There were three kinds of financial transactions involving rights of land during the Qing Dynasty: debt financing through rights of land, the direct transferring of the rights of land, and the transaction of shares. This article attempts to clarify the confusion between several types of debt financing through rights of land. Ya 押 was loan through land as guaranty and repaying the interest and capital by the rent of land or harvest. Dian 典 was loan through temporary transferring of usage rights and harvest in a certain period of time. Dang 当 referred to various types of loans which involved the rights of land. Di 抵 meant using a certain portion of land right as repayment of debt. Similar with modern financial methods, these financial transactions in the Qing Dynasty allowed peasants to preserve their possessive rights over the land and also satisfied their financial needs. The direct transactions of rights of land and repayment of debt by harvest included juemai 绝卖 (finalized sale of land), huomai 活卖 (not finalized sale of land), dianquan dingtui 佃权顶退 (sell or purchase tenancy), zhaojia 找价 (price add-on after transaction), and huishu 回赎 (redemption). The main purpose of these transactions was to protect the land proprietors as far as possible. Share transaction and co-tenancy of land also appeared in the Qing Dynasty. Such diverse financial transactions not only were substitutes of modern financing tools which allowed peasants to weather financial hardship, but also promoted the changing ownership of land which further encouraged the combination of different production elements and reallocation of resources in the land market. The objective of the present article is to highlight the obscured links between the multilevel and multifaceted legal concept of cultural diversity and its political uses. It intends to provide a clear appraisal of the concepts of cultural diversity within the legal framework in which cultural policies are immersed. It seeks to focus on the uses of cultural diversity as a legal concept that reflect intense disagreements on cultural policies, that helps legitimatize very different and variable political ideas and that emerges from very different backgrounds. After identifying the exact legal scope of the notion, the article analyses the narratives and discourses that lead to the consolidation and use of cultural diversity as a multilevel legal notion.  相似文献

Abstract

Miroslav Volf’s sets out a strong, good thesis about the freedom religious people ought to have to participate in public as fully themselves, as religious people. This thesis is in tension with the fact that some people seek to harm others, or to radically compromise public life itself, in the name of their religion. Along the way, Volf makes a number of points that seem puzzling, at least overstated, but perhaps even incoherent with other claims he makes or with data that he likely also knows. I raise the possibility that the author’s social location may help to explain at least some of these debatable features of his otherwise salutary book.  相似文献

This research examines factors that have influenced state choices about methods of voter identification practices in the current environment of election administration reform. State voter identification practices have been an active area of state policy action since 2000. Rival explanations for state adoption of voter identification requirements are analyzed for three national election cycles following the 2000 presidential election. State voter identification practices are classified according to levels of relative stringency and in terms of variation from federal requirements for voter identification under the Help America Vote Act of 2002. State decisions to adopt more stringent forms of voter identification are significantly influenced by intrastate factors including Republican Party control of state government, traditionalist state political culture, and greater levels of racial/ethnic diversity. Federal review of election practices under the Voting Rights Act is positively associated with more moderate approaches to voter identification but is not significant over this time period.  相似文献

In recent years, the concept of diversity has become prominent in cultural policy, echoing community arts philosophies of the 1960s and 1970s that questioned the notion of universal artistic value and argued for greater recognition of the relationship between cultural identity and inequality. Cultural diversity policies today implicitly challenge the liberal‐humanist discourse of ‘the best’, and emphasise what is ‘relevant’ to particular communities. Official policy rhetoric can often hide contradictions that are only apparent in practice. How does ‘diversity’ shape the way organisations engage with audiences and does this contradict the still present discourse of ‘universalism’, with its emphasis on value judgements? This paper explores this tension through the study of Rich Mix, a multi‐functional arts centre in London's multi‐ethnic East End. It argues that Rich Mix is caught between discourses of universalism and diversity, leading to confusion over the project's rationale and ambivalence amongst artists about how their art is judged.  相似文献

Mimicking paleobiological studies of biodiversity, changes in the diversity of temporal types of North American projectile points are modeled to reveal evolutionary patterns of origination and extinction. Origination is modeled as rapid innovation of multiple point types (high diversity), and extinction is modeled as gradual winnowing of less-efficient types. Introduction of the bow and arrow as a new weapon-delivery system is modeled as an increase in point diversity. Six sequences of points (dart + arrow), six sequences of dart points, and six sequences of arrow points from western North America best match the model when the number of time periods ?5 and the number of types is >3.  相似文献

Zooarchaeological analyses often draw inferences on socioeconomic status from the composition of bone assemblages associated with houses and other structures in residential sites. In this paper, we test how well faunal assemblages reflect socioeconomic differences among contemporary farmer households in two rural villages in the Central African Republic. Independent measures of wealth are tallied and ranked for six households in each village, including complete inventories of the types and numbers of material goods and the sizes of residential structures and agricultural fields. These data are compared against the associated food bones collected from household trash middens and activity areas, including skeletal abundances, large mammal body part representation, and taxonomic diversity. In most instances larger and more taxonomically diverse faunal assemblages are associated with houses of means and the faunas do, in fact, reflect differences in socioeconomic status. However, faunal “wealth” may be linked to factors unrelated to social or economic inequalities, notably the presence of active hunters. Our analyses suggest that small animals provide useful and important data in assessing socioeconomic means, and comparative studies of wealth in archaeological contexts should not be based on bones alone.  相似文献

The southern Mendoza Province of Argentina constitutes the southernmost limit of Andean agriculture in South America. Archaeofaunal assemblages from sites in this region show a pattern of changing taxonomic diversity concomitant with the first appearance of domesticated plants. This pattern is characterised by an increase in prey diversity before the appearance of the first cultigens and a decrease in diversity after their arrival. Furthermore, the animal taxa exploited when domesticated plants entered the diet indicate a focus on big game. The pattern observed in southern Mendoza is in accord with ethnographic and archaeological models generated by faunal research worldwide. Copyright © 2008 John Wiley & Sons, Ltd.  相似文献

Some scholars maintain that the Republic of Turkey should construct a consociational model to manage its ethno‐cultural diversity. This article suggests consociationalism is not the optimal multiculturalist approach for Turkey, where there is some degree of interethnic moderation between ethnic Kurds and Turks at the grassroots level. In the presence of this mass‐based moderation, a consociational formula is unlikely to provide Turkish political leaders with political incentives that urge them to cooperate and enter into consociational power‐sharing arrangements with their Kurdish counterparts. This renders consociational power‐sharing arrangements difficult to promote or enforce in Turkey. In the absence of such incentives, any multicultural reform of the consociational formula would not be sustainable in Turkey. There would simply not be enough popular support for such reforms. There are some electoral strategies that offer both majority and minority leaders political incentives to move toward the moderate middle, form interethnic coalitions, foster interculturalism, and increase the number of intercultural citizens. These strategies are offered by centripetalism, another multiculturalist approach to managing ethno‐cultural diversity.  相似文献
