与王韬、康有为、梁启超等人主要基于日本学者的二手著作而形成的法国大革命观不同,严复的法国大革命观与斯宾塞、柏克、托克维尔、雨果等人密切相关,呈现出直接的地道的西方渊源,他对法国大革命的研究是广泛和深入的,所关注的问题也颇有价值和意义,学理色彩浓重。

刑法规范法定原则是一项重要的刑法规范配置原则。其思想渊源是民主主义与尊重人权主义。民主主义要求刑法规范配置应当民主化,尊重人权主义要求刑法规范配置应当尊重人权。刑法规范法定原则包括法律性原则与明确性原则两个派生原则。法律性原则要求刑法规范的法律渊源应当是法律,刑法规范的内容应当依法规定。明确性原则包括刑法规范确定化与刑法规范明晰化两个方面。     

The Linguistic and Rhetorical Legacy of the Prague Spring: Reading the Czechoslovak Communist Party Daily,Rudé právo,from the Late 1980s

This study uses a corpus-informed lexicological approach to analyse texts published in the Czechoslovak Communist Party daily Rudé právo during the final years of Communist rule in Czechoslovakia. The analysis aims to uncover how far such texts represented a departure from or a reaffirmation of the norms of the pre-Gorbachev era and, in particular, the role that they played in the Party’s attempt to control interpretations of the 1968 Prague Spring. The investigation also considers ways in which the texts sought to construct a ‘new’ reality in the light of the changes in the Soviet Union and other Warsaw Pact countries. The article maintains that the ‘authoritative discourse’ model represents an especially useful analytical framework for evaluating the impact of ideological language in the context of the Communist system. The model both helps to explain the relative acquiescence of most of the population, and also to track the extent to which the ‘coded’ message of the approved discourse was successful in slowing the demise of the regime.

近二十年来中国社会稳定研究述评

社会稳定问题是事关改革开放和现代化建设的关键问题。在相当长的一段时间里,理论界关于社会稳定的研究囿于意识形态和政治因素,局限在狭小的范围,甚至有些领域被视为研究的禁区。随着改革的日益纵深,各种社会矛盾凸显,诸如农民因税费负担引发的抗争、工人因下岗失业引发的抗争、业主因权利受损引发的抗争等问题都亟需理论上的解释和说明。为此,研究者们从不同角度、不同层面对社会稳定问题进行了理论探讨,取得了不少有价值的成果。

中国历史上的南唐时期,因统治阶层倡导文治,文人价值观对社会精神起主导作用。在社会文化风尚的影响下,南唐画家的作品也呈现出文人化的倾向,文人画在五代已处于萌生状态,如诗、书、画开始结合于一体且书法用笔进入绘画。中国画在这一时代的发展对文人画的形成意义重大。     

Legalism as an Executive Ideology: Foundations of Barack Obama's Leadership Style

Abstract

The purpose of this commentary is to explore the sources of decision-making by President Obama. Specifically, the article notes his strong foundation in legal education, law journal editing, and early occupational activities related to law practice. It is observed that a legalist cast of mind rather than broad statements about race, class, and nation define the Obama early period in office. These considerations are often at the center of presidential options chosen, especially in areas of foreign policy and global challenges. The article claims that “legalism” serves to place serious limits on initiatives and independent actions, but also serves to put a brake on tendencies to impose a new imperial presidency. Such ideological checks and balances show unique dimensions to this president, but also continuity with past limits to extremism.

20世纪初的社会思潮突出反映了近代中国在学习西方进程中的不断进步。首先,将学习西方物质明与发展资本主义经济,挽救民族危亡,做了逻辑的联系。其次,开始了对西方制度化的学习,并伴以选择、改造、批判的理性态度。第三,在对自己民族与化反省的基础上,将对西方化的学习推进到观念意识层面,提出了人的近代化问题。
