The Right to the City and Critical Reflections on China's Property Rights Activism

Wholesale clearance and eviction that typify China's urban development have often resulted in discontents among urban residents, giving rise to what critics refer to as property rights activism. This paper is an attempt to critically revisit the existing debates on the property rights activism in China. The paper refers to the perspective of the “right to the city” to examine whose rights count in China's urban development contexts and proposes a cross‐class alliance that engages both migrants and local citizens. The alliance itself will have substantial political implications, overcoming the limited level of rights awareness that mainly rests on distributional justice in China. The discussions are supported by an analysis of empirical data from the author's field research in Guangzhou, which examines how local and non‐local (migrant) residents view nail‐households resisting demolition and forced eviction.     

美国宪法改革与人权政策

美国人权政策是建立在古典政治哲学基础之上的,它过分强调人民的消极权利,而忽视了人民的积极权利。随着美国社会的发展,这种人权政策显得越来越不能适应时代的需要。因此,20世纪80年代以来,美国又掀起了宪法改革运动的高潮,以解决宪法中存在的人权概念不清楚和政治自由太多、人民的经济利益太少的问题。在修宪运动中,美国的最高法院发挥了重要的历史作用,使运动取得了一些阶段性成果。但由于种族偏见的根深蒂固,因此美国人权政策的发展依然面临着有待进一步克服的问题。

"自由亲王"是沙特阿拉伯现代化发展初期的第三种政治力量,是沙特阿拉伯经历从传统君主制到"发展的独裁模式"之历史性变革的重要推手。自由亲王运动根源于石油时代沙特阿拉伯经济社会秩序的变动,在沙特阿拉伯首次提出宪政民主等现代政治理念并尝试付诸实践,由此成为沙特阿拉伯宪政历程的源头,对沙特阿拉伯政治现代化的发展具有启蒙意义,预示着沙特阿拉伯政治现代化进程的发展方向。     

关于我国农用土地产权制度的分析

目前,我国对农村集体土地所有权与农村土地承包经营权的规定和理论界的观点在实际执行中存在内在矛盾,立法上存在缺陷,主要是财产权主体不明确、财产权属性质模糊,权能缺位,权能立法冲突等等。面对这种情况,要从我国现实农地产权制度的历史与现状出发,区别土地国有权与集体土地所有权的不同本质,强化农地承包经营使用权,并通化立法予以确立。     

Written Differently: A Survey of Commonwealth Constitutional History in the Age of Decolonisation

ABSTRACT

This article provides a survey and definition of the field of Commonwealth constitutional history since 1918, especially during and after global decolonisation. It asks what is Commonwealth constitutional history and how it differs from its English and Imperial counterparts. The article puts forward a working definition of Commonwealth constitutional history and introduces key and diverse writers who illustrate the range and potential of this history. The article provides an historiography and survey of constitutional history in the Pre-Commonwealth and Post-war Commonwealth periods while also assessing the opportunities of Post-British Commonwealth constitutional history. The objective of this article is to show how Commonwealth constitutional history can contribute to the historical study of state power and to see its worth to other disciplines and fields of history. Commonwealth constitutional history is a necessity to examine the politics, power and consequences of the British empire during the long age of decolonisation.

不当得利请求权是债权请求权的重要组成部分。然而,这种请求权在我国的司法实践中却极少应用。为充分发挥不当得利请求权的功能,需理清不当得利请求权与物权请求权、合同请求权、无因管理请求权、侵权损害赔偿请求权的竞合关系。     

何炳松的相对主义史学思想辨证

何炳松指出历史学与自然科学在研究方法、研究目的和研究对象上均有很大不同,由此得出历史学是一门主观推理的学问,历史学不必像自然科学那样寻求历史发展的因果规律,历史认识会随时代的变化而变化,体现了历史相对主义的思想特征。另一方面,他指出,历史学与自然科学都旨在求真,历史学为了求得历史真相,必须在充分搜集史料的基础上,对史料进行科学的考订和分析,然后用科学的方法进行编撰,这又是一种实证史学的方法论。因此,简单将他定位为中国现代相对主义史学家是片面的。
