Gisèle Halimi entre plainte et plaidoyer: ‘On naît avocate,on ne le devient pas’

This intellectual portrait of defence lawyer and feminist activist Gisèle Halimi tests the hypothesis that her writings function like one long closing argument in a courtroom, where a passionate ‘I’ fights for Justice not only by making sure that the Law is upheld but, when necessary, trying to change the Law with the weapons authorised by the judicial system—narratives and stories. Each word is at the service of the overall agenda. One of the unexpected textual consequences of this ethical position is that it becomes radically impossible to separate autobiography from history, or the voice of the renowned public figure of Maître Halimi from Gisèle's ‘I’.

The article takes issue with W. G. Runciman's contention, in Great Books, Bad Arguments, that modern political development has moved beyond both theory and practice of governance by a sovereign power over subjects as expounded in Hobbes's Leviathan. Runciman's allegations that Hobbes overrates education, that he fails to recognise the potential for dissent and revolt in a polity under a sovereign, and that he ignores society's pre-political scope and its post-absolutist, eventually democratic prospects, are checked against the text and argument of Leviathan. Runciman's contention that government without subjection has been achieved in modern constitutions is confronted with Hobbes's resistance.     

Libertés et Sûreté les Mutations de L’État de Droit

The right to safety submits the State to the law even when it can legitimate attacks on liberties apparently contrary to the State of law. We propose to analyze here the mutations of the State of law, notably since the externalisation of the state of exception after 2001 and the appearence of regimes of suspicion such as the expression of three legal processes distinct from suspension, skirting and diversion. It is a question of recalling how, beyond the distinction between authoritarian and liberal policy, a double movement, internal and international, of constitutionalisation and internationalisation of the systems of law constitues a ferment of resistance, limited but already effective to all reasons of State.
