重评1946年《中华民国宪法》

1946年《中华民国宪法》是在政治协商会议已经召开、并通过了宪草修改十二条原则的背景下由非国民党人士起草的,因此,与此前国民党一党制定的“五五宪草”比较,存在着一些重大区别。这些重大区别表明：与“五五宪草”不同,1946年《中华民国宪法》多多少少带有一些民主性质或色彩。这些民主性质和色彩是中共、民盟以及全国人民和国民党斗争的结果。     

论毛泽东的文艺批评思想

毛泽东继承和发展了马克思主义文艺批评理论,提出了政治标准与艺术标准相统一的文艺批评思想。他还指出,文艺批评应在创作主体态度与客观效用的关系上遵循动机与效果相结合、在批评方法上革命性与科学性相统一的原则,做到专业批评与群众批评相兼顾,全面系统、科学合理地展开。     

博物馆文物保存环境质量标准研究

我国大气污染严重,环境质量恶化使文物受损影响日益明显。上海、重庆、广州三市博物馆环境质量检测调查说明其现状与文物保护的要求还有相当距离,有些甚至还处于污染相当严重的地步。博物馆文物保存环境影响因素主要是温湿度、光线(可见光、紫外光)、污染气体(包括尘埃),不同材质的文物受各种环境因素影响在程度上是不同的。有的是起主要作用,有的则是起协同增效作用。研究其反应机理、反应速率,量化它们之间的关系,将是制定出文物保存环境质量标准的重要依据。 文物保存环境质量标准要求达到最大限度降低环境因素对文物所造成的损害,但受治理技术、监测技术、经济的许可、合理程度等方面的制约,制定分级标准将有利博物馆的环境治理实施和监测。     

中国旅游饭店星级标准前瞻研究

《旅游饭店星级划分与评定》标准自颁布实施以来,对我国旅游饭店业实现历史性跨越具有不可替代的作用。但随着时代与市场环境的变化,现有星级标准已越来越难以适应我国饭店业产业结构升级和饭店企业竞争力提升的需要,星级标准的修订迫在眉睫。本文在总结历史经验与深刻剖析行业现状的基础上,从标准的共同性、重复性和市场性3个要素角度,对标准的内涵作出新的解释,并对星级标准的修订明确提出了8条前瞻性建议。     

The Softwood Lumber Dispute and US Allegations of Improper NAFTA Panel Review

The dispute over Canadian exports of softwood lumber products to the United States (US) has lasted since 1982 and, so far, has gone through four episodes of litigation. In Lumber IV, the US International Trade Commission (ITC) determined that the US softwood lumber industry was threatened with material injury by reason of dumped and subsidized lumber from Canada. Under the North American Free Trade Agreement (NAFTA), a binational panel concluded, however, that there was no such evidence and directed the ITC to reverse its finding. In its resort to the Extraordinary Challenge Procedure, the US alleged that the injury panel had misapplied the US standard of review. In fact, allegations of improper NAFTA panel review were used by the US in order to justify its non-compliance with adverse binding decisions.     

LGBTQ rights,conservative backlash and the constitutional definition of marriage in Romania

Abstract

One of the hottest topics on the most recent Romanian public agenda concerns the organisation of a national referendum on the constitutional amendment of the definition of marriage. This article seeks to understand the dynamics between the LGBTQ groups, the conservative responses and the articulation of each other’s strategies and tactics based on the opportunities created by both contenders. By analysing the history of their opposition, the international context dominated by a populist and nationalist narrative and the domestic synergies within society, it demonstrates that the intense debate on the referendum should be understood as a critical turn in the evolution of the LGBTQ rights.
