The transfer and deportation of ethnically Rohingya people from Myanmar into Bangladesh is a crime against humanity demanding an international response. What role, however, should the International Criminal Court (ICC) play? On 6 September 2018 an ICC Pre-Trial Chamber ruled that the Court has jurisdiction to investigate and prosecute such crimes as they are completed on the territory of a State party, Bangladesh. Myanmar is not a party to ICC Statute and has invoked the principle that treaties do not bind third parties without their consent. The case put in this commentary is that while the Pre-Trial Chamber’s approach to the law was arguable as an interpretation of the ICC Statute, it was unwise as a matter of policy. The argument is threefold. First, the Pre-Trial Chamber’s ruling is as a matter of legal method only the first-move in a process of norm-creation and persuasion. Second, it does not follow that because territorial jurisdiction in international law includes ‘objective’ jurisdiction over transboundary acts completed on a State’s territory that such jurisdiction was delegated by member States to the ICC in all cases. Finally, it is argued that international criminal tribunals do not succeed when the cooperation of necessary territorial governments (here, Myanmar) is withheld. Proceeding in this case risks becoming a quagmire of the ICC’s own creation at a time when it can little afford further risks to its legitimacy.  相似文献

Contemporary Australian Indigenous policy changes rapidly and regularly fails to deliver its stated aims. Additionally, political and social relationships between Aboriginal and Torres Strait Islander peoples and the Australian state remain complex and contested. This article draws on critical Indigenous theory, alongside the increasingly influential scholarly paradigm of settler colonialism, to draw these two elements together. It highlights the ongoing nature of colonial conflict, and the partisan nature of state institutions and processes. While policy is usually framed as a depoliticised, technical practice of public management for Indigenous wellbeing, I suggest that it also seeks to ‘domesticate’ Aboriginal and Torres Strait Islander peoples, perform their dysfunction and demonstrate state legitimacy. This is especially the case in Australia, which has a long tradition of framing domestic welfare policy – rather than legal agreements – as the ‘solution’ to settler colonial conflict.  相似文献

Voluntary environmental programs (VEPs) have been used as a policy tool in the United States since the early 1990s and come in many forms. Early assessments of VEPs targeting changes in production processes showed that industrial participants improved their environmental performance and VEPs were celebrated as a viable alternative to more traditional regulation. Recent analyses using more sophisticated techniques, however, paint a less favorable picture. On the one hand, firms appear willing to sign up to VEPs, and in some cases, participants may be able to create a shield against future losses in shareholder value. On the other hand, these VEPs targeting production processes appear not to generate significant pollution abatement. The latter finding is particularly disturbing and this article discusses various explanations, including institutional failure and participant motivations. Future research needs to focus on understanding the firm motivation to invest in production‐related pollution abatement under a VEP. For policymakers, the research offers a warning on the limited impact to date of VEPs targeting production processes. However, the multitude of other VEPs, such as those which target new product development and changing market demands, merit a closer look to determine the overall potential of VEPs to engender positive environmental change.  相似文献

Recent research has studied the effects of seasonal variability on waterlogged burial environments. In a new approach to the study of archaeological contexts, the use of controlled laboratory conditions via lysimeters has enabled new insights into the nature of short term fluctuations in saturation, and the impact that these can have on burial contexts. In addition, the protocols used have facilitated interesting insights into burial environments and the way in which fluctuations in saturation and seasonality can impact on the contained organic components within them.  相似文献

吐蕃文物曾通过不同途径流散于海外,主要包括金银器与织锦。从中反映出吐蕃作为七世纪以来兴起于青藏高原的强大政治集团与唐、粟特、萨珊波斯等都有着密切的文化联系,并已形成具有自身特色的金银器制作风格;以对兽纹为主题的织锦是吐蕃人最为喜好的"番锦"之一,有可能为粟特锦,也有可能为包含粟特锦、波斯锦等中亚风格在内的"胡锦"。吐蕃银器上的纹饰更是多见于吐善时期的装饰性图案当中,并且影响到以后的藏族艺术。  相似文献

清代宫廷对白伞盖佛母的崇拜出现了显著的发展,特别在乾隆时期,除在宫中大量制作白伞盖佛母像外,还在北京及其周边地区的各大寺庙制作供奉精美的绘画和雕塑,甚至专门兴建寺院来供奉白伞盖佛母像。其信奉目的和崇拜方式等方面的特点,目前尚很少有专门的论述见诸文献。本文借助清宫档案及现存清代原状佛堂内白伞盖佛母的陈设情况,试图说明清代宫廷是将白伞盖佛母作为重要的福寿保护神来供奉的,并不是简单地继承元代的信仰传统而是另有传承和发展。  相似文献

六朝隋唐时期,考功郎隶属及其职掌均发生较大变化。魏晋时,考功郎掌百官考课,隶属于吏部尚书;南朝时,功论郎取代考功郎掌考课,隶属于都官尚书;北朝中后期,考功郎中掌考课百官及考试秀孝,隶属于吏部尚书;隋及唐前期,考功郎中、员外郎之隶属及其职掌略同北朝。唐中期以后,考功郎中、员外郎专掌京官与地方官的考课,策试秀孝的职责则转归礼部。六朝隋唐时期考功郎隶属及其职掌的变化,反映了尚书省机构的职能调整及选举与考课各司其责体制的逐渐形成。  相似文献

雷戈所著《秦汉之际的政治思想与皇权主义》一书,认为从秦朝到汉初的思想史发展阶段是中国思想史上皇权主义意识形态的生成和确立时期,并将其概括为"后战国时代";采用独特的"历史-思想"研究法,从政治制度、官场规则和官吏的政治生活中,挖掘特定时期的政治思想共识,为政治思想史研究开辟了新的路径,并扩大了思想史的资料范围;认为秦汉时期生成的皇权主义秩序,把"天高皇帝远"的制度现实变为"天高皇帝近"的观念实存,实现了对人们思想的可控性,从此,思想成为皇权可以控制和规范的领域,达到了有效的思想专制。这是秦汉以降中国思想史发展的基本特征。该书在研究方法的创新和思想深度的开掘上,都做出了独到的贡献。  相似文献
