论陕甘宁边区婚姻立法原则的修正——以边区司法实践为视角

中国共产党在陕甘宁边区试图对旧有的婚姻观念和婚姻形态进行较为彻底的改造,在一系列婚姻立法中提出了新型的婚姻原则和婚姻制度。但是,婚姻制度的变革并不仅仅是新旧观念的简单变化,它的变革还应该包括经济、政治、文化等诸多社会制度的变革。因此,考察陕甘宁边区的实际婚姻状况,从司法实践中发现边区处理婚姻纠纷的原则、规则,不仅可以使我们全面了解边区司法机关在推行婚姻立法原则过程中所起到的重要作用,同时也为当今我国构建和谐社会、完善婚姻家庭制度提供了有益借鉴。     

Playing with Fire: The 4th Duke of Hamilton's Jacobite Politics and the Union

James Hamilton, duke of Hamilton and the Scots jacobites are generally linked in analyses of the final years of the Scots polity. Indeed, Hamilton is often presented as the leader of the jacobite party in the Scottish parliament. Yet both contemporaries and historians have been unsure what to make of his on-again, off-again, conduct with respect to the exiled Stuarts and France. This has fuelled an ongoing debate about Hamilton's erratic and highly enigmatic behaviour during the winter of 1706–7, when the Union was passing the Scottish parliament. Was he genuinely opposing the Union? Was he duped by the court? Or was he, ‘bought and sold for English gold ’? This essay takes a fresh look at the duke and his part in the Union crisis in the light of new and previously underused jacobite sources with a view to better understanding Hamilton's aims, objectives, and influence with this crucial group. Only the jacobites and the Cameronians were potentially willing to take their opposition to the Union to God's Acre. But neither party immediately flew to arms in response to passage of a union they both believed was a betrayal of everything they held dear, and Hamilton was a major factor in their failure to do so. This essay thus takes a close look at the duke's part in preventing a major national uprising against the Union in the winter of 1706–7 and advances a new interpretation of his conduct and significance throughout the Union crisis.     

Towards an understanding of local protest: hospital closure and community resistance

The aim of this paper is to suggest an analytical framework through which the complex question of hospital closure and local protest can be further explored. The significance of this area of study lies with the extraordinary events that surrounded a campaign to save the Kidderminster General Hospital from downsizing. Whilst the hospital was not saved, the local campaign committee organizing the protest took their fight into the political arena and were successful in gaining a parliamentary voice in the 2001 general elections. Such an achievement has had considerable political implications, however, the question asked here is how might we begin to interpret the events that took place. To this end, the paper draws on current geographical literature in an attempt to construct a framework that accounts for both national policy debates and the local context within which such campaigns emerge.     

Point Chev boys and the landscapes of suburban memory: autobiographies of Auckland childhoods

This article uses a comparative analysis of two autobiographical texts to consider the ways in which the emotions and the imagination inform a sense of place. These autobiographies recount boyhoods in Point Chevalier, an Auckland suburb which embodies much that is emblematic of the mythology of early- to mid-twentieth-century childhoods in New Zealand. Both a modern suburb in a fast-growing city, and a richly particular coastal environment, it makes itself available as the setting for a childhood of the national imaginary. But as each of these narratives crosses the suburban terrain it produces a different understanding of what it meant to grow up as a male then, and there: in Halfway Round the Harbour Keith Sinclair never questions the fit between boy and place, or the certainty of his belonging and his identity; Peter Wells in Long Loop Home recalls a tumultuous boyhood increasingly marked by the threat of exclusion and intense family conflict. Between the two opposing trajectories of these texts, other possibilities are glimpsed. Place is created here by gender, sexuality and class; and masculinity is shaped and positioned differently for each of these boyhoods and the men who reflect on them. The affect of place marks the difference between these two Point Chevs.     

Slaves, servants and wage earners: Free and unfree labour, from Grotius to Blackstone

This article provides an intellectual history of the status of wage earners as conceptualized within the natural law paradigm by European writers both on the Continent and in Britain. Historians of political discourse have mostly investigated the consequences of such a status for the political rights of labourers. This article shows that the crucial moves were made by different authors analysing the relation of servant to master either in the domestic sphere or in private contracts. The article further contends that that resulting deeply ambiguous analyses implied a far from complete personal freedom for wage earners. This had a decisive impact on different visions of commercial society in early modern times, and left a significant legacy for moderns.     

Alberta’s Great Experiment in Senatorial Democracy

In 2014, the Supreme Court of Canada ruled that the unelected nature of the Senate is an inherent feature of Canadian parliamentary democracy and is a central pillar of the constitution. Members of the Upper House are appointed by the Governor General, acting on the advice of the Prime Minister. The decision taken by the Prime Minister is not subject to review by Parliament or the provincial legislative assemblies. Patronage appointments have given the Senate a reputation as a dumping ground for political friends and party insiders. In 1989, the province of Alberta enacted the Senatorial Selection Act, arguing that it would serve as a stepping stone for substantive reform to the Senate. The province has held four elections in which the people of the province have chosen senators-in-waiting. This article argues that the Court’s opinion in Reference re Senate Reform undermines the foundation upon which the provincial statute rests.     

‘Unlike Vancouver … here there’s nothing’: imagined geographies of idealized health care for LGBTQ women

This article explores imagined geographies of health care among Lesbian, gay, bisexual, transgender and queer (LGBTQ) women in Halifax and Vancouver. In expressing the possibilities and limitations of accessing care, participants frame their own experiences through spatialized narratives of how LGBTQ people are thought to be treated elsewhere. Participants’ explicit connections and distinctions between Halifax and Vancouver gave insight into how their perceived difficulties in one health care context are sometimes framed by imagining more ease in accessing care in the other. We explore here the implications of these imagined, idealized spaces, which may set up false expectations that things are always better elsewhere. We reveal imagined geographies and senses of place as highly relevant features in LGBTQ women’s accounts of experiences with and access to health care and expand conventional arguments about physical access to care.     

Intimate citizenship? Rethinking the politics and experience of citizenship as emotional in Wales and Singapore

Conversations around, and conceptions of, citizenship have changed over time. Assumed initially as a mark of membership, of belonging to a political community (Marshall 1950), the essence of what it means to be a citizen and what the contractual ties of citizenship are have evolved over time. This evolution has been encouraged by processes of migration and increasing mobility. More recently, our ability to traverse geographical and political boundaries has meant that notions of borders and boundaries, of who belongs where and why, have also been subject to dramatic changes. This article investigates the impact of such mobility on the individual lived experience of migrant women who, as a group, have been traditionally excluded from more formal political arenas, and asks questions of what citizenship means for them. Though I do not contest the very political fact of citizenship as status, this article challenges the way in which the nature of this status is assumed or implied for all. This article therefore argues that citizenship itself is a much more fluid concept, incorporating the emotional and lived experience of individuals and that it is in these emotional accounts through which citizenship, and its extended rights and political capabilities, must be understood through a sense of everyday, grounded and personal politics.
