Congress and the Constitution: The Twenty-seventh Amendment and the Past and Future of Constitutional Alteration

The most recent addition to the U.S. Constitution is also one of the first proposed amendments. The 27^th Amendment restricts change to congressional salaries until after the next election. First drafted by James Madison and approved by Congress in 1789, the proposal was among a package of 12 items sent to the states. Ten of those proposed amendments were ratified and became known as the Bill of Rights. The others languished with only occasional attention by constitutional scholars. In the early 1980s, an undergraduate student at the University of Texas wrote a term paper arguing for adoption of the limits on congressional pay raises. After receiving a C grade from his teaching assistant and instructor, the student rejected the opinions of his teachers and independently pursued the adoption of Madison's proposal. Gregory Watson single-handedly mounted a letter-writing and lobbying campaign that caused state legislators to redirect their attention to the proposed amendment. In 1992, following a most unusual ratification process—including certification by the Archivist of the United States—the measure became the 27^th Amendment. In this article, we trace the history of the amendment, demonstrate that its impact has been more symbolic than substantive, and argue that Congress needs to reassert its authority over the amendment process in line with the letter and spirit of Article V. The 27^th Amendment has a peculiar constitutional history, and there are lessons we should learn from that experience.     

The Sherwood Foresters of 1916: memories and memorials

ABSTRACT

This paper examines the memorialisation of the Sherwood Foresters who fought during the Easter Rising of 1916 in Dublin. These men, from Nottinghamshire and Derbyshire in the English midlands, suffered the greatest casualties of the British regiments involved in the insurrection, and participated in the firing squads that executed the rebel leaders. Yet the public and artistic memorialising of these English soldiers is not widely known, and this interdisciplinary paper seeks to tell the unfamiliar story of what happened to the Sherwood Foresters after the fighting of Easter Week ceased. We use archival material in order to explore how, at the time of the Rising, these men believed that they would be remembered. We examine the way that the Sherwood Foresters of Easter Week subsequently appeared in literature and drama. And we analyse the way that those soldiers have been commemorated in funerary memorials.     

Becoming ‘enchanted’ in agro-food spaces: engaging relational frameworks and photo elicitation with farm tour experiences

Abstract

Ecofeminists maintain that seemingly diverse and naturalized socio-ecological issues are in fact rooted within a particular cultural framework that perpetuates inequality and severs relationships among human and more-than-human communities. This important yet perhaps abstract understanding can be made tangible via examination of the ‘conventional’ food system, in which human and more-than-human communities are simultaneously otherized, marginalized, and exploited, realities largely hidden in a global industrial food system that disconnects production from consumption and obscures embedded relationships. Yet as consumer awareness rises, more people wish to know and move closer to the sources of their food, fueling community-based agro-food alternatives. When endowed with an ethic of care, such alternatives can be transformative for individuals and communities across scales.

This article situates conventional and alternative agro-food systems within relational frameworks of ecofeminism and care ethics and uses participant-driven photo elicitation (PDPE) to engage with experiences of consumers participating in a community farm tour. Findings suggest that such ‘enchanting’ experiences can begin to (re)embed food ‘products’ within contexts of place, people, and process, contributing to a relational consciousness that is central to an ethic of care. Findings also illustrate that PDPE can serve as a valuable window into experiences of reconnection, particularly useful for feminist researchers interested in learning more about enchantment and the transformational potential it holds.     

Is It Always Good to Talk? The Paradoxes of Truth-Telling by Rwandan Youth Born of Rape Committed during the Genocide

Social scientists have extensively debated the virtues, pitfalls, and practical effects of open dialogue and truth-telling versus silence and concealment in global post-conflict endeavours for justice and reconciliation. This article addresses these debates not by endorsing practices of either talk or silence, but by investigating the practical dilemmas faced by Rwandan youth born of rape committed during the 1994 genocide as they find themselves caught in dual cultural imperatives to reveal and to conceal the circumstances of their origins. On the one hand, the post-genocide moment has seen the rise of truth-telling and self-revelation through testimonial practices in settings like post-genocide trials and reconciliation or peace-building workshops. On the other hand, silence and concealment are accepted and expected modes of dealing with hardship in Rwandan cultural practice, and youth participants struggled with the stigma of having been born of genocidal rape. We argue that the youths’ ambivalent and sometimes contradictory moral evaluations of talking about versus hiding their origins highlight the challenges and complexities of identity and belonging in post-genocide Rwanda, since their very existence draws them, their mothers, and their perpetrator-fathers into ongoing relationships. These youths’ lives and experiences speak to larger and powerful conundrums at the heart of what it means to live with legacies of violence, including what should be said or remain unsaid, and how the very opposition between revealing and concealing can be confounded by social and cultural variances in the meaning of “truth.”     

Assessing Australia’s options in the context of Brexit: engaging with the UK and the European Union

ABSTRACT

The Brexit vote will fundamentally transform the European Union (EU) and will change how the UK relates to Europe and the rest of the world. What are the implications for Australia at this critical juncture? The UK has been a major player in the Australia–EU relationship, and Australia will now need to recalibrate its approach to both the UK and the EU across a range of policy areas. This article examines the future of Australia–UK and Australia–EU relations in the wake of Brexit, and assesses Australia’s options going forward. The authors advance three considerations. Firstly, Australia’s national interests are best served by adopting a pragmatic rather than nostalgic approach towards future relations with the UK and the EU. Secondly, Australia should avoid pursuing one relationship at the expense of the other and creating a zero-sum dynamic. Finally, Australia’s future strategy must consider broader global developments, such as events within its own region and the US presidency.
