Depuis les années 1980, la province du Québec a créé de nombreux parcs, devenus parcs nationaux en 2002, afin d'assurer la conservation et la protection des territoires représentatifs de ses régions naturelles. Certains d'entre eux sont contigus à des portions de forêts publiques où se déroulent des activités industrielles d'exploitation forestière. Or, depuis 2003, les industriels sont tenus d'intégrer la coupe en mosaïque à leurs activités. Ce type de coupe requiert la préservation de forêts résiduelles (non-coupées) d'une superficie au moins équivalente à celle des aires de coupe. En 2004, les industriels se voient autorisés à situer ces forêts résiduelles à l'intérieur des frontières des parcs nationaux. Reposant sur l'approche interdisciplinaire de la géographie du droit, notre étude entend développer le concept d'empiètement, mais aussi les stratégies géo-légales qui sous-tendent ce dernier, au continuum du public-et-du-privé. Pour ce faire, nous avons recours à une méthodologie conciliant les méthodes juridiques et qualitatives afin d'étudier trois parcs nationaux où il y a localisation de forêts résiduelles à l'intérieur des limites de ces parcs. Notre étude entend démontrer que ces forêts résiduelles, situées à l'intérieur des parcs nationaux, constituent des empiètements résultant de stratégies géo-légales mises en œuvre par le ministère des Ressources naturelles et de la Faune et les compagnies forestières.  相似文献

Often interpreted as a field of contradictions and fragmentation, the work of Jean-Jacques Rousseau presents an inner unity. This inner unity, though, is structured around regulated contradictions. I will examine here the distribution of those regulated contradictions by focusing on the preface to the Lettre à M. d’Alembert sur les spectacles and the relations between the Lettre and the Essai sur l’origine des langues. What Rousseau rejects as agents of corruption—theater and laughter—constitute at the same time the principles of his argument. The values of representation and technique implied by theater and laughter come to compose with those of presence and nature. Taking as a point of departure the work of Jacques Derrida on Rousseau, but also engaging it polemically, I will show in the analysis of the preface to the Lettre the distribution of regulated contradictions as well as the essential difference between language and theater in Rousseau throughout his reflection on the origin of theater and language.  相似文献

Political theorists recently focused their attention on the history of the idea of constituent power. This, they claim, shows that the notion of pouvoir constituant expressed the radical and absolute power of the sovereign people. In other words, constituent power pointed at the democratic and irresistible core of popular sovereignty. In this paper, I argue that the analysis of nineteenth-century French political thought offers a different account of constituent power’s history. Relying upon archival resources, I show that in the aftermath of the French Revolution politicians and legal scholars used constituent power to tame the very idea of sovereignty and the powers from it derived. First, during the Restoration constituent power was used to pose a limit to the power of the monarch. Second, throughout the July Monarchy scholars resorted to constituent power to oppose the Parliament's claim to be the sovereign power and the only legitimate author of the constitution. Moreover, they also used it to claim that claim that, even if the people was sovereign, its power was restricted to authorizing the constitution. Third, during the Second Republic, jurists and politicians addressed the people’s sovereign power in terms of constituent and constituted power. While the first was meant to disappear after the constitution’s approval, the second was a second-order power limited by the hierarchy of norms and the rigidity of the constitution.  相似文献

It is argued that although this book will be of interest to any scholar interested in Croce, Gentile, or de Ruggiero, it will be of particular interest to those interested in R. G. Collingwood, for the ultimate focus of the book is upon Collingwood's philosophy and how it developed in relation to the work of the Italian idealists. This is a subject that has not previously been investigated in any depth. Peters argues that the basic idea that unites all four philosophers is that “the past is not dead, but living”; but what distinguishes Collingwood's philosophy from the Italians' is the idea, and its justification, that “the past can live on even if we are not aware of it.” Collingwood explored and developed this idea in reaction to the “presentism” of the Italians, a position that is most obvious in the philosophy of Gentile but that is also to be found, albeit less obviously, in the philosophies of Croce and de Ruggiero. Without casting doubt upon the influence of the Italian idealists on Collingwood, it is suggested in this review that, as well as explaining that influence, Peters's book also throws Collingwood's similarities with Oakeshott into relief; by contrast with Collingwood, there is no evidence that Oakeshott ever read the Italian idealists.  相似文献

Drawing together insights from neo‐Innisian geography and environmental history, this paper explores the landscape and environmental changes engendered by ‘cyclonic’ patterns of development associated with uranium production at Uranium City, Saskatchewan. Strong postwar demand for uranium led to the establishment and rapid expansion of Uranium City on the north shore of Lake Athabasca as a ‘yellowcake town’, dedicated to producing uranium oxide concentrate to supply federal government contracts with the US military. In spite of optimistic assessments for the region's industrial future, the new settlement remained inherently unstable, tied to shifting institutional arrangements and external markets, and haunted by the spectre of resource depletion. The planning and development of the townsite at Uranium City reflected both neocolonial desires to open the north to Euro‐Canadian settlement and efforts by the state to buffer the stormy effects of resource dependency. Ultimately, however, quixotic government efforts to implant an outpost of industrial modernity in the Athabasca Region failed to forestall the inevitable winds of change, which left in their wake destructive legacies of social dislocation and environmental degradation, already evident with the near‐collapse of the uranium export market by the early 1960s.  相似文献

This article uses thirteenth-century hospital sermons as a window into the moral and religious environment of these charitable institutions, large numbers of which were founded during the twelfth and thirteenth centuries. What emerges from the reportationes of sermons preached in the hôtel-dieu of Paris and ad status sermons directed at hospitals' personnel and inmates by Jacques de Vitry, Humbert of Romans and Guibert de Tournai is a spirituality that stressed the penitential (and potentially salvific) power of doing works of mercy (in the case of hospital workers) and bodily suffering (in the case of hospital inmates). The particular social context of hospital preaching is also evident in preachers' anxieties about the quality of hospital administration. The sermons that were preached in thirteenth-century hospitals reflect the heightened value placed on caring for the sick and poor, a historical development more often associated with the later middle ages.  相似文献

This article investigates the enduring chronopolitics of Historicism. To do so, I work through two dominant understandings of Historicism: the view that “historicism” is a means to account for the historian's own standpoint or historical situation as the place from which they take up and interpret the past, which I call Historicism A, and the separate (though now more popular) understanding of “historicism” that is derived from Karl Popper's The Poverty of Historicism, which I call Historicism B. I am less interested in what draws these varying definitions of Historicism apart and instead investigate a point of intersection in their understanding of time and temporality. Both strains serve politics via a concept of time as a neutral, uniform, and apolitical scale upon which any political or ideological agenda is enacted. Time here serves as the basis for historical explanation, but its neutrality, homogeneity, and extra-historicality are a trick. I employ Gérard Genette's analytic of the palimpsest, with the help of Nancy Partner, to expose the ways that Historicism allows the past to be rewritten and overwritten to political and ideological ends that the temporal construct conceals. This then enables me to work through the politics of Historicism and ultimately deconstruct Historicist time, demonstrating how the universal or eternal claims of Enlightenment or pre-Historicist thought are actually maintained in Historicism as the mechanism to advance political and ideological positions under the cloak of neutrality. In what follows, I make the temporal mechanism of Historicism explicit in order to expose the ethical failings that this mechanism conceals.  相似文献

Changes brought about by globalization such as the growth of the travel industry and increasing interconnectivity between places have opened up new lifestyle options for Canadian retirees. Commonly called “snowbirds,” thousands of Canadian retirees choose to spend their winters in warm destinations outside Canada, with most going to localities in the southern United States. Most snowbirds visit the same place every year and spend many years going back and forth between Canada and their chosen winter destination. Drawing on insights from both life-course theory and the new mobilities paradigm, this paper considers how the cross-border snowbird phenomenon links to wider processes related to aging. Qualitative interviews were conducted with retirees wintering in various communities in southern Florida. The findings of the study highlight the importance of understanding both aging and mobility as processes that intersect in variable ways over time to influence new geographies of aging.  相似文献
