The Declaration of Paris, signed by seven European powers on 16 April 1856, is almost forgotten today. Yet it marks the beginning of modern international law as we know it: multilateral treaties open for accession by all powers with the intention of creating new universal rules. Its extension of neutral rights to trade undisturbed in peace-time was a radical reversal of the centuries-old British tradition of extensive belligerent rights. But there is no convincing explanation why Britain signed this treaty and lobbied for its global acceptance. This article shows that the Declaration was a package deal in which Britain accepted broader neutral rights but gained the abolition of privateering. Privateering was no anachronism, but the linchpin of US strategy in case of a conflict with Britain. The Declaration of Paris closed most of the world's ports to privateers and thus ended the practice. The Declaration was also the first multi-lateral law-making treaty and marks the invention of the main instrument we use today to create international law.  相似文献

The two comprehensive reference grammars for Biblical Hebrew, Gesenius/Kautzsch and Joüon/Muraoka, in addition to the more or less generally accepted categories of use of the definite article, make use of a category which they describe as not having to do with definiteness in the sense that we know it. In this category they group the instances of use of the article that do not seem to fit into the generally accepted categories, instances where the Hebrew definite article, in German and English respectively, is said to be expressed by an indefinite article. In the present article, I analyse the 67 examples given to substantiate the existence of the proposed category. I argue that this category probably does not exist and I contend that most of the examples, when carefully analysed, are examples of regular article usage. When the nouns in question are perceived as nondetermined and translated as such, it is because we are not sufficiently familiar with ancient Hebrew language and culture and hence do not possess the contextual information the articles refer to.  相似文献

A key trend in post-1995 French cinema has been the return of the social. Analysing this trend, this article seeks to evaluate its politic impact. Using Herve´ Le Roux's Reprise (1997) and Agne ¤ s Varda's Les Glaneurs et la glaneuse (2000) as key meta-texts, it suggests that the current wave of politically engaged cinema needs to be approached in new ways that recognise how films trace the impact of a politically unmediated, 'raw' real on groups or individuals. It further suggests that the withdrawal of political mediation gives the films an essential ambiguity and a melodramatic quality that, rather than mere cliche´, may be a privileged way to engage with the violence of the real. Film is now not so much in the van but dans le bain of a diverse socio-political stirring.  相似文献

Herbert Spencer, the nineteenth-century philosopher, has frequently been dismissed as a “fantastical hypochondriac” (as his most recent biographer, Mark Francis, terms him). Yet he left a record in his Autobiography of symptoms that suggest a very different diagnosis. Abruptly at age 35, he found that the activity of reading, previously indulged in without difficulty, triggered paroxysmal episodes of disturbing “head-sensations” including “giddiness” (so Spencer described them); these severely curtailed his ability to carry out his philosophical studies. Of all possible explanations for such episodes, none seems as likely as reading epilepsy. Enduring preconceptions about Spencer's presumed neurosesmay have kept modern historians from appreciating that Spencer suffered from a legitimate, if esoteric, neurological malady.  相似文献

Abstract

In the Lady chapel at the east end of the north aisle of the church at Pucklechurch (Gloucestershire) are two effigial monuments, which have received little scholarly attention. The monuments are attributed to William de Cheltenham (d. between 1371 and 1374) and his wife Eleanor, and were set up in his lifetime within the chantry chapel dedicated to St Mary which William received licence to establish at Pucklechurch in 1337. Little remains of the chapel except an exquisite altar frontal. During the 19th century the two effigies were transposed. Various aspects of the conception and design of the Pucklechurch monuments reflect developments in monumental sculpture in Herefordshire.  相似文献

THIS PAPER EXPLORES how noblemen expressed themselves in late-medieval Scandinavian castles, in the buildings and in the landscape. The focus is on decorated stone tablets with coats of arms and memorial texts found on the castle walls, but the landscape setting of the castles is also discussed. The examples considered here are Glimmingehus in Scania, in present-day southern Sweden, and Olofsborg in eastern Finland — both erected in the late 15th century. The locations of stone tablets in the castles are investigated, as well as who was able to see them and share their messages. It is argued that while the coats of arms and memorial texts were situated to convey ideas to an aristocracy, the landscape context of the castle mediated messages of social status to a wider public.  相似文献

This article contrasts Mark Bevir's approach to the history of ideas with a neo-Gramscian theory of discourse. Bevir puts the case for an ‘anti-foundationalist’ approach to understanding ideas, yet he defends a weak rationalism centred on individual intentions as the original source of all meanings. Discourse theorists—specifically Ernesto Laclau and Chantal Mouffe—also adopt an anti-foundationalist perspective but pursue its implications beyond any rationalism. The advantages of discourse theory are argued to lie in its emphasis on power and conflict in the consitution and transformation of social meanings and identity. Laclau and Mouffe's work, it is claimed, alerts us to a political logic of discourse that Bevir's more rationalist approach to ‘ideas’ sidesteps.  相似文献
