This article presents an analysis of the political thought of Lord Hugh Cecil. It argues that in order to understand Cecil's thought it is necessary to emphasize the role of the constitution in his thinking. There are three reasons for this. First, his opposition to Chamberlain's tariff reform campaign was rooted in a view of the detrimental effects the policy would have on politics, evidence for which Cecil saw in the tactics used by the tariff reformers. Second, because his opposition to the Parliament Bill and to the home rule proposals, which lay behind the removal of the house of lords' veto, was similarly rooted in what he saw as the unconstitutional nature of these measures. Third, because Cecil was an active proponent of constitutional reforms that were designed to ensure that the second chamber could still exercise a restraining influence on government and so stand up for the interests of what he saw as the moderate majority of the people.  相似文献

During the French Revolution, Jean-Baptiste “Anacharsis” Cloots (1755–1794) developed a theory of the world state as the means to guarantee perpetual peace for mankind. Though his ideas have largely been misunderstood, Cloots's political writings were in fact an extensive plea for a more cosmopolitan understanding of the French Revolution. His system adapted institutions and concepts of the French revolutionary republic for a world state, the republic of mankind. This essay recovers his political vision and connects it both to the heritage of eighteenth-century political thought, especially Rousseau, and to revolutionary political culture. The goal is to retrieve the meaning of Cloots's universal republic, and with it a chapter in the history of cosmopolitan thought.  相似文献

On 3 December 1979, almost one year after Mohammad Reza Shah Pahlavi left Iran, the Constitution of the Islamic Republic of Iran replaced the monarchical constitution of 1906. The new constitution was to guarantee that the monarchy was abolished and the Islamic Republic system of government was enforced in its place. The constitution was to observe the Islamic and the nationalistic aims of the revolution with regard to the demands of a public that came from various social, religious, ethnic, and political backgrounds. Thus the 1979 constitution included differing components, which necessitated the amendments and the modifications that were added to the constitution in 1989. The constitution and its development are subjects that have been discussed in detail by scholars of modern Iran, among whom Asghar Schirazi stands out for his comprehensive study of the constitution. The following translation of the Constitution of the Islamic Republic of Iran highlights the relationship between the 1979 text of the constitution and the 1989 amendments in an attempt to contribute to the ongoing discussions on this subject.  相似文献

行省治理是罗马共和国后期政治生活的一个重要内容,直接关乎共和政治的运作与国家的命运。然而,在行省治理过程中,作为实际治理者的罗马官员滥用权力,通过多种途径大肆搜刮钱财,成为行省治理中的首要弊病。为遏制这种弊病,规范行省治理,罗马当局围绕着官员搜刮钱财现象,不断加强法律建设,呈现出立法条款细致化、诉讼程序固定化以及惩处严厉化的倾向。但是,行省治理制度中总督权力缺乏制衡,荣誉任职的传统观念以及税收体系的混乱等因素为罗马官员滥用权力、非法敛财提供了条件,而相关法律实践过程面临着距离、语言、时间与经济成本等实际障碍,且法庭充斥着腐败与偏见,导致治理局面未因法律建设的加强而得以有效改善。行省治理的失当从行省与共和国政治两个层面加速了共和政治的失序,推动了内战的爆发,进而加速了罗马共和国的衰亡。  相似文献

五权宪法思想是孙中山三民主义学说中民权主义的重要组成部分。它的产生是晚清国粹思潮与孙中山对西方政治制度深刻认识相结合的产物。其理论来源是西方资产阶级国家政体分权制衡原则和中国封建政治制度中某些合理性因素,孙中山在革命实践中将其逐步完善,最终形成比较完整的思想体系。孙中山始终不渝地实践着五权宪法,这种实践虽然在小范围内部分地取得了成效,但作为一种完整的整体构想却始终未获成功。孙中山五权宪法思想的提出及其实践是对西方资产阶级三权分立政治思想的重要发展。是中国政治变革史上的一件大事,推动了近代中国民主政治的发展。  相似文献

1946年《中华民国宪法》是在政治协商会议已经召开、并通过了宪草修改十二条原则的背景下由非国民党人士起草的,因此,与此前国民党一党制定的“五五宪草”比较,存在着一些重大区别。这些重大区别表明:与“五五宪草”不同,1946年《中华民国宪法》多多少少带有一些民主性质或色彩。这些民主性质和色彩是中共、民盟以及全国人民和国民党斗争的结果。  相似文献
