This paper argues that the moral legitimating reasoning of terra nullius assumed an under-recognised, different guise in the later years of colonial justification in the form of trusteeship. The idea of terra nullius has a central place in the political thought of thinkers such as Grotius and Locke. Although terra nullius, consolidated in European colonial thought in the early modern period, differed conceptually from the doctrine of trusteeship as the colonial legitimation for Africa, both instituted a moral justification for the appropriation of native land, and of empire itself. The contention is that the trajectory from the one doctrine to the other was aligned with the change in the underlying moral framework of the rights and duties of Europeans and non-Europeans. In the early days of colonisation, there was a certain permissiveness on the part of the colonisers to appropriate the land of American Indians. By the late nineteenth century this seemed to change into a moral requirement for civilising the native Africans. Edmund Burke's conceptualisation of trusteeship illustrates the way in which traditionally conceived natural rights were transformed into fundamental social rights, and central to this idea was the expansion of European ‘civilised’ moral communities on which rights now depended.

Burke's view of history is an aspect of his thought that has been largely neglected by scholars, despite the wide recognition of its importance. In Burke's view, history, led by providence and by a human nature designed by God, is necessarily progressive. It is, nevertheless, human beings who are largely responsible for building their nations. A variety of civilisations could be generated if people governed a nation in harmony with its peculiar manners and circumstances. Nations can, however, be unstable, because their fortunes fluctuate. Although Burke was very familiar with—and influenced by—several different traditions of historiography, his ideas on history should also be seen as the product of his own reflections.

The 1854 Ostend Manifesto has long been scorned as an expansionist treatise, a leading indicator of “Young America's” hold on the antebellum Democratic Party, and a signal of Franklin Pierce's failed presidency. Unnoticed is the genesis of the document's most famous metaphor, of Cuba representing a neighbor's “burning house” that could cause American intervention. The primary author of the Manifesto was minister to Great Britain and future president James Buchanan, and he attempted to smooth over the rough suggestion of an American takeover of the island by borrowing imagery from Edmund Burke's 1791 Reflections on the Revolution in France. Buchanan's use of Burke, the anti‐revolutionary English philosopher of prudence and critic of ideology, demonstrates the wide but underappreciated popularity of Burke with American politicians of all parties. Not just Whigs and Southern planters, but also Northern Doughface Democrats such as Buchanan, especially in the 1850s, used Burke to preach calm, moderation, and political prudence. As his use in the Manifesto makes clear, a larger study of Edmund Burke's appeal to Americans is badly needed to plot his broad influence on American politics leading up to the Civil War.

Abstract This article explores and defends Leo Strauss's interpretation of Edmund Burke's thought. Strauss argues that Burke's conservatism is rooted in the modern empiricist school of John Locke and others. Following Strauss, this article sets out to consider the suitability of these foundational principles to conservative politics. Burke wants to temper or ennoble Lockean politics by inspiring sublime attachment to the political community and its traditions, but he shies away from stating universal standards according to which the traditions of political communities ought to be judged. This respect for reason in history without moorings in transcendent standards of reason or revelation leaves his conservatism on precarious ground.

Edmund Burke’s speeches and writings during the trial of Warren Hastings—from 1788 to 1795—remain one of the most comprehensive assessments of the effects of colonial trade and territorial expansion on Britain’s nationalist self. A rhetorical reading of his prosecution speeches reveals how they affected the public response to the trial by evoking the sublime and framing terror as the basic feature of Britain’s mercantile imperialist agenda in the colonies. Moreover, by associating Hastings’s governance of Bengal with sublime terror, Burke altered the interpretations of virtue and corruption, thus distancing both Britain and India from the rampant profiteering of the East India Company. Burke’s critique of the degenerative influences of commercial imperialism along with the reformulation of his ideas in subsequent colonial historiography is crucial for assessing how the aesthetics of the sublime conferred greater moral force to the sporadic and fragmented reports about the Company’s abuses of power in India.

Although ‘Burke and Irish history’ is a theme which has long been known to modern commentators, it has not necessarily been addressed sufficiently. This essay seeks to put forward a more comprehensive account of Burke's views on Irish history than has previously been offered by scholars. According to Burke, the protection of Christianity had brought flourishing science to seventh- and eighth-century Ireland. Nevertheless, the nation was plunged into a barbarous state after the invasions of the Danes and other northern tribes. Burke's sympathy with the Brehon law was possibly unique, although he was not uncritical of it. Unlike the Irish patriots, his chief concern with historical Ireland was not the origins of the Irish legislature. He was rather most interested in the religious affairs which had continued to plague the nation during history. Throughout his career, Burke considered the Irish Rebellion of 1641 to have been ‘provoked’, and continuously endeavoured to remove the penal laws imposed on the Roman Catholics after the Williamite Conquest of 1689–1691. In his view, despite the substantial increase in prosperity after 1688/9, the series of religious persecutions, as well as other oppressive policies, had still obstructed the further progress of Irish society.

SUMMARYThis essay combines the study of Humboldt's sources with a critique of the treatment of this subject in most studies of Humboldt and his linguistic thought. One crucial issue is the date of his early ‘Über Denken und Sprechen’, which is our first evidence of his mature thinking about language. This text is conventionally dated 1795, thus ruling out that Humboldt might be indebted to the anthropo-linguistic philosophy that he explored in Paris a few years later. But a host of facts make the date untenable and the debt unquestionable, including incontrovertible evidence that ‘Über Denken und Sprechen’ relies on Condillac's argument for the anti-idealist principle that the distinction between subject and object is the absolute precondition for self-awareness and reflection, and thus, by the same token, for the concept of Weltansicht. ‘Über Denken und Sprechen’ also shows that Humboldt was inspired to choose Condillac's and Destutt de Tracy's argument over that of Fichte for what Berkeley disapprovingly called ‘outness’. This analysis exemplifies the critique that is advanced in this essay.

Many historians of Australian political thought have attributed its pragmatic and anti-speculative tendencies to a Benthamite influence. Without denying the influence of Bentham and Benthamism on Australian thought and institutional development, this article challenges the assumption that the abovementioned tendencies necessarily betray a Benthamite heritage. By analysing the theoretical justifications for pragmatic, anti-speculative approaches to institutional design in the Federation debates (1890–1898), this article shows that there was a very strong Burkean impulse behind the sort of pragmatism that is usually attributed to Bentham. If the argument of this article is correct, then it is an invitation for historians and political scientists to reconsider significantly the nature of Australian political thought.
