On political theology: A controversy between Hans Kelsen and Carl Schmitt

This article pays special attention to the large number of references to political theology by Hans Kelsen and Carl Schmitt, particularly in the interwar period, and seeks to interpret these references in a new way. While Schmitt's analogies between God and state are to be expected considering his strong Catholic roots, such comparisons are much more surprising for a positivist like Hans Kelsen, who always tried to relieve state and law from transcendental elements. The article concludes that, far from being marginal in the doctrinal dispute between Schmitt and Kelsen, references to political theology express and summarize their major controversy about the relation between state and law, as well as about the sources of the state's unity. The heart of the disputatio between the two jurists concerned the ability of the political power to emancipate itself from the juridical order. The ‘legal miracle’—in this context meaning the occasional autonomization of the state from law—was for Schmitt the manifestation of sovereign power. However, for Kelsen it represented the negation of the state's essence, whose actions must be determined only by the legal order.

The Limits of Public Policy Intervention in Urban Logistics: Lessons from Vicenza (Italy)

For over 15 years, the subject of urban logistics has preoccupied many stakeholders, including both private and public decision-makers. The purpose of this paper is to present a study of the limits of public policy regulations restricting vehicle access to limited traffic zones to promote the use of urban consolidation centres (UCCs). After examining the main technical and economic aspects of implementing an UCC, we present the case of Vicenza (Italy), which has implemented very restrictive regulations. We study the municipal regulations and their legal consequences, by analysing court rulings issued between 2006 and 2009, following a lawsuit brought by an association of freight transport carriers due to these restrictions. Although this case seems applicable to a specific context, we identify several lessons that can be extrapolated to other cities. Therefore, the lessons drawn for other urban areas in Europe are presented, and their advantages and possible transferability studied.     

‘My Body was Aflame with His Memory’: War,Gender and Colonial Ghosts in Hiroshima mon amour (1959)

This article argues that historicising the iconic 1959 French film Hiroshima mon amour reveals a different set of meanings that most scholars have overlooked. As France found itself embroiled in the brutal and bloody Algerian War of Independence, many started reflecting on the meaning and aftereffects of the Second World War. Despite its anti‐colonial universalist humanism, Hiroshima remains haunted by colonial ghosts and fantasies of post‐war ‘Asia’ where Asian female bodies are passive and Asian male bodies only echo other European male bodies. Ultimately, sexual and racial differences organise the film's narrative of war and canonises a Eurocentric version of ‘history’. The film's melodramatic love story renders invisible the ways gender and sexuality shape understandings of violence, wars, and violated bodies. Against Marguerite Duras's and Alain Resnais's intentions, the love story allows the remembering and forgetting of a (French) national history that only the female character embodies. Only the French woman stands in for subjectivity, memory and trauma, rendering everything else secondary. Once read as a historical text, the film illustrates the limits and ambivalences of post‐war anti‐colonial humanist political imagination.     

Les Pradelles (Marillac-le-Franc, France): A mousterian reindeer hunting camp?

The site of Les Pradelles has an important mousterian stratigraphic sequence. In the lower levels, the very low density of artefacts as well as the carnivores scavenging of carcasses abandoned by the neanderthals point to short-term human occupations; the introduction of finished tools (made on non-local, good quality flint) later highly curated, together with an expedient strategy on strictly local flint, suggest a task-specific location, within a low mobility pattern. The large faunal sample (mainly reindeer) underlines the preponderance of hunting activities. A range of butchering activities took place on the site and the abundance of filleting marks may be an indication of the processing of meat for transport to another settlement. The hypothesis of “specialized hunting” during Middle Palaeolithic is assessed with this new data set.     

‘…but not gagged’: Responding to Covid-19 and its control measures in France,Italy and the USA

The beginning of the Covid-19 pandemic was far from the ‘great equalizer’ sometimes described by the media. This article shares themes emerging from research conducted in 2020 in France, Italy and the USA concerning responses to the pandemic and its social effects. The authors analyze how the pandemic elicited varied reactions within the three countries where they conducted anthropological fieldwork. They propose that narratives of the Covid-19 response can shed light on how individuals navigate social and political relationships in each context.
