The establishment of the World Trade Organization (WTO) has been widely accepted as representing the legalisation of world trading rules. However, it is important to reflect on the limits of this legalisation thesis in terms of the interface between international and domestic policy processes. By locating trading disputes in a political analysis of policy implementation, it is argued that it is difficult to establish conceptually how the WTO dispute settlement system could have authority separate from and above the conventional international politics of trade policy relations. Instead, the article argues that case outcomes should be expected to be largely the product of domestic political institutions and policy processes, and how these intersect with developments in the WTO dispute settlement system. Brief studies of the Australian government's dispute settlement strategy and two high-profile WTO disputes—the US upland cotton and European Union sugar cases—serve to suggest that the authority of international trade law is not as significant as assumed by the legalisation thesis. Rather, domestic politics and institutions have an important impact on the outcome of trade disputes.  相似文献

This article examines how the Spanish Crown's attempt to implement a systematic linguistic policy across the New World from the last quarter of the sixteenth century failed in the New Kingdom of Granada. Based on the ambiguous and problematic idea of ‘general languages’ that had arisen in Mexico and Peru, this one-size-fits-all policy was wholly unsuited to even the Muisca heartlands of the archdiocese of Santa Fe. Instead, local authorities settled on the use of bespoke translations of catechetical and pastoral texts into individual local languages, even at parish level, thereby reinforcing linguistic particularism—but availing themselves of the disciplinary and procedural framework of the legislation to support their strategy. In doing so, the article seeks to challenge established assumptions about the treatment of indigenous languages in New Granada in this period, and to throw new light on unanswered questions about the Spanish response to the region's linguistic heterogeneity.  相似文献

Shells were the most deadly weapon used during the conflicts of the twentieth century involving industrialized nations. Astronomical numbers of them were produced and fired, making shell fragments the most common artefact to be found on modern battlefields. An understanding of shell fragments can therefore be useful to the battlefield archaeologist. This paper discusses the three main components of artillery shells and mortar shells: the body, the fuse and the rotating band for artillery shells or the tail-fin assembly for mortars. Analysing the fragments of these components can provide important information, including nationalities, types, and calibres of shells used in an area. Body fragments are the least useful, but can prove helpful if they are large, or contain markings, threads, or fragments of band seat. Rotating band fragments are extremely characteristic as well as easy to find, and a single fragment is usually sufficient to determine the exact type of shell it came from. Tail-fin assemblies are also specific of the mortar shell they were used on. Fuses are typically covered with highly informative markings such as dates of manufacture, lot numbers, or factory codes. Because the information derived from the analysis of various shell fragments is a cheap and relatively easy way to help maximize the understanding of a battlefield that is being investigated, any archaeologist working on a modern battlefield should familiarize themselves with this topic.  相似文献

This paper presents results from a study of environmental harm created in the collision of real estate speculation and the political process that governed extension of the urban frontier of New Orleans into its eastern wetlands. Near term concerns of rent‐seeking real estate capital and the contested politics of urban infrastructure expansion challenged a fragmented state charged with regulatory oversight and protection of investments in land and citizens. The paper engages theoretically the relative inattention of urban political ecology theory to rent as a way to theorize how capital flows through land, and argues for increased attention to the problem of land rent and the multiple scales of political engagement that manage ecological crisis immanent in the metabolism of nature and society under capitalism.  相似文献

Hurricanes Katrina and Felix made landfall in 2005 and 2007 on the Gulf Coast of the US and the Atlantic Coast of Nicaragua respectively. Despite many economic, political and cultural differences between these two sites, they share a number of interesting similarities. Their inhabitants are subject to similar modes of racialized Othering and internal colonialism, and both places have vital links with the transnational cultural consciousness that Gilroy referred to as the Black Atlantic. Katrina and Felix also occurred at a time when centralized forms of media are increasingly perceived to be in crisis. This crisis is creating new spaces for the development of alternative ways of knowing, watching and making media. This paper draws on recent literature on decolonization by Mignolo, Escobar, Quijano and others to explore the prospects for decolonizing energies within the new media environment and a context of devastation wrought by neoliberalism and disaster. This research examines disasters in/and the new media environment, and suggests that activists should understand the distinctions between mainstream (or corporate) and alternative media, between top‐down and grassroots media, and between “old” and “new” media, in relational and non‐categorical rather than absolute terms. These media realms should be engaged from an awareness of how they interact with and impact upon one another. This research also suggests that disasters must be understood as ongoing and open‐ended events embedded within historical, social, cultural, economic and political processes and systems. Media, policymaking and emergency management practices that are informed by an awareness of this complex embedding, and which are therefore able to take a long‐term view of the unfolding of disasters, will be best equipped to engage effectively, and in democratically responsive ways, with disasters and in particular with the needs of those populations most vulnerable to their impacts.  相似文献

Migration theories often ignore the role that states play in stimulating migration through public assistance policies. Using the case of Mexico, this article explores the role of the state as a migrant‐producing actor by examining the relationship between migration and social assistance policies in the form of monetary cash transfers. It argues that direct, unconditional cash transfers, like those provided by agricultural programs such as Procampo, rather than providing the incentives needed to retain individuals in their home country, may instead be providing the resources needed to migrate, particularly if the amount of the transfer is insufficient to spur investment. Instead of discouraging migration by enhancing economic opportunities and reducing poverty, such policies can actually make it easier and more appealing for its beneficiaries to migrate.  相似文献

Offering a systematic comparison of the history of the differing rural gender orders that have developed in Norway and Sweden since 1750, this article considers the complex interconnections between gender and capitalist relations. It begins by highlighting the contrasts between these two Scandinavian countries’ settlement patterns, agricultural structures and rural gender orders, in spite of the similarities in their environments, social-democratic policies and commitments to gender equality. Within a theoretical framework focused on the persistence of simple commodity production by farming families within capitalist economies, it considers the gender division of labour, commodity systems, and laws of succession and inheritance as they bear upon the positions of farm women in Norway and Sweden. Tracing the development of stratification in the countryside and the history of farmers’ political activism at the national level illuminates the salient differences between these two countries’ histories from the early 19th through the late 20th centuries. This comparison demonstrates that gender as well as the mobilization of rural citizens shaped the transition to capitalism and that, in turn, agricultural and settlement policies reshaped rural gender relations.  相似文献

In 1929, āpirana Ngata published an article titled “Anthropology and the government of native races in the Pacific”. This would appear to confirm the link between anthropology and the rule of indigenous populations in New Zealand and its Pacific empire, but the evidence presented in this article suggests a more complex situation. This paper examines the “empirical anthropology” of Ngata and Peter Buck and the ways in which their activities reshaped the policy and practice of the Department of Native Affairs between 1920 and 1935, particularly through the notion of cultural “adjustments” or “adaptation”. Archival research reveals that behind the activities of the Dominion Museum, the Polynesian Society and its Journal was a Māori-led body, the Board of Māori Ethnological Research, which redirected government collecting, research and publication from salvage to the maintenance and revival of Māori cultural heritage in the service of tribal social and economic development. Seen through the theoretical framework of assemblage theory, we can see how a malleable idea of culture was employed in social governance in quite different ways to the colonial governmentality at work in other settler colonies at this time. The paper argues that this form of “anthropological governance” effectively de-territorialized state institutions, thereby creating a distinctive space for the native exterior to the nation.  相似文献
