The Indonesian Family Planning Programme: A Success Story for Women?

The Family Planning Programme of Indonesia is constantly being hailed as a success story for its performance in reducing fertility rates in many parts of the country. This paper examines what this apparent success has meant for women, taking women's rights to the control of their fertility as the necessary aim for all family planning programmes, and the safeguarding of their reproductive health as an obligation. In the paper, the aims and methods of the Family Planning Programme are examined separately, in order to assess on the one hand the extent and the manner in which women's interests are acknowledged in its objectives, and, on the other, whether in its implementation the programme takes into account the needs of women, both as recipients and as family planning workers. The main conclusion of the paper is that the priorities, style of implementation and service delivery of the programme do not provide women with the means of regulating their fertility autonomously through access to freely chosen contraceptives and related services. In addition, the paper concludes that the safeguard and improvement of women's reproductive health is not among the concerns of the programme, in principle or in practice.

Barrister gender and litigant success in the High Court of Australia

We examine the relationship between gender of the barrister and appeal outcomes on the High Court of Australia. We find that an appellant represented in oral argument by a female barrister, opposed to a respondent represented in oral argument by a male barrister, is less likely to receive a High Court justice's vote. However, we also find that the appellant disadvantage of having a female barrister present oral argument is (partially) offset in the case of liberal justices and on panels having a higher proportion of female justices. The extent to which the disadvantage is offset, and potentially turns from being a disadvantage to an advantage, depends on the degree to which the justice is liberal and the proportion of female justices on the panel.

Historical Consensual Norms in the High Court

There is a substantial political-science literature that discusses the notion of consensual norms in the US Supreme Court. Most of this literature assumes that consensual norms exist, rather than proving their existence. Caldeira and Zorn ( American Journal of Political Science 42: 874-902, 1998) use the method of cointegration developed in econometric time-series analysis to prove the existence of a single consensual norm in the US Supreme Court. This study applies cointegration analysis to historical time-series data on dissenting and single judgments to examine whether there is a single consensual norm in the High Court of Australia. The study finds that a single consensual norm does not underlie decision making in the High Court. This result is explained on the basis that the institutions underpinning decision making and the approach to decision making are different between the Australian High Court and the US Supreme Court.     

Global Environmental Governance and the Challenge of Shadow States: The Impact of Illicit Sapphire Mining in Madagascar

The environment has become a key site of global governance because of its transboundary nature: forests, wildlife and oceans have all become central foci for networks of global governance which link international organizations, international financial institutions, states and non‐governmental organizations. This article examines how contemporary forms of global governance can be challenged and even subverted. It uses the concept of shadow states introduced by William Reno to explore how invisible global networks flow through developing states, to show how they constitute important political and economic interest groups, and to assess what kinds of environmental impact they have. It explores how powerful these networks are, and whether they are able to challenge or subvert attempts to manage, control or govern the environment. The author provides an analysis of the ways in which the clandestine networks of shadow states impact on conservation initiatives in the developing world, focusing on the features of global environmental governance and the problems posed by illicit gem mining and trafficking in Madagascar.     

Two dramatic treatments of the ‘Déirdre’ legend: a case study in Irish betrayal

During the heightened cultural activity of the Celtic Revival, the moral ownership and utilisation of Ireland's literary remains became an important cultural issue. At the same time, many nineteenth- and early twentieth-century Irish writers were concerned to ‘retell’ ancient stories in ways which explored their relevance to the modern world. One of the most retold tales from the period was the story of Déirdre and the Sons of Usnach. The story of Déirdre broaches one of the most ubiquitous of human experiences – betrayal – and it does so in relation to both political and interpersonal behaviour. This essay examines two dramatic treatments from the early years of the century: W.B. Yeats's one-act Deirdre (1907) and J.M. Synge's Deirdre of the Sorrows, unfinished at the time of his death and finally published in 1910. This essay looks to account for the particular ways in which each author inflects the legend in terms of their own concerns, and in particular how both Yeats and Synge engaged with a discourse of betrayal that – although always significant in Irish cultural history – was moving to a position of centrality in Irish national life in the years leading up to the revolutionary period.
