The legitimacy of government agencies rests in part on the premise that public administrators use scientific evidence to make policy decisions. Yet, what happens when there is no consensus in the scientific evidence—i.e., when the science is in conflict? I theorize that scientific conflict yields greater policy change during administrative policymaking. I assess this claim using data from the U.S. Food and Drug Administration (FDA). I identify policy change—what I refer to as “policy development” in this article—between the FDA's draft and final rules with a novel text analysis measure of shifts in regulatory restrictions. I then go on to find that more policy development does occur with scientific conflict. Moreover, using corresponding survey data, I uncover suggestive evidence that one beneficiary of such conflict may be participating interest groups. Groups lobby harder—and attempt to change more of the rule—during conflict, while an in‐survey experiment provides evidence of increased interest group influence on rule content when scientific conflict is high.  相似文献

Congressional scholars have conducted little research on the consequences of the majority party controlling bill formulation and excluding minority members from the legislative process. Critics of one-party deliberations use case-study evidence to argue that such processes lead to error-prone, often defective legislation. However, no large-N analysis has sought to operationalize and verify this effect. I develop new empirical strategies to explore claims about the relationship between deliberative procedures and policy outcomes. Examining legislation drafted in the U.S. House between 1987 and 2008, I find suggestive but consistent evidence of error-prone bills being developed under one-party processes.  相似文献

This article examines the representativeness of conference committees in the U.S. Congress by measuring the difference in observed policy preferences between the conference delegations and the parent bodies. We predict and find significant differences between the House and Senate in terms of the partisan bias of conference delegations. House conference delegations are systematically biased in favor of the majority party and away from the chamber median. We take the additional step of exploring the source of this bias. In particular, we examine whether majority party bias in conference is a function of partisan processes at work directly in the selection of conferees. We find evidence that the conditions of majority party influence in the House are consistent with some existing theoretical models of party influence in legislating. There is less conclusive evidence of partisan processes in the Senate, which is consistent with institutional differences in appointment practices.  相似文献

A central preoccupation for archaeologists is how and why material culture changes. One of the most intractable examples of this problem can be found between AD 400 and 800 in the enigmatic transformation of sub-Roman into Anglo-Saxon England. That example lies at the heart of this review, explored through the case of the agricultural economy. Although the ideas critically examined below relate specifically to early medieval England, they represent themes of universal interest: the role of migration in the transformation of material culture, politics, and economy in a post-imperial world, the significance of “core” and “periphery” in evolving polities, ethnogenesis as a strategy in kingdom building, property rights as a lens for investigating cultural change, and the relationship between hierarchical political structures and collective forms of governance. The first part of my argument proposes a structured response to paradigmatic stalemate by identifying and testing each underlying assumption, premise, and interpretative framework. The recognition of any fallacies, false premises, and flawed arguments might assist with an overall evaluation of the continuing utility of a discourse—whether it has life in it yet, or should be set aside. In either case, the recognition of its structure should enable arguments to be developed that do not lead into a disciplinary cul-de-sac, prevented by the orthodoxy from exploring new avenues for research. In the second part of the review, I deliberately adopt a starting point outside the limits of the current discourse. Freed from the confines of the conventional consensus, I experiment with an alternative “bottom-up” approach to change in early medieval England that contrasts with conventional “top-down” arguments. I focus in particular on how rights over agricultural property—especially collective rights—and the forms of governance implied by them may assist in illuminating the roles of tradition and transformation in effecting cultural change.  相似文献

A growing number of studies identify “morality policy” as a distinct category of public policy and have tested several related hypotheses. This article reexamines morality policy as a conceptual category and an empirical phenomenon. As others have pointed out, we should distinguish morality policy from other policies by how political actors frame issues rather than by its substantive content. In the first part of the article, I argue that we should view morality “policy” as one of two broad strategies for framing issues, rather than try to fit it into existing policy typologies. Next, I move beyond viewing morality policy as a single, broad category by identifying several distinct subtypes of morality frames. In the second part of the article, I challenge a basic assumption of the morality policy paradigm—that advocates frame morality policy issues by engaging in moralistic discourse that reflects their basic beliefs and values. Gay rights issues are a strong test of this claim because the literature cites them as typical examples of morality policy, and gay rights opponents would seem especially likely to engage in “morality talk” in framing these issues. Very few studies of morality policy actually observe framing behavior and what it reveals about the political strategy of each side. Congressional and state‐level data reveal that opponents usually do not frame gay rights issues in terms of the morality of homosexuality or religious injunctions against it, even in most states where we would expect to find it. Instead, they emphasize frames that focus on alleged negative social consequences from gay rights and procedural arguments about who should make policy and how it should be made. Although many opponents of gay rights disapprove of homosexuality on moral and religious grounds, their framing behavior reflects more complex strategic considerations. I speculate that opponents deemphasize morality talk because it is politically disadvantageous compared with other kinds of frames, and because of greater acceptance of gays in society. In reducing gay rights debates to moral and religious judgments, the morality policy perspective obscures the complexity of advocates' framing strategies and ignores many of their most important arguments.  相似文献

Trade voting in the U.S. House of Representatives from 1993 to 2001 provides an opportunity to move beyond examining the determinants of trade voting on single bills and to focus on the consistency members of Congress demonstrate in their trade preferences. We find that while a significant percentage of House members are consistent in their trade preferences during the time period, a surprising percentage of those members serving over the entire period are inconsistent, affecting important changes in U.S. trade policy. Ideological, partisan, and constituency- based factors prove significant cross-pressures on House members' trade preferences throughout the time period; however, we unearth differences in effects between the two parties. It is these cross-pressures that lead to inconsistent preferences among some legislators.  相似文献

The 109th Congress commenced with a huge ethical cloud hanging over the Capitol. In January 2005, prominent Washington lobbyist Jack Abramoff admitted conspiring to defraud Native American tribes and corrupt public officials. As a result, the Democratic Party chose to adopt corruption as a central theme of their 2006 congressional campaign. They argued that the scandal resulted from a “culture of corruption” fostered by Republicans, who controlled Congress. Although past research shows that voters do punish at the polls congressional incumbents under criminal investigation, little is known about whether the mere appearance of wrongdoing can be assigned to an entire party and cost its candidates votes. Utilizing data from a variety of sources, we find that systemic efforts by House Democratic leaders to frame Republicans as “owning” the scandal—whether individual members actually received Abramoff funds or not—were largely successful in the polls and at the ballot box. These findings suggest that scholarly views of the influence of corruption may have been overly restrictive and that voters are willing, at least in this case, to punish public officials who “appear” to be corrupt.  相似文献

East Asia has led the world in economic growth and export expansion in recent decades. The phenomenal rate of economic growth among the so‐called “four little tigers”—Hong Kong, Singapore, South Korea, and Taiwan—enabled them to achieve newly industrializing country (NIC) status in the 1980s, followed by Indonesia, Malaysia, and Thailand. Earlier studies explained the development from the government‐led development paradigm, or the so‐called the statist approach. Scholars also argue that foreign direct investment (FDI) played an important role in the economic development, thanks to technology transfers. Kojima and Ozawa and later Kohama, however, argue that Japanese FDI help East Asian economies while U.S. FDI do not because Japanese technology transfer practices are appropriate for East Asian countries but not the United States'. Thus, we revisit the issue of East Asian economic development and test the economic effects of FDI from the United States and Japan. Using a Barro‐type growth model, we test the effects of FDI from the United States and Japan on economic growth in East Asian NICs. We find that FDI from both the United States and Japan helped economic growth in the “four little tigers,” but not in Indonesia, Malaysia, and Thailand.  相似文献

In the years since its twin publication in 2001 (Indian edition) and 2003 (U.S. edition), Textures of Time has attracted a great deal more attention outside the United States than in the American academy. This, we suggest, is because its ideas and approach are rather at odds with the dominant trends in the area of “postcolonial studies.” In this response to three critical essays that engage with the book—by Rama Mantena, Sheldon Pollock, and Christopher Chekuri—we begin by setting out our principal hypotheses as well as the evidentiary structure of the book, which draws mostly on vernacular materials from South India in the seventeenth and eighteenth centuries. The former includes the claim that South India between roughly 1600 and 1800 (and thus in the centuries before the consolidation of colonial rule) possessed considerable and diverse historiographical traditions, though these histories came couched in a variety of genres, rendering them difficult for the uninitiated to recognize at first; the latter requires us to develop the significance of the concepts of “texture” as well as of “subgeneric markers” that help distinguish texts with a historical intention from those that are nonhistorical but have the same generic location. Our response then goes on to discuss why theoretical or ?āstric texts in India do not themselves explicitly theorize the distinctions we make. Here, we posit a contrast between “embedded” and “explicated” concepts in the “emic” sphere, suggesting that “texture” belongs to the first category. We explicitly distinguish our views from the poststructuralist (and Barthesian) language adopted by Pollock in his critique of Textures, and the more predictable postcolonial vision of Chekuri. We once more emphasize the need to take the vernacular historiography seriously, and to refine our reading practices, rather than overly depending on normative materials in Sanskrit, or on a prefabricated theoretical schema that derives from a stylized (and impoverished) view of the nature of the transformations produced by colonial rule.  相似文献

Sexual minorities in Poland are excluded from the traditional understanding of “Polishness” premised on conservative, Catholic values. This article examines how ethnic Polish citizens who identify as non‐heteronormative navigate their relationship to “Polishness” at a moment of heightened nationalism. Through 31 interviews with Polish sexual minorities, I show that while national identification is a struggle for some sexual minorities, others work to reframe what “Polishness” means to them. I argue for further research examining the ways that stigmatised members of the ethnic majority—what I term ideological others—understand and navigate their relationship to national identity. The study contributes to the literature on everyday nationhood and national identity by attending to national identification among stigmatised members of the ethnic majority.  相似文献

Research to date has often positioned women of minority cultures as a separate group. They were, in many cases, twice removed — both from the men in their communities and from the majority communities within which they lived. This essay discusses the benefits of including these women, both as separate groups and as part of cross cultural comparison and points to the possible contribution of such studies. In the three parts of this article I propose different strategies for studying minority and majority women using examples from the sources on Jews in medieval Europe. In the first section, the article explores how to learn from similarities and differences between majority and minority practices, focusing on wet-nursing practices and medical care. The second part of the article proposes examining how ordinary people themselves perceived the ‘religiousness’ of certain everyday practices and set their own boundaries to what they were and were not willing to do. In this case, I suggest that more attention be paid to the way medieval women (and men) turned daily actions into religious proclamations and how in some cases they involved members of other religions in what seem to be internal affairs. This, in turn, leads to a final, larger comparative question taken up in the final part of the article: how do the larger trajectories of transformations in women's roles and rights compare across different religious cultural traditions.  相似文献

Baseline models have been used in the analysis of social networks as a way to understand how empirical networks differ from “random” ones. For the purposes of social network analysis, a “random” network is one chosen—at random—from a population of possible graphs derived from a given generating function. Although these principled hypothesis tests have a long history, many of their properties and extensions to multiple data structures—here, specifically two‐mode data—have been overlooked. This article focused on applications of different baseline models to two data sets: donations and voting of the 111th U.S. Congress, and organizations involved in forums on watershed policy in San Francisco, USA. Tests using each data set, but with different baseline reference distributions, will illustrate the range of possible questions baseline models can address and the differences between them. The ability to apply different models and generate a constellation of results provides a deeper understanding of the structure of the system.  相似文献

One important criterion for assessing the quality of democratic governance is the extent to which the policy process effectively translates citizen preferences into collective choices. Several scholars have observed a discrepancy between citizen preferences for strong environmental protection and weak policies adopted in the United States, indicating that the United States may fall short on this criterion. We examine one possible mechanism contributing to this discrepancy—legislator defection from campaign promises. Our data indicate that legislators in the U.S. Congress routinely defect from their campaign promises in environmental protection, undermining the link between citizen preferences and policy choice. We also find that legislators are much more likely to defect from pro‐environmental campaign promises, which moves government policy toward less stringent environmental programs. Finally, the propensity of legislators to defect from their campaign promises is systematic, with defection affected by partisanship, constituency influence, the influence of the majority party, and the likely consequences of defection for policy choice. These findings contribute empirical evidence relevant to the “mandate theory” perspective on how citizen preferences are translated into collective choices through the policy process. These findings may also complement research in comparative politics concluding that legislatures selected through single member districts adopt less stringent environmental policies than do legislatures chosen via proportional representation in that the mechanism for this effect may go through legislator defection from campaign promises.  相似文献

Legally protected individual private property rights and a constrained state are doctrines of neoclassical economics-derived development theory. But what about China? It lacks strong rule of law, property rights can be collective, contested and ambiguous, and the state is relatively unconstrained and maintains a central role in the economy; yet it has seen impressive economic growth to take it to the world’s second largest economy. I argue that in the absence of legal/rational protections of individual property rights, political and social networks can provide alternative methods of property protection, allowing for economic development – with political protection substituting for legal. The novel claim I make is that ambiguity of property rights can provide opportunities and spaces for development and innovation, with the building of meaning and institutions found in a transitional state, where rules are unclear and contested, and where formal rules can “catch up” if apparent success can be demonstrated.  相似文献

I argue that the French economist Thomas Piketty's 2014 (American) bestseller Capital in the Twenty-First Century is not the treatise of economic analysis that its author purports it to be, but is rather a work of political partisanship making claims about the supposedly inevitable increase in the share of national income deriving from capital as opposed to labor—to the point where Chinese bankers or Middle Eastern oil sheiks might own “everything,” even people's bicycles, barring either world catastrophe or broad government intervention—that lack any empirical support or logical plausibility. As a professed heir to (what he understands to be) the spirit of the French Declaration of the Rights of Man and Citizen, as distinguished from the American Declaration of Independence, Piketty displays none of the respect for the rights of the individual—including the right not to have lawfully acquired property arbitrarily confiscated by government—that the original American political tradition entails. Nor, indeed, despite his profession of staking everything on “democracy,” does Piketty display any regard for the principle of self-government. Rather, his ultimate, admittedly “utopian” goal, outlined in Part IV of his book, is of a European “budgetary parliament,” selected in vague fashion by the existing parliaments of Eurozone members (not by the people themselves), that would hold sweeping powers to confiscate any privately owned wealth that its members regarded as “excessive” and redistribute it to others they deem more needy or deserving. This body would exacerbate all the difficulties resulting from the European Union's widely publicized “democracy deficit.” Yet Piketty implies it should ultimately be a model for world governance. Ultimately, his cause is the opposite of democracy: the unfettered continental or even worldwide rule of unaccountable bureaucrats, advised by “intellectuals” like Piketty himself, convinced that they know far better than their fellows how the latter should live their lives, and claiming the authority to regulate it accordingly.  相似文献

This article provides a historical overview of the development of the U.S. Latina/o Muslim community. U.S. Latina/os have been converting to Islam since the 1920s. Early converts were primarily found in African‐American‐majority Islamic communities, though there were some others who entered Islam through ties to Muslim immigrants. In both cases, the U.S.'s racist social system had brought the two communities together. In New York City during the 1970s, however, a group of around a dozen Latina/o Muslims felt that neither the African‐American‐majority nor the immigrant‐majority communities sufficiently addressed Latina/os' particular culture, languages, social situations, and contributions to Islamic history. To correct this, they created the first known U.S. Latina/o Muslim organisation, the Alianza Islamica, a group which fostered a “Latino Muslim” identity. Since that time, due to the growing numbers of U.S. Latina/o Muslims, as well as a tendency to foster ties with Latina/o Muslims in countries outside of the U.S., U.S. Latina/o Muslims are more and more adopting the “Latino Muslim” identity, which is now being promoted by several organisations and prominent leaders.  相似文献

Why are Americans who believe homosexuality is innate more likely to support the rights of lesbians, gay men, and bisexuals (LGBs)? Attribution theory suggests that people are more likely to support LGB rights if they do not blame LGBs for their sexual orientation. Alternatively, moral condemnation of homosexuality may lead both to belief that homosexuality is a choice and opposition to LGB rights, while acceptance of LGB rights may lead to a belief in a biological basis for homosexuality as part of a constellation of tolerant beliefs. Using logit analysis on individual‐level data from 24 national surveys conducted since 1977, I find that the link between belief in a biological basis for homosexuality and support for LGB rights is strong and growing for almost all groups on almost all issues. The reason may have more to do with people shaping their origin beliefs to match their political and religious values, than with origin beliefs affecting support for LGB rights.  相似文献

In this article I try to answer the question posed by History and Theory's“call for papers”; namely, “do historians as historians have an ethical responsibility, and if so to whom and to what?” To do this I draw mainly (but not exclusively and somewhat unevenly) on three texts: Alain Badiou's Ethics: An Essay on the Understanding of Evil, J. F. Lyotard's The Differend, and Edward Said's Representations of the Intellectual; Jacques Derrida and Richard Rorty have a presence too, albeit a largely absent one. Together, I argue that these theorists (intellectuals) enable me to draw a portrait of an ethically responsible intellectual. I then consider whether historians qua historians have some kind of ethical responsibility—to somebody or to something—over and above that of the intellectual qua intellectual; I reply negatively. And this negative reply has implications for historians. For if historians are to be intellectuals of the type I outline here, then they must end their present practices insofar as they do not fulfill the criteria for the type of ethical responsibility I have argued for. Consequently, to be “ethical” in the way suggested perhaps signals—as the subtitle of my paper suggests—the possible end of a history “of a certain kind” and, as the inevitable corollary, the end of a historian “of a certain kind” too.  相似文献

Abstract: This paper is a critical engagement with immanentist approaches to cities. Geographers approaching the urban through an immanentist lens—primarily inspired by Gilles Deleuze's work—have called into question transcendent determination, namely the determination of material reality by an external and ontologically distinct substance. This has been an implicit assumption in approaches that reduce contemporary urban developments to “effects of globalization” or “impacts of neoliberalism”. I identify two major shortcomings within the recent immanentist critique: first, their rejection of the notion of a structure in toto, and second, their noticeable silence on Louis Althusser despite his unique contribution to the question of complex causality and his shared trajectories with and influence on Deleuze. By using illustrations from the ongoing urban renewal program in Istanbul, I speculate on the ways in which an Althusserian notion of “immanent structure” could contribute to a better understanding of cities as multiplicities.  相似文献

Mexican post-revolutionary cultural institutions excelled at implementing Mexican art and popular arts as key elements in cultural diplomacy. However, while there is abundant research regarding these arts and their inclusion in international exhibitions during the first part of the twentieth century, there is little research on their role in international cultural diplomacy during the second half of that century. In the first part of this article I present a historiographical appraisal of the 1968 Mexican Cultural Olympiad and the resolutions of the “First Latin American Seminar on Popular Arts and Crafts” sponsored by UNESCO in Mexico City in 1965. In the second, I examine the case of U.S. participation in the “Exposición Internacional de Artesanías Populares” (International Exhibition of Popular Arts), which was part of the 1968 Cultural Olympiad’s programme – largely neglected by the historiography of the XIX Olympics – to explain how popular arts were made to perform as agents of cultural diplomacy in Mexico and the U.S. during the Cold War. In addition, I argue that U.S. participation in this exhibition also reveals negotiations and redefinitions of the concepts of handcraft and arte popular, and the economic and social situation of their makers in the United States.  相似文献
