Canada grants citizenship expansively to most persons born subject to its territorial jurisdiction. Canada’s Charter of Rights and Freedoms also treats naturalized and native-born citizens as equals. But new distinctions have emerged that threaten the equal status and rights of Canadian citizens. Here, I argue that the reemergence of the dormant historical norm of citizenship as allegiance is being used to cast citizens deemed disloyal out from Canada’s protection and supervision. First, I historically trace the erosion of equal citizenship status and rights in Canada under the guise of protecting native-citizens from security threats. Second, I offer a normative argument against the recent practice of denaturalizing Canadian citizens for their actions or questionable allegiances. I conclude with a preliminary recommendation for protecting the citizenship status of Canadians from revocation.  相似文献

ABSTRACT

Amongst Britain's former colonies the independent countries of the Commonwealth Caribbean represent something of an anomaly in so far as the majority of them remain constitutional monarchies and continue to retain the Judicial Committee of the Privy Council (JCPC) as their final appellate court, even though the region has had its own final appellate court – the Caribbean Court of Justice – since 2006. This is in marked contrast to Britain's former colonies in Africa and South Asia, the majority of which switched to republicanism soon after independence and at the same time abolished rights of appeal to the JCPC. This paper seeks to uncover the reasons for this anomaly by examining how the path that led to independence was shaped by a particular conception of Dominion status and by the willingness of nationalist leaders to embrace a dual identity: equal parts West Indian nationalist and Empire loyalist. It will also examine the phenomenon of the ‘postcolony’; being the persistence of the colonial order following the acquisition of constitutional independence. The paper has three aims. Firstly, to contribute to a better understanding of the impact of Dominion status and all that it symbolised in a region which is often overlooked in the scholarly literature on this topic. Secondly, better to understand the competing political forces that led three countries in the region to adopt republicanism, but inhibited its adoption elsewhere in the region. Thirdly, and finally, to enhance discussion of the complex nexus between republicanism and the abolition of rights of appeal to the JCPC where political and juridical considerations do not neatly align.  相似文献

This study brings together the often disparate scholarship on the League of Nations and the ILO. It follows the interactions between the League, women internationalists, and the ILO, which evolved around the question of woman-specific labor legislation and the equality of women's status. These interactions resulted in a broadening mandate of international gender policies while deepening the institutional and legal distinction between women's ‘political and civil’ as opposed to their ‘economic’ status. The ILO insisted on certain forms of women-specific labor regulation as a means of conjoining progressive gender and class politics, and was anxious to ensure its competence in all matters concerning women's economic status. The gender equality doctrine gaining ground in the League was rooted in a liberal-feminist paradigm which rejected the association of gender politics with such class concerns, and indeed aimed to force back the ILO's politics of gender-specific international labor standards. As a result of the widening divide between the women's policies of the League and the ILO, the international networks of labor women reduced their engagement with women's activism at the League. The developments of the 1930s deepened the tension between liberal feminism and feminisms engaging with class inequalities, and would have problematic long-term consequences for international gender politics.  相似文献

Partnership is an equitable exchange of knowledge. In fact, the very nature and indisputability of imported and taught knowledge—the scientific one and here archaeological—question the nature of the traditional and ordinary knowledge of peoples concerned. These two kinds of knowledge differ in the nature of the facts recognized by each of them: scientific facts or tacit common knowledge facts built differently, and in the number and strength of the external allies they succeed in mobilizing. Even if they remain translatable one into the other at a certain cost, they are engaged in a race. The result seems lethal for traditional knowledge unless powerful nonscientific allies, opposed to this leveling standardization, get involved with researchers aware of the stake for the South but also for the North, committed for some centuries to a rationalization supported by science, its technics, and the socioeconomic powers able to fund them.Le partenariat est un échange équitable de savoirs. En réalité, la nature et l'indiscutabilité du savoir importé et inculqué—le savoir scientifique et ici archéologique—met en cause la nature du savoir ordinaire et traditionnel des peuples concernés. Ces deux formes de savoirs diffèrent par la nature des faits reconnus par chacun d'eux: faits scientifiques ou faits du savoir observationnel ordinaire, construits différemment, et par le nombre et la force des alliés extérieurs qu'ils réussissent à se donner. S'ils sont traduisibles l'un dans l'autre à un certaincoût, une course est néanmoins engagée entre eux. Development studies employs theories, tools and methods often found in geography, including the international field trip to a “developing” country. In 2013 and 2014, I led a two-week trip to Ethiopia. To better comprehend the effects of “the field” on students’ learning, I introduced an assessed reflexive field diary to understand what the field trip experience teaches students about themselves and their relationship to the field. In this paper, I present critical reflections on “the field” that speak to a provocative concept – “the tropics”. These reflections illuminate prevailing challenges in the study and practice of development and suggest a way forward.  相似文献

Archaeological research in central‐northern Patagonia (Atlantic coast and lower the valley of Chubut river) showed that this area was used since at least the Middle Holocene. Stable isotope analyses (13C and 15N) of human bone samples indicate that hunter‐gatherers living in that area had a terrestrial‐marine diet including guanaco meat, land plants, mollusks and pinnipeds. Despite this general trend, intersite variability and changes through time were noted, especially after the late Holocene. These results have been reinforced by archaeofaunal, technological and bioarchaeological records. In this paper, three hypotheses are examined: (a) the diet of these populations was complete and rich enough to ensure good health status and avoid nutritional deficiencies; (b) carbohydrate consumption increased progressively after 1000 BP, when pottery technology was adopted and (c) this kind of mixed diet would have been qualitatively more nutritious than that of other populations of the region, which would have resulted in better nutritional and healthy conditions. These three hypotheses are compared with dental results obtained from 563 permanent teeth from 45 individuals (34 adults and 11 juveniles from both sexes), rescued from burial sites. Indicators of oral health were assessed through the observation of caries, abscesses, wear, pulpar cavity exposure and ante mortem loss. Features of nutritional status such as enamel hypoplasia, porotic hyperostosis and cribra orbitalia were also examined. Given the availability of direct radiocarbon dating for most of the sample, three temporal series were determined: ‘Before 1000 BP’, ‘1000–5000 BP’ and ‘Post‐contact’. No evidence of alimentary stress or iron deficiency was found in individuals from the three series, which accounts for healthy and good nutritional life conditions. After 1000 BP, the results show a progressive increase in the caries percentage and a decrease in abscesses, dental wear and ante mortem losses frequency. This is possibly related to more consumption of processed foods in the last 1000 years. These results were compared with similar studies based on samples from different environments and latitudes of Patagonia. Evidence suggests that mixed diets (marine‐terrestrial) would have been more appropriate and nutritionally complete than exclusively marine or terrestrial diets. Hamstrung by weak institutions that undermine conventional environmental regulatory tools, policymakers in developing countries are increasingly turning to voluntary approaches. To date, however, there have appeared few evaluations of these policy experiments. To help fill this gap, we summarize arguments for and against the use of voluntary regulation in developing countries, review the nascent literature on the topic, and present case studies of agreements negotiated between regulators and leather tanners in an industrial city in Mexico, a national environmental audit program in Mexico, and a national public disclosure program in India. Admittedly few in number, these three case studies nevertheless suggest that although voluntary environmental regulation in developing countries is a risky endeavor, it is by no means doomed to failure. The risks can be minimized by emphasizing the dissemination of information about pollution and pollution abatement options and by avoiding voluntary approaches in certain situations—those where regulatory and nonregulatory pressures for improved environmental performance are weak and where polluters can block quantified targets, individual sanctions for noncompliance, and other widely accepted prerequisites of effective voluntary initiatives.  相似文献
