广东少数民族地区非物质文化遗产保护的现状与发展

近几年来,非物质文化遗产的抢救、保护与发展已成为人们所关注的热点问题之一。本文回顾了这几年来广东省少数民族地区非物质文化遗产保护取得的成果和存在的问题;并指出是否能够利用非物质文化遗产的独特性,引入文化旅游的概念,将保护非物质文化遗产与发展当地旅游产业和文化产业结合起来,使两者形成良性互动,取得良好的经济效益,促使人们自发主动地保护和传承少数民族地区非物质文化遗产。     

论旅游立法中非物质文化遗产保护的完善

随着旅游业的繁荣和世界各国对非物质文化遗产保护的重视,在旅游过程中如何促进作为重要旅游资源的非物质文化遗产的保护,实现旅游与非物质文化遗产保护的双赢与互动显得尤为重要。非物质文化遗产与旅游契合于文化性。在依法治国的背景下,以旅游法为载体,通过旅游法的体系化实现对非物质文化遗产的保护是可行而科学的。我国应通过制定旅游基本法、行政法规与部门规章、省级地方旅游法规等法律,实现对非物质文化遗产从宏观到微观多方位的保护。     

非物质文化遗产保护工作方法创新琐谈

我国非物质文化遗产的保护方法应该采用公权为主、私权相辅的保护方法。对非物质文化遗产进行解构,通过公权的方式维护其"文化空间",实现其公共利益;通过私权的方式,利用著作权制度保护非物质文化遗产的创新产品,并鼓励其走产业化的发展道路;对于历史悠久的传统作品,可以通过私权与公权相结合的方式,调动相关地方和人员的保护积极性,实现非物质文化遗产应有的利益,保护好我国珍贵的非物质文化遗产。     

浅谈旅游开发中的非物质文化遗产保护

非物质文化遗产是人类文化的重要组成部分,如何正确处理旅游开发与非物质文化遗产保护,历来是学界争论的话题。本文立足于花溪区非物质文化遗产的发展,从旅游业与非物质文化遗产的关系进行分析,阐释了如何在发展旅游业的同时保护好非物质文化遗产。

非物质文化遗产保护不能是简单的呵护,而必须在继承中创新,保护中发展。保护和创新本民族的传统文化,应该正确处理好保护和利用的关系。而要对非物质文化遗产实行保护,就要探讨和了解非物质文化遗产的生存特点和发展规律,只有懂得了非物质文化遗产的生存特点和发展规律,才能做到正确的、有效的保护与创新。     

旅游开发与非物质文化遗产保护

非物质文化遗产是我国宝贵的遗产资源,对于目前我国非物质文化遗产资源不断消失的现状,如何保护这些遗产资源成了一个亟待解决的问题。笔者认为旅游开发是保护非物质文化遗产资源的有力途径,故本文试从旅游资源调查评价、宏观战略制定、旅游项目设计三个方面具体阐述如何对其进行保护。

非物质文化遗产知识产权保护研究进展

近年来,关于如何建立有效的保护非物质文化遗产知识产权法律机制,建构相应的规则体系和理念基石,成为国内外学术界、实务界讨论的热门话题。本文在对国内外非物质文化遗产知识产权保护研究成果梳理的基础上,通过分析日本、韩国、法国、意大利等国家非物质文化遗产知识产权法律保护以及我国关于知识产权保护的立法实践,从研究非物质文化遗产概念、性质,国内非物质文化遗产保护现状入手,对非物质文化遗产知识产权保护的正当性,非物质文化遗产知识产权的权利主体、保护客体以及非物质文化遗产知识产权保护模式等方面进行归纳与总结,进而提出在非物质文化遗产可以采用或借鉴知识产权保护模式进行保护的前提下,将非物质文化遗产划入现行知识产权法的保护范围,在现有法律框架基础上确立社区或族群作为知识产权主体的权利,以及采取"适度原则",在现行知识产权框架内创设一种"传统资源权"等观点。

随着社会的不断发展,越来越多的消费者选择旅游作为休闲放松的方式,这为旅游行业带来了巨大的发展机遇。非物质文化遗产是全人类共同的文化瑰宝,作为文化多样性的具体表象,其对当今社会文化的发展具有相当重要的意义。然而,非物质文化遗产传承与保护与旅游开发之间的矛盾却在逐渐加剧。因此,如何解决二者间存在的矛盾,实现非物质文化遗产与旅游业共同发展,是目前亟待解决的问题之一。本文以非物质文化遗产保护与旅游开发为研究对象,分析如何在促进非物质文化遗产开发的同时实现对其的传承与保护,以期能够为旅游行业发展和非物质文化传承与保护提供参考。
