ABSTRACT

Over the past century, the ‘culture and trade’ debate has constantly evolved, particularly in the wake of rapid and still accelerating technological and scientific advances. These changes, manifest in an increasing convergence of many new technologies and industries, meant that the strict separation of culture from trade by means, for instance, of general or special exceptions in international trade agreements, such as the 1947 General Agreement on Tariffs and Trade (GATT) or the 1988 Canada–United States Free Trade Agreement (CUSFTA), can no longer be sustained. It means that in light of the emergence of oxymoronic concepts like ‘the cultural and creative industries’, the debate can no longer be framed along binary modes of thinking that oppose the liberalization of international trade and the protection and promotion of the diversity of cultures. Instead a more holistic approach seems to be needed, which appears to coincide with the approach taken by the People’s Republic of China (PRC), which joined the WTO in 2001. The present paper examines the holistic approach by the PRC, which seeks to combine rather than separate culture and trade in its domestic, regional and global law and policymaking.  相似文献

ABSTRACT

There is a norm assuming high mobility in the Western world today, which can increase the social and geographical exclusion of those who have limited possibilities to travel, such as people with disabilities. When it is a child who has the disability, travel-related constraints are likely to affect the whole family’s travel patterns. This study explores travel constraints among Swedish families with children with cerebral palsy who use wheelchairs. A time-geographical framework is employed. Interviews with parents show that these families’ everyday mobility is affected by authority, capacity and coupling constraints, and that it is often a combination of these constraints that makes travelling difficult. The families use different strategies to negotiate these constraints. In addition to strategies controlled by the families, the findings suggest that there is also a need for governmental support and a barrier-free transport system to enhance their mobility.  相似文献

Since 2009, Innu members of the community of Ekuanitshit have faced a major hydroelectric project on the Romaine River, an integral part of the Nitassinan, their ancestral territory. In this paper, we study the project's impacts on the material and ideational relationship the Innu have with the river. We explore the idea that the project transforms the traditional relationship to territory into a more pragmatic one, marked by economic and political interests. Our analysis reveals that the Innu's territorialities, though partly transformed by increased contact—and sometimes conflict—with hegemonic non‐indigenous society, remain anchored in a strong cultural heritage and a deep identification with territory. We argue that these seemingly differentiated conceptualizations, of traditions on the one hand and development on the other, are not incompatible. These conceptualizations comprise dynamic cultural, social, and political territorialities which are thus internal and external, ancestral and contemporary.  相似文献

In order to construct a suitable transport policy, based on the needs of the inhabitants and city users, planners have to be aware of the needs of urban residents. In this research, Hägerstrand’s space‐time geography is used to understand constraints that individuals from contrasting livelihoods experience regarding their daily mobility in Kampala. To carry out economic activities, both poor and non‐poor face the need to travel, but moving in the city is hampered by congestion and poor walking infrastructure. While non‐poor have the financial and economical flexibility to adjust the time and transport mode of their movements, the poor are constrained by affordability. Space‐time prisms of the movements show that paradoxically the further the distance from the centre, the less movement is undertaken by the non‐poor and more movement by the poor. The policy responses, driven by foreign investments, mainly from China, show that policy circulation plans prevail over tailor‐made solutions.  相似文献

This essay explores the significance of the Elizabethan house of commons meeting in a converted royal chapel within the Palace of Westminster. In 1548 the dissolved collegiate chapel of St Stephen at Westminster was given over to the exclusive use of the Commons, providing MPs with a dedicated meeting space for the first time. Although a great deal has been written about Elizabethan parliaments, little attention has been paid to the physical spaces within which MPs gathered, debated and legislated. Drawing on parliamentary diaries and exchequer records and informed by digital reconstructions of the Commons chamber modelled by the St Stephen's Chapel project at the University of York, this essay argues for the enduring influence of the architecture and decoration of the medieval chapel on the procedure, culture, ritual, and self‐awareness of the Elizabethan house of commons. Famously likened to a theatre by the MP and writer on parliamentary procedure, John Hooker, the Commons chamber is analysed as a space in which parliamentary speeches were performed and disrupted. The sound of debate is contrasted with other kinds of noise including scoffing and laughter, disruptive coughing, and prayers led by the clerk and the Speaker of the Commons. The iconography of the chamber, including the royal arms above the Speaker's chair and the mace carried by the serjeant‐at‐arms, is interpreted as enabling a culture of counsel and debate as much as an assertion of monarchical power. Evidence is also presented for the Commons chamber as a site of political memory.  相似文献

This study brings together the often disparate scholarship on the League of Nations and the ILO. It follows the interactions between the League, women internationalists, and the ILO, which evolved around the question of woman-specific labor legislation and the equality of women's status. These interactions resulted in a broadening mandate of international gender policies while deepening the institutional and legal distinction between women's ‘political and civil’ as opposed to their ‘economic’ status. The ILO insisted on certain forms of women-specific labor regulation as a means of conjoining progressive gender and class politics, and was anxious to ensure its competence in all matters concerning women's economic status. The gender equality doctrine gaining ground in the League was rooted in a liberal-feminist paradigm which rejected the association of gender politics with such class concerns, and indeed aimed to force back the ILO's politics of gender-specific international labor standards. As a result of the widening divide between the women's policies of the League and the ILO, the international networks of labor women reduced their engagement with women's activism at the League. The developments of the 1930s deepened the tension between liberal feminism and feminisms engaging with class inequalities, and would have problematic long-term consequences for international gender politics.  相似文献

In this article I examine the relations between Jacob’s putative oral story and the pre-Priestly narrative. I argue that Hosea’s prophecy presents the version of Jacob's oral story related in his time and antedated by many years the composition of the story-cycle in its written form. Comparison of Hosea’s prophecy and Jacob’s narrative indicates the thorough way in which the exilic author worked the oral story he received in order to fit it to his ideological messages and religious concepts. To further examine the relations between the oral and written modes, I discuss the episode of the treaty between Laban and Jacob (Gen 31,45–54) in light of a Mari letter (A.3592). Comparison of the two episodes indicates that part of the biblical narrative rests on the oral story and other part was written by the late author. Evidently, the long process of oral transmission, the growth of the narratives in its course, and the creative reworking of the author make it impossible to either isolate the early oral layer within the present story-cycle or to date the stages of its growth in the oral process of transmission.  相似文献
