In 1835, a statute was passed in the parliament of the United Kingdom making it illegal for a widowed man to marry his sister-in-law. 1 Lord Lyndhurst's Act (1835) 5 & 6 Will VI c. 54. Marriage to a sister-in-law after a wife's death was common practice in nineteenth-century England and colonial Australia and aunts often took on the responsibility of raising children after a sibling's death. In the 1840s, a protracted parliamentary and social debate began over whether a widowed man's marriage to his sister-in-law should be made legal and this debate lasted over seven decades. In the Australian colonies, where English law had been inherited, 2 Those Australian colonies settled prior to the passing of Lord Lyndhurst's Act inherited the English position regarding deceased wife's sister marriage at the time, that such unions were voidable in the ecclesiastical courts during the lifetime of the parties, and in those colonies established afterwards, the 1835 statute applied and deceased wife's sister unions were illegal. In both cases colonial parliaments attempted to pass legislation to clarify the law. a similar debate occurred in the 1870s. The marriage was legalised in most of Australia in the 1870s while it remained illegal in England until the turn of the century. The parallel debates in each country provide a window into the comparative effect of religious culture on the development of marriage law. One of the primary reasons for the protracted nature of the struggle for marriage reform in England was its significance for the relationship between church and state. This article explores the implications of the relationship between church and state in Britain and the colonies for marriage legislation.  相似文献

This article examines how one group of actors actively infused education, citizenship and Canada’s international relationships with a sense of empire in the first third of the twentieth century. Making use of archival and published sources from collections in Canada and Britain, it focuses in particular on imperial citizenship teaching in Canadian schools, a number of education conferences held in the United Kingdom and the exchanges of elementary and high school teachers and school inspectors between commonwealth countries. In this period, politicians and bureaucrats in Canada and other dominions actively connected their education systems to an imperial network at the very moment that others were striving to attain more economic and political autonomy from the British government. Education came to occupy a significant cultural space alongside the trade agreements and constitutional changes that slowly recalibrated the nature of the British imperial system in the interwar period. Imperial education projects were an important feature of the cultural politics of a fading empire, but they were driven by actors in both the imperial centre and the self-governing dominions. This article argues that between 1910 and 1940 teachers and politicians in Canada drew on an international support network, actively fostered new ideas of citizenship, and strove to assert the country’s belonging in the British Empire.  相似文献

In the second half of nineteenth century, a small transnational British and foreign community grew up in the treaty ports scattered along China’s coast, a community literally caught between the great inner Asian empire of the Manchu Qing and British-dominated informal empire in Asia. Although scholars often contend that few major developments occurred in the foreign sector of the treaty port world until the very end of the nineteenth century, this article joins recent revisionist scholarship seeking to better understand the growth of this transnational treaty port community through a study of the Shanghai Municipal Council’s local post office in the context of informal empire prior to the rise of muscular Chinese nationalism in the early twentieth century.

As an institutional history of the virtually unknown local post office, this article is a study of the decades-long process by which the foreign settler community of Shanghai slowly built up the administrative capacity, trading networks and communications infrastructure of informal empire and semi-colonial order in the nineteenth-century treaty ports. The history of the local post office is largely unknown not because of its insignificance, but because we have not paid enough attention to the institutions that facilitated the emergence of transnational expatriate and settler communities throughout the world of British informal empire and the global and local influences that shaped them.  相似文献

This article will consider the reasons for the inclusion of cocaine in the Hague Opium Convention of 1912. This was the first time that the emerging international drugs regulatory system considered substances other than opiates and it was British delegates who took the initiative to include cocaine in discussions and in the final version of the agreement. Historians have tended to keep brief their accounts of this episode, seeing the British agenda on cocaine as driven primarily by their wider interests in opium, or alluding briefly to colonial anxieties about manufactured drugs. This article returns to the events of 1911–12 and argues that Britain's position on cocaine deserves greater attention. It shows that British administrations in Asia had tried to control a growing market there for the drug since the turn of the century, and that their efforts had failed. In exploring the history of these efforts, and their impacts in the early days of the international narcotics-control regime, the article suggests that imperial policies are more complex than many historians have previously acknowledged, and that it may be time for fresh thinking on the relationship between empires and drugs in modern Asia.  相似文献
