Adam Gopnik once observed that "Paris is a struggle between its pompous official culture and its matchless … commonplace civilization." The aphorism applies even more clearly to the Supreme Court. It is an institution cloaked in formality, from the ceremonies of First Monday to the grand generalities it invokes in its ruling. It is also an institution that takes itself extremely seriously, with its strongest opinions penned when it thinks another institution—Congress in passing Commerce Clause legislation or the Religious Freedom Restoration Act, the Florida supreme court during  Bush v. Gore —is treading on the Court's privileges. The Court's pompous officious culture contributes to the studied cynicism lawyers exhibit whenever they talk about judges.  相似文献

In the second half of the nineteenth century, American Presbyterian “home” and “foreign” missions developed parallel and mutually reinforcing policies towards freed slaves in Egypt, Sudan, and the U.S.A. as well as towards Egypt's indigenous Christians, the Copts. Yet the racial ideologies and social hierarchies of these three countries reflected distinct historical trajectories of migration and conquest. In the Nile Valley, American missionaries struggled to understand, address, and sometimes revise Egyptian and Sudanese social hierarchies, which they found alternately idiosyncratic or unjust. This essay conjectures that these interactions, in the long run, induced the Nile Valley missionaries to confront the lingering injustices and incongruities in American social hierarchies, particularly in the mid‐ to late twentieth century. In this way, the “foreign” mission experience had a backflow for missionaries and their church by raising questions about American racial orders and by strengthening a commitment to civil rights and social justice agendas.  相似文献

This article explores the ways in which cartography served as a tool to reinforce racial divisions in the context of late nineteenth and early twentieth century race science. Racial and anthropometric mapping was an endeavour in which both European and new world anthropologists and geographers were involved. The focus here is on the work of Thomas Griffith Taylor – regarded as one of the founders of modern geography in Australia – who deployed a number of cartographic techniques to reinforce his racial theorisations. This article explores Taylor's ‘zones and strata’ portrayal of racial evolution, and other geological‐ style maps of racial difference. These representations are investigated from two standpoints. Firstly, Taylor's theories are situated within the wider context of the Victorian tradition of classifying race, a tradition where physical race type was often correlated with moral and intellectual traits, and which was supported by the acceptance of environmental determinism within geographical circles. Secondly, his maps are considered from the perspective that, as J.B. Harley has argued, maps are social texts that contain power and, as such, can be deconstructed. Taylor's cartographic representations resulted from the manipulation of the internal elements of the map text, such as shading and projection, and were supported by the widely held belief that human racial groups could be delineated through physical anthropometry.  相似文献

Europe and the United States—the West—urgently need political leadership, economic fortitude and a clear vision of the future if they are to contend with the challenges posed by emerging regional powers and to resist the downward pressures of ‘relative decline’, the central focus of David Marquand's book, The end of the West: the once and future Europe. Central to this goal will be the West's ability to ‘rebalance’ between its institutions and democracy; its power and commitments; and its political and moral authority. Europe must ‘rebalance’ on issues related to ethnicity and identity, governance and authority, and civilization and territory. EU enlargement and its institutional reform processes have exacerbated this imbalance. American foreign policy objectives currently exceed its resources and are hampered by lack of strategic clarity and intellectual vision which keeps the United States from achieving an adaptive leadership model more capable of successfully operating in an increasingly complex and multipolar world. For Europe to become internally healthy and externally productive—both politically and economically—it needs to regain balance between its utopian, institutional objectives and democratic support for its future ambitions and policy course. Strong leadership and a powerful vision of prosperity from the West will be vital to return the transatlantic partnership to global economic and political advantage.  相似文献

This paper summarizes the results of recent research on the Mesolithic and Neolithic periods in the Channel Islands and focuses on the integration of new information into the long‐ running efforts to explain the processes by which the Neolithic became established in Guernsey and the other Channel Islands. This research builds on Kinnes's work on the complex monument at Les Fouaillages, Guernsey in the early 1980s and the review by Patton of Neolithic communities in the Channel Islands in 1995. Many rescue and research excavations in Guernsey have provided new evidence which informs the complex relationships between Guernsey, the other Channel Islands and the north‐west of France at the time of the Mesolithic and Early Neolithic. Analysis of the data takes into account recent French research (and in particular Cassen et al. 2000 and Guyodo and Hamon 2005 ). Also, at the time of writing, Kinnes's work on Les Fouaillages is being prepared for publication ( Kinnes et al. forthcoming , see below). The developments are discussed against new and existing data for rising sea levels and the consequent isolation of Guernsey as an island.  相似文献

We here report the results of a programme of AMS dating and stable isotope analysis on human remains from the chambered tomb of Le Déhus, Guernsey. An early use‐phase in the range 4100–3900 BC is indicated, confirming the monument's attribution to the Middle Neolithic II as defined in western France. Late Neolithic burial activity is also identified. Stable carbon isotope measurements provide little or no evidence for the consumption of marine foods, although stable nitrogen isotope values are unusually high. These results are situated in the wider context of Neolithic mortuary monuments of the Channel Islands and Normandy.  相似文献

In 1959, a Northern Territory bureaucrat refused permission for Mick Daly, a non-Aboriginal drover, to marry his Aboriginal girlfriend, Gladys Namagu. Their case sparked a national controversy involving federal and state politicians, academics, the media, and even the United Nations. This article reconstructs the story of Gladys and Mick's romance, comparing their particular corporealities to that conjugal body demanded as the 'proper' subject of matrimony. In their troubled courtship, how was marriage deployed as a regulatory strategy, and how did the specificities of race disrupt or contest the corporeal body politic discursively figured therein? The story of Gladys and Mick is part of a longer work in progress concerning 'the conjugal body politic'-the corporeal, political subjectivities produced and regulated in Australian legislation on marriage and marriage-like relationships.
