浅析上市公司"资金占用"问题

上市公司“资金占用”问题,既反映出大股东与中小股东的利益冲突,也反映了现行法律制度对此的规范和约束存在缺陷.本文针对控股股东利用合同形式和滥用控制权直接侵占资源的问题,对“资金占用”行为进行了分类定性,提出制定和完善相关法律制度的基本思路.     

RAPID REGIONAL ENLARGEMENT IN SWEDEN: A PHENOMENON MISSING AN EXPLANATION

According to Swedish register data, regional size and the extent of commuting have both increased rapidly in recent decades. From the perspective of policy-making authorities, this would indicate good prospects for regional development, as small regions could be integrated into larger ones resulting in increased economic growth. However, there are few concrete manifestations of such regional enlargement, and alternative datasets give other impressions of the effects of commuting. Here we argue that this apparent growth might stem from several problems inherent in a register-based way of measuring changes in commuting patterns. Thus, regional enlargement and the extent of commuting may be exaggerated when measured conventionally, and the high hopes of using such enlargement to lever regional development might be misplaced. More generally, this study considers the problems arising as census or other enquiry and interview based data are replaced by register data.     

Writing in wartime China: Chongqing,Shanghai, and Southern Zhejiang

ABSTRACT

The outbreak of the full-scale Sino-Japanese War (1937–1945) brought an end to the printing and publishing industry centered in Shanghai in the 1930s. Chongqing then emerged as a nerve center of information and opinion. Writers everywhere worked under wartime conditions of social dislocation, economic dependency, and political control. This article examines the writing and publishing of three notable pieces of work completed in wartime Chongqing, Shanghai, and southern Zhejiang, respectively. The article explores the context in which each work was written and then evaluates the broader significance of the texts with regard to a historical assessment of the Chinese intellectual experience during wartime.

国家宏观政策和市场物价水平在地方的传导存在一定的时滞期。本研究分析货币政策、投资政策和进出口政策对青海传导的执行时滞以及农畜产品价格、工业产品价格和生活消费品价格波动对青海传导的时滞性特征，以期为相关政府部门决策提供参考。     

Where to draw the line: the difference between a fan and a pirate in Japan

ABSTRACT

This article examines the gap between the public discourse favoured by right holders and politicians for strict copyright enforcement and industry practice where infringement is tolerated and sometimes even facilitated by the same right holders. Drawing on the Japanese contents sector surrounding Manga, Anime and video games, the interaction between strict copyright provisions, positive and negative market impact and broader considerations such as reputation and pay-offs are contextualised. It is demonstrated that right holders do not see infringing behaviour as such as a cause of action nor does it dominate how right holders want users to interact with their products. Instead, it is the wider context which determines if copyright will be enforced or not. Based on an analysis of copyright law, stakeholder interviews and observations at industry and stakeholder events, this paper clarifies where right holders draw the line between a pirate and a fan, especially the limited influence copyright law has in practice.
