The year 2005 will remain notable in Supreme Court history. A nearly unprecedented period of stability in the Court's membership came to an end. The nation witnessed the appointment of a new Chief Justice, and, for the first time since 1971, a President and the Senate confronted the momentous responsibilities of two simultaneous vacancies to fill.     

Heterogeneity effects on possible salinity-driven free convection in low-permeability strata

Although studies of free convection commonly focus on highly permeable strata, but numerical analyses indicate that density-driven free convection may also occur in heterogeneous low-permeability strata. Traditional Rayleigh number criteria are overly conservative in predicting thermohaline convection in these systems; so, numerical models are used to make inferences on the process. Simulations with stochastic realizations of permeability fields show that dense plumes can take preferential pathways to sink through generally low-permeability strata; patch analysis using percolation theory shows that the threshold permeability for the onset of free convection can be as low as 10⁻¹⁶ m² even with a mean permeability of 10⁻¹⁸ m². Threshold permeability for the percolation pathways decreases with increasing concentration gradient, vertical correlation length and the mean and variance of the permeability. The connectedness of relatively high-permeability zones is important in initiating and controlling plume fingers of free convection in both single-layer and sand-shale sequence models. Permeable units above and below are conducive to free convection through intervening low-permeability strata if buoyancy gradients exist. This heterogeneity is on scales that are difficult to sample by drilling and too localized to be simulated in regional models but may be significant in solute transport in these systems.     

An analysis of Late Pre-Islamic copper-base artefacts from Ed Dur, U.A.E.

The article presents the analytical results of a study of copper-base artifacts from ed-Dur, a large site in the United Arab Emirates which was occupied principally during the 1^st century A.D. In addition to identifying a number of pieces with high lead content, the analyses have contributed to an understanding of brass and brass distribtion in the Roman Near East.     

Magic darts and messenger molecules: Toward a phytoethnography of indigenous Amazonia

Recent scientific findings on plant intelligence are forcing anthropologists to reconsider indigenous theories of plant vitality. In this article, the authors compare original ethnographic and ethnobotanical research among two different peoples from opposite extremes of lowland South America – the Makushi of Guyana and the Matsigenka of southern Peru – and explore how somatic experiences and the chemosensory properties of plants permeate indigenous understandings of the aetiology of illness and medical efficacy in both the cosmological and microbiological domains. The authors synthesize emerging theory in ecosemiotics, embodiment, plant personhood and plant intelligence with the concept of ‘sensory ecology’ to recast multispecies ethnography as a phytochemical as well as a philosophical endeavour.

Laments about federal judges, Supreme Court Justices in particular, are nearly as old as the Republic. Those who say otherwise perhaps have either poor memories or a need to read more history. True, the Court has not been continuously caught up in strife, but controversies have occurred often enough to make Court-bashing a routine part of American political life.     

Tribute to William H. Rehnquist

The casket was plain unvarnished pine, and over it was draped the American flag. As my fellow Rehnquist clerks and I carried that casket up the marble steps of the Supreme Court building, to the Great Hall, it occurred to a number of us that this was very fitting. For Chief Justice William H. Rehnquist was direct, straightforward, utterly without pretense—and a patriot who loved and served his country.
