There are roughly 70 secessionist movements around the world, and all of them advance arguments for why they deserve independence. These include restorative rights, remedial rights, primary rights, a history of conflict and functionality-based arguments. However, no one has conducted a comprehensive analysis to see how these arguments (or grievances) match reality. That is, are secessionists making the right arguments given their context? To answer this question, we utilise a data set of potential secessionist grievances to determine what normative arguments each secessionist movement ought to make given their setting. We conduct a content analysis of the normative appeals/grievances that have actually been made by specific secessionist movements since 2000. We then compare the predicted grievances against the actual grievances and summarise the patterns. The results matched our predictions where restorative rights, remedial rights and functionality-based arguments are concerned. Our analysis returned a positive and statistically significant relationship. However, we found no evidence that those making conflict-related arguments were more likely to exist in conflict settings. Interestingly, the findings for primary rights were the opposite of our expectations; it is the secessionists with the most political voice, not the least, that are the keenest to stress primary rights. 相似文献

Residents living in close proximity to contaminated sites may experience adverse effects from financial losses and property devaluation, leading to poor mental health and physical illnesses—effects that may require compensation. The most common legal process of seeking compensation is the toxic tort—litigation pressed on the basis that contamination has harmed the victims. Several recent toxic tort class actions in Australia brought by residents living in areas affected by contamination from per- and poly-fluoroalkyl substances (PFAS) exemplify that process. Two such actions, those at Williamtown and Richmond, provide an opportunity to explore how toxic torts currently function as a means to secure compensation, whether they mitigate the harms of the contamination and considering how spatio-legal manoeuvres may shape the litigation. In this article, we use a legal geography approach to analyse how plaintiffs’ bodies, litigants’ properties, and the state are constructed and represented by parties involved in these toxic torts. Legal geographers contend that examining the spatio-legal manoeuvres made via litigation can make visible the effects of legal action on those involved and draw out how the law and its instruments may shape places and communities. Toxic tort class actions have allowed those affected by the contamination to be heard and receive some compensation. However, we argue that they do little to alleviate plaintiffs’ concerns about the effects of contamination on their health, properties, and the environment. The findings have significance given that torts will likely play an increasingly prominent role in dealing with such challenges. 相似文献

A series of quantitative methods for investigating the basis for preference for landscape scenes was applied to photographs of alpine and subalpine landscapes in Alberta. The procedure incorporates a multidimensional scaling analysis with the repertory grid technique and also employs a property vector-fitting algorithm as an aid in interpreting the dimensional solution. The preferences of a sample group were based on three criteria. In order of importance, these are character of vegetation cover, depth of field, and elevation of terrain. Additional validation of the results was obtained through a principal components analysis of the repertory grid data. 相似文献

This paper draws upon the findings of a recent project examining the motivations of UK students seeking higher education overseas. We argue that notions of fun, enjoyment and the pursuit of happiness abroad featured strongly in young people's stories, in contrast to an emphasis in recent academic and media accounts on overt strategising around educational decision making. Several students wanted to escape the UK, particularly the rigidity of British higher education; the perceived flexibility of a liberal arts education was extremely appealing. Others saw education overseas as a chance for personal reinvention. Moving the focus away from stressing the negative effects of academic-related pressures upon young people, in this paper, we argue that education can offer up new possibilities for fun and excitement, which for privileged individuals work alongside more strategic objectives around the accumulation of cultural capital. 相似文献

Stable nitrogen isotopes have been used to reconstruct infant feeding practices as nursing infants have elevated δ15N ratios compared with their mothers. However, infancy is also a time of rapid growth, which may alter nitrogen isotope diet‐to‐tissue spacing. Several studies have documented a decrease in δ15N during growth in tissues with relatively fast accretion rates. This study investigates the effect that the growth of long bones, via collagen accretion, has on δ15N ratios. Long bones from individuals aged seven to nineteen years were obtained from a protohistoric ossuary in Ontario, Canada. Analysis of juveniles and adolescents permitted the examination of growth in a group who were not also nursing. It is concluded that a nitrogen isotope growth effect is not detectable in bone collagen from juveniles and adolescents, because: (1) δ15N ratios are not significantly different among the epiphyses, metaphyses and diaphysis of a growing long bone; (2) δ15N ratios are not significantly different between faster‐growing versus slower‐growing metaphyses; and (3) δ15N ratios are not significantly different between bones (or areas of a bone) that are still undergoing growth, versus bones that have ceased growing. The relatively slow speed of collagen accretion may explain why a growth effect is not manifested. Ultimately this research lends support to the use of nitrogen isotopes from bone collagen for infant feeding reconstructions. Copyright © 2009 John Wiley & Sons, Ltd. 相似文献

The dispersal of Homo sapiens across the New World is one of the greatest chapters in the history of our species; however, major questions about this late Pleistocene diaspora remain unanswered. Two contentious issues are the timing of colonization of the Bering Land Bridge and origin of Clovis, which at 13,000 calendar years ago is the earliest unequivocal complex of archaeological sites in temperate North America, known by its specialized fluted spear points. One hypothesis is that fluting technology emerged in Beringia and from there was carried southbound, with fluted points becoming the diagnostic “calling card” of early Paleoindians spreading across the Western Hemisphere. Fluted points have long been known from Alaska, yet until now they have never been found in a datable geologic context, making their relationship to Clovis a mystery. Here we show that a new archaeological site at Serpentine Hot Springs, Bering Land Bridge National Preserve, Alaska, contains fluted points in a stratified geologic deposit dating to no earlier than 12,400 calendar years ago. Our results suggest that Alaska's fluted-point complex is too young to be ancestral to Clovis, and that it instead represents either a south-to-north dispersal of early Americans or transmission of fluting technology from temperate North America. These results suggest that the peopling of the Americas and development of Paleoindian technology were much more complex than traditional models predict. 相似文献
