This paper examines the law as a mechanism for resisting neoliberal policy change through a consideration of legal challenges to welfare reform in the United States. The Welfare Reform Act of 1996 marked a sea change in both the content and scale of the American social welfare system. It has entailed a downward shift in policy creation and administration from the national to the state and local level, and conveys a heavy emphasis on the “responsibility” of single mothers to engage in waged labor. In addition to changing the scale at which the social welfare system operates, welfare reform has changed how the more oppressive aspects of this policy might be resisted. While some legal advocates are challenging welfare reform by working within the “policy scale”, others are invoking national level protections by appealing to Civil Rights legislation. By working against the scale imposed by neoliberal social policy, Civil Rights legislation presents the possibility for advocates to “re‐scale responsibility” from that of single mothers to submit to wage labor in order to survive, to the government’s responsibility to protect its citizens against identity‐based discrimination. Herein, I argue both that the law can serve as an important mechanism for re‐focusing the scale of resistance in efforts to challenge oppressive social policy; and that even in the face of policy that imposes a local scale, the national level holds potential as an important terrain of resistance. 相似文献

Medieval prohibitions abound against artisans selling stolen or bloodied goods, and refabricating used clothing to deceive customers. Such prohibitions have led scholars to suggest the secondhand trade in the Middle Ages was one of poverty or marginality. Yet, if we read trade regulations carefully and alongside other types of sources as well as consider the context of a late medieval economy undergirded by credit, a complex image of fripperers materialises. This was a trade populated by both men and women of various means vying with each other and other merchants and artisans for control of retail space. This paper works to uncover the economic and cultural standing of fripperers in thirteenth- and fourteenth-century Paris and the commercial space of Les Halles. 相似文献

Abstract: Much of the discussion surrounding neoliberal urbanism has been empirically grounded in the North. This paper shifts the discussion south to focus on the regulation of indigenous street vendors and beggars in the Andean nation of Ecuador. Inspired by zero tolerance policies from the North, the cities of Quito and Guayaquil have recently initiated urban regeneration projects to cleanse the streets of informal workers, beggars, and street children. In this paper, I explore the particular and pernicious ways in which these neoliberal urban policies affect indigenous peoples in the urban informal sector. Grounded in the literature on space, race and ethnicity in the Andes, I argue that Ecuador's particular twist on revanchism is through its more transparent engagement with the project of blanqueamiento or “whitening”. I further argue that Ecuador's “refinement” of revanchist urban policies only works to displace already marginalised individuals and push them into more difficult circumstances. 相似文献

Ludlow, based on associated conodonts. The fish fauna comprises loganelliiform thelodont scales, the ? stem gnathostome Aberrosquama occidens nov. gen. et sp., the acanthodian Nostolepis sp. aff. N. alta, and the ? stem osteichthyan Andreolepis sp. aff. A. petri. Because of the paucity of the material, and some differences between the Pendock scales and those of established species, a precise age can not be confirmed; however, the composition of the fauna at generic level most closely resembles that of late Silurian (Ludlow) assemblages from northern Eurasia.Carole J. This article examines one of the most intractable problems that a newly independent nation encounters; the dissonance between the rhetoric of a revolutionary movement and its subsequent treatment of women in nationalist and supposedly decolonial projects. In drawing on interviews and archival research carried out in periodicals, newspapers and Hansard, the article examines the optimism, disillusionment and betrayal of Zimbabwe's women in the first decade of independence. Exploring women's variegated roles during the country's war of independence, this article argues that many women believed that their participation in national liberation would be a precursor to a broader programme of cultural and societal emancipation. Yet, as is shown, governmental thinking placed women as consumers and not producers of new nationalist culture. In particular, the grim reality of the situation was unambiguously shown just three years into independence through ‘Operation Clean-Up’, whereby thousands of women in Zimbabwe's main cities of Harare and Bulawayo were indiscriminately detained with state machinery arguing that the women were prostitutes, vagrants and beggars. A blatant effort to curtail women's autonomy in urban spaces, the machinations of ‘Operation Clean-up’ demonstrated an uneasy coherence between colonial and post-colonial thinking regarding the ‘appropriate’ place for women in the new nation. 相似文献
