The Moral Theologian,Oliver O'Donovan and International Law

Abstract

Oliver O'Donovan renders a singular contribution to the theory and history of international law by identifying the spiritual impoverishment of the discipline following the triumph of state-centred contractarianism in the theory of international relations, with Hobbes, Locke, Kant and, for the present, John Rawls. This contractarian approach to international society has an inherent tendency, which O'Donovan highlights, to ground international order in the hegemonic claim of one or two countries to represent the values of the whole of humanity. With a combination of rational moral theology and biblical interpretation (Revelation), O'Donovan reasserts an international order grounded in the autonomous identities of the nations, which God has recognized as equal. With a theory of political legitimacy which rests upon representation of national identity, O'Donovan points the way to an international order based upon mutual respect among nations under natural law, in the classical medieval sense finally represented by Grotius and Suarez. This article describes again what the natural law tradition meant in the hands of Aquinas and Vitoria, in order to highlight the fact that the ontological dimension of natural law theory provides a way to meet the intolerable insecurities which theories of nationalism appear to generate. Then the article goes on to offer one way to bring natural law thinking up to date for contemporary audiences by drawing upon Paul Ricoeur's phenomenological theory of mutual recognition and respect among the nations as a way of going beyond the contractarian tradition in contemporary international law and relations theory.     

INTERNAL VERSUS INTERNATIONAL MIGRATION AND THE ROLE OF MULTIPLE DEPRIVATION

This study disentangles the concept of relative deprivation by distinguishing feelings of individual and collective relative deprivation as sources of individual aspirations. Both concepts are then operationalised and empirically tested with regard to their relative importance in migration decision-making. Based on data from the National Sample Survey in 2008, two factors turn out to be relevant in understanding the Indian migration pattern. First, individual and collective relative deprivations are both strong predictors for out-migration, but only for short-distance, intra-state movements. The likelihood of out-migration towards international destinations is significantly higher for households with lower levels of individual and collective relative deprivation. Second, leaving aside the effects of relative deprivation, absolute deprivation plays a rather ambivalent role: while economically better-off households have a higher propensity for sending (primarily male) migrants to distant inter-state and international destinations, shorter distance out-migration is mainly dominated by female migrants stemming from poorer households.     

Asian migration to Australia: Changing trends and implications

International migration between Asia and Australia has undergone profound change in the last two decades. This paper outlines the major changes which have occurred in this movement. The proportion of Australia's resident population born in Asia has increased from 1.1 % in 1976 to 5.5 % in 2001. Asians now make up more than a third of new settlers to Australia but there has been an increased diversity in the flow of Asian settlers to Australia as well as the substantial increase in numbers. Australian international migration has entered a new era since the mid‐1990s with a greatly increased flow of temporary workers to Australia. The inflow of these workers is less dominated by Asia‐born people than is the permanent flow except for student migration. There is also an increasing flow of movers from Australia to Asia. Much current knowledge and research remain focused on Asian permanent settlement in Australia. While this is important and worthwhile, there is a need to broaden the work to encompass the full range of population movements between Asia and Australia if the impact of international migration is to be adequately assessed.     

海外中国劳工保护制度的演变与未来展望--基于历史制度主义视角的分析

论文梳理了海外中国劳工保护制度变迁的内在逻辑,探讨了海外中国劳工保护制度变迁的动力机制和新形势下创新与提升的应对举措。研究显示:海外中国劳工保护制度经历起步探索期、规范建制期、调整拓展期、发展完善期的演进轨迹,展示出一个清晰和完整的兼有历时性与共时性的制度谱系。海外中国劳工保护制度演进有五种驱动力:理念转变、国内发展需要、国家实力提升、国际形势转变以及关键节点催化。海外中国劳工保护是我国海外利益维护的重要组成部分。在新冠肺炎疫情肆虐全球背景下,基于历史制度主义视角来重新审视海外中国劳工保护制度的演变具有特别重要的意义。     

基于价值转移方法的我国游憩活动价值评价

鉴于目前我国在构建价值转移模型中存在的限制因素,本文采用基于Meta分析的价值转移方法并尝试利用国外游憩活动价值评价的实证研究结果,构建基于Meta分析的国际间价值函数转移模型,估算了我国10种游憩活动的日平均消费者剩余.通过将价值转移模型估算的游憩活动价值“转移值”与国内97个游憩价值评价的“真实值”做比较,对价值转移模型的有效性和可靠性进行统计检验,平均转移误差为18.74％.最后,总结了提高我国Meta回归价值转移模型的具体、可操作性方法及途径.     

Footprint or fingerprint: international cultural policy as identity policy

This article focuses on government policy aimed at the presentation of the nation abroad through cultural activities and its relation to national identity, external cultural policy. The methodological framework is offered by the discourse analysis of Wodak and the notion of identity of Laclau and Mouffe, treating policy as a discourse. A closer look is taken at the concept of cultural diplomacy and the closely related term nation branding. This article will show how the shift in paradigm also changes the role of ‘the other’ in the construction of national identity and how this influences the role of the arts in international cultural policy.
