British Postal Packet Hanover, 1757: a legal history

The wrecking of the Falmouth Postal Packet Hanover in 1763 led to three legal disputes and two court cases—in 1766 and 1997. This article recounts the origins and course of these disputes. It examines what the resolution of the 18th‐century case and the second dispute has revealed of the law and practice of marine insurance in the mid 18th century. It further examines what the 20th‐century case has revealed concerning the tension between ancient principles of commercial salvage and modern principles of heritage protection. Somewhat fortuitously, the examination of the case provides an opportunity to advance a simple solution to this conflict.     

Antiquity at the National Memorial Arboretum

The paper explores the use of ancient and historic material cultures and architectures within the recent resurgence in public commemoration in the UK. Using the case study of the National Memorial Arboretum (Staffordshire), the study focuses on how ancient designs (including prehistoric, classical and medieval styles and forms) interleave with the arboreal, geological and celestial themes of the memorial gardens. Together these designs serve to create a multitude of temporal poises by which auras of commemorative perpetuity and regeneration are projected and sustained. The paper proposes that archaeologists can bring their expertise to bear on the investigation of the complex, varied allusions to the past within contemporary landscapes of memory.     

Transit Access for Americans: A Proposal for the Next Stage of Implementing the Americans With Disabilities Act of 1990

Formany Americans with disabilities, transit is the only path to real opportunities. An open society for them depends upon increased transit services for all Americans. Many transit professionals, however, daunted by transit needs and worn down by their critics, wallow in cost issues, ignoring transit's real value to their communities. The key to improvement is to measure transit benefits that are intuitively obvious to most taxpayers. Empirically, accessible transit proves to be the most valuable transit to passengers and to other taxpayers as well.     

Social Dynamics and Pottery Distribution in the Faro Department, Northern Cameroon

Ethnoarchaeological studies have constantly emphasized the complexity of pottery distribution and its close ties with other aspects of social life. It is argued here that, among the Dowayo of northern Cameroon, pottery exchange is not regulated by preferential economic relationships between producers and consumers but rather by mechanisms such as fashion or the reputation of the artisans.De récentes études ethnoarchéologiques ont constamment mis en avant la complexité des processus de distribution de la poterie et les liens étroits que ceux-ci entretiennent avec les autres aspects de la vie sociale. Il est démontré dans cet article que, chez les Dowayo du Nord-Cameroun, les échanges de poterie sont structurés par une absence de lien privilégié entre producteurs et consommateurs et sont dès lors régulés par des mécanismes tels que la mode ou la réputation des artisans.     

Commercial developments and their impact on maritime heritage: the Northern Ireland experience

This paper refers to the body of international, national and regional legislation that exists to protect submerged cultural heritage sites. It advocates the use of the consultation process available through current legislation to protect submerged sites through preservation or through record by archaeological mitigation. It reviews the main types of commercial seabed developments and opens discussion on the appropriate archaeological response.     

The Failure of Citizens’s Initiated Referenda Proposals in Australia: New Directions for Popular Participation?

Australia has been a leading proponent of direct democracy since the turn of the century because of the provision for referenda in the Australian Constitution. However, the experiment has progressed little further. Bills for citizens’s initiated referenda have been introduced across the Australian parliaments. Not one has been passed, despite the concept being supported at different times by all sides of politics. This article examines why these proposals have failed. It also evaluates other means of reinvigorating popular participation. Widespread disillusionment with the political system indicates that there is a genuine need to increase community involvement in the political process.     

The Carnival of Custom: Land Dives,Millenarian Parades and Other Spectacular Ritualizations in Vanuatu

ABSTRACT This paper deals with the aestheticization and commoditization of culture in specific grand rituals held in Vanuatu. Through political, commercial and juridical processes, the traditional referent of these neo‐ritualizations has been replaced by a celebration of the kastom theme itself; the official value of a regional, national, and global cultural heritage. The examination of two iconic rituals, the Nagol land dive on Pentecost island and the 15th February annual commemoration of John Frum on Tanna island, reveals them as similarly invoking a Christian and colonially inspired reverence in their idealization of an ancestral past. Nevertheless, the increasing monetarization of village communities through the global promotion of kastom spectacles by media and for touristic purposes is ever more frequently considered locally as a factor of inequality or division.
