, the juridical measures that gave rise to them and their political motivations in the period from the crisis of the First Republic to the declaration of a ‘state of emergency’ in the prison system which (at least for now) seems to have brought to a close the openly populist use of the criminal justice system.  相似文献

We gauge the relative impact of economics, demographics, and politics on the decisions of 79 rural North Carolina counties whether to site a prison in the period 1970–2000. The results of this model demonstrate that, contrary to the expectation that counties site prisons in response to economic distress, the demographic characteristics of each county affect the relative likelihood of a prison siting more than its economics does. The influential demographic predictors are those inextricably bound up with development options—the education levels of its citizens—and those that limit its ability to pursue controversial projects—its not-in-my-backyard (NIMBY) constituencies—rather than those that measure its racial diversity. Therefore, prison siting is neither a simple story of economic determinism nor one of environmental racism. We use a proportional hazards regression to model this innovation adoption in response to the challenge to select methods that take the potential time dependence of adoptions into account. A duration model is also particularly suitable for cases such as this one for which the innovation adoption is better understood as a process than as an event.  相似文献

Since the Registrar General began to count the signatures and marks made by brides and grooms in parish registers across England in 1839, contemporaries and later historians have used this data to describe rates of literacy during the Victorian period. Evidence from the marriage registers only tells us about the literacy of the marrying population at any given point in time. Moreover, by distinguishing between those who could read and write and those who could not, the marriage registers have helped to draw an artificial line between those who were literate and the rest of the population, ignoring the large number of semi-literates who played an important role in a society progressing towards mass literacy. This article uses data collected on the separate skills of literacy and the experience of schooling of those men, women and children who passed through the criminal justice system between c.1840 and c.1870 in an attempt to reconstruct patterns of skills acquisition among the lower classes during the Victorian period. Not only does this evidence further dispel myths about the existence of a so-called ‘criminal class’ with specific characteristics in Victorian England, but, even more importantly, it shows that the path towards mass literacy was uneven, far less predictable than previously allowed, and often only loosely tied to developments in formal schooling.  相似文献

The US has been engaged in coercive projects of counterinsurgency since the Indian Wars in the 19th century. Racist constructions of the enemy have been central to this process. Counterinsurgency has called forth new waves of contestation at every juncture, which has in turn shaped the very texture of military doctrine. This article draws on archival research, historical geography, and Marxist theory to trace the dialectics of counterinsurgency and insurgency through a series of turning points in US imperial history from the development of small wars doctrine in the 1930s to renewal of counterinsurgency during hybrid wars in Venezuela and Latin America in the current conjuncture. Through a conjunctural analysis, we argue that racism performs fundamental work in achieving consent to counterinsurgency wars, allowing capitalism to survive challenges to its legitimacy.  相似文献

In this paper I ask how might environmental justice studies scholarship be recast if we consider the phenomenon of environmental injustice as a form of criminalisation? In other words, since environmental injustice is frequently a product of state‐sanctioned violence against communities of colour, then what are the implications of reframing it as a practice of treating those populations as criminally suspect and as deserving of state punishment? Moreover, how are the targets and survivors of environmental injustice/racism enlisted in generative ways that resist that criminalisation and support abolition? I answer these questions through a consideration of how struggles inside and outside of carceral spaces represent urgent and timely opportunities to rethink the possibilities of environmental justice theory and politics by linking them to practices and visions of abolition ecology and critical environmental justice.  相似文献

This introduction discusses the western cultural context that connects the following three articles of site-specific research on the Adelaide Destitute Asylum in South Australia, the Ross Female Factory (prison) in Tasmania and the Magdalen Asylum in Philadelphia. These institutions are a few of the many types of nineteenth century asylums and prisons. Although some research issues are raised the purpose of this introduction is to provide a general historical context for the different research designs which are presented in the articles. While this introduction provides a largely ungendered historical background from ungendered sources, the companion feminist commentary following the articles addresses the gendered historical context and the feminist issues in the articles.  相似文献

Two political geographers examine significant ways in which northern-tier states of the EU-10 entrants in 2004 have challenged conceptions of European integration. The paper first focuses on the institution of exclusionary citizenship regimes, particularly in Latvia and Estonia, that created a new caste of "non-citizens" within the EU's boundaries. It then turns to the strained Polish-EU relations involving inter alia the war in Iraq, pro-Americanism, and alleged violation of human rights through the purported existence of CIA detention and interrogation facilities.
