This essay uses Schmitt's work to cast new light on the relevance of the American legal tradition known as ‘legal realism’ for the history and analysis of human rights. It does so by exploring several of Schmitt's most famous criticisms of international law and human rights, and then suggests how they might correspond with a widespread critical legal tradition in the 1920s and 1930s. This essay describes in detail two fundamental features of this tradition: historicism and realism. It concludes by suggesting that a return to some of these earlier law writers and texts might be a more substantive way to develop a constructive critical position in the fields of human rights and international law than an overreliance on the politically provocative (and problematic) rhetorical flourishes of Carl Schmitt.  相似文献

Over the last decade analysis of the HMS Pomone wreck scattered below the Needles has aimed to correlate artefact positions with their terrain and aid research into the distribution process of the wreck-site. However, physical limitations faced by divers on the site have restricted progress. The search for a solution to the difficulties of archaeological surveying was resolved by the Submetrix ISIS 100 system when a bathymetric survey of the wreck-site was performed in a single day. It has provided a contoured terrain model that can aid further investigations and help plans for the future management of the site.  相似文献

Despite the centrality of Mexico–US border policing to pre‐ and post‐9/11 US immigration geopolitics, perhaps the most significant yet largely ignored immigration‐related fallout of the so‐called war on terrorism has been the extension of interior immigration policing practices away from the southwest border. As I outline in this paper, these interior spaces of immigration geopolitics—nominally said to be about fighting terrorism, but in practice concerned with undocumented labor migration across the Mexico–US border—have not emerged accidentally. Rather, the recent criminalization of immigration law, the sequestering of immigration enforcement from court oversight and the enrollment of proxy immigration officers at sub‐state scales have been actively pursued so as to make interior enforcement newly central to US immigration geopolitics. I argue here that these embryonic spaces of localized immigration geopolitics shed new light on the spatiality of US immigration governance, which has typically been thought of by geographers as active predominantly at the territorial margins of the state. I conclude the paper with some thoughts as to how geographers might rethink the what and where of contemporary US immigration geopolitics.  相似文献
