The aim of this article is to analyse the complex roots of Carl Schmitt's theory on dictatorship in the classical world through the lens of classical receptions. It argues that Schmitt was deeply engaged with the classical tradition in formulating his theory on dictatorship. Knowingly or unknowingly, Schmitt legitimates his theory through a foundation in both the Roman idealisation of the virtuous dictators of the early Republic as well as the long tradition of the narrative of the enlightened sovereign as a guarantor of law, present in both Greek and Roman antiquity and in the subsequent European tradition. Schmitt skilfully repurposed the Roman historical tradition on dictators but glossed over the traditional antipathy of Roman republicanism towards sovereign rule. The claim that this article is presenting is that even though it has been overlooked by earlier scholars, Schmitt was both directly and indirectly influenced by the classical tradition of dictatorship and utilised their mythical and symbolic dimensions in the later Roman and the subsequent European legal and political traditions. The reason for this omission was that Schmitt, like his contemporaries, belonged to one of the last generations to be groomed in the classical tradition of literature.  相似文献

ABSTRACT

When the inventor of phrenology, Franz Joseph Gall, came to Denmark in the fall of 1805, he was met with great enthusiasm and fascination among the general public, as well as within the scientific community. His visit was an event that was covered by the newspapers unlike any other scientific lecture. However, as soon as Gall left, public interest in phrenology almost instantaneously vanished. Different theories have been put forth in the attempt to answer the question as to why phrenology never found a audience in Denmark. The Danish phrenologist Carl Otto explained it by referring to the poor quality of the Danish phrenological publications. Danish historians have argued that phrenology was too incompatible with the dominant scientific paradigm, Natürphilosophie. This article argues that the newspaper coverage of phrenology was more about sensational news stories than about science, and ultimately phrenology was a fad that wore off when the newspapers shifted their focus to other news.  相似文献

This article considers the growth of Ottonian hegemony through a close examination of Flodoard's Historia Remensis ecclesiae. Specifically, it scrutinises Flodoard's laconic account of a property dispute between the church of Rheims and Conrad the Red, Otto the Great's powerful duke of Lotharingia. Reading Flodoard's testimony alongside diplomatic evidence and Ottonian narratives, this study argues that the controversy was a factor in Conrad's rebellion against Otto in 953. Both the central role of Rheims' property in an Ottonian political conflict and Flodoard's silence on numerous aspects of the affair reveal that the church was deeply enmeshed in Ottonian politics. The Historia therefore offers an unrecognised angle on the expansion of Ottonian power, while further investigation of its content suggests that this emergent hegemony may indeed have been welcomed by Flodoard and his superiors at Rheims.  相似文献

This essay discusses Hans Aarsleff's long battle to demonstrate the importance of the French and British thinkers of the mid-eighteenth century to the development of modern linguistic thought. Contesting claims that German scholars were the first to develop historicised theories of language, Aarsleff, along with his Princeton colleagues Lionel Gossman and Anthony Grafton, helped pioneer longue durée studies of the history of philology and of historiography that cross national boundaries as well as the so-called Sattelzeit (stretching from about 1780 until 1820). Although the importance of his work was, for a long time, little appreciated by modern intellectual historians, this essay argues that it is time that we fully learned Aarsleff's lessons.  相似文献

This article analyzes the compound of the categories of secularization and reoccupation in its variations from Hans Blumenberg's philosophy to Carl Schmitt's political theory and, ultimately, to Reinhart Koselleck's conceptual history. By revisiting the debate between Blumenberg and Schmitt on secularization and political theology with regard to the political‐theoretical aspects of secularization and the methodological aspects of reoccupation, I will provide conceptual tools that illuminate the partly tension‐ridden elements at play in Koselleck's theorizing of modernity, history, and concepts. For Schmitt, secularization is inherently related to the question of political conflict, and, correspondingly, he attempts to discredit Blumenberg's criticism of secularization as an indirectly aggressive, and thereby hypocritical, attempt to escape the political. To this end, I argue, Schmitt appropriates Blumenberg's concept of “reoccupation” and uses it alternately in the three distinct senses of “absorption,”“reappropriation,” and “revaluation.” Schmitt's famous thesis of political concepts as secularized theological concepts contains an unmistakable methodological element and a research program. The analysis therefore shows the relevance of the Blumenberg/Schmitt debate for the mostly tacit dialogue between Blumenberg and Koselleck. I scrutinize Koselleck's understanding of secularization from his early Schmittian and Löwithian theory of modernity to his later essays on temporalization of history and concepts. Despite Blumenberg's criticism, Koselleck holds onto the category of secularization throughout, but gradually relativizes it into a research hypothesis among others. Simultaneously, Koselleck formalizes, alongside other elements, the Schmittian account of reoccupation into his method of conceptual analysis and uses the term in the same three senses—thus making “reoccupation” conceptually compatible with “secularization,” despite the former notion's initial critical function in Blumenberg's theory. The examination highlights a Schmittian residue that accounts for Koselleck's reserved attitude toward Blumenberg's metaphorology, regardless of a significant methodological overlap.  相似文献

This article pays special attention to the large number of references to political theology by Hans Kelsen and Carl Schmitt, particularly in the interwar period, and seeks to interpret these references in a new way. While Schmitt's analogies between God and state are to be expected considering his strong Catholic roots, such comparisons are much more surprising for a positivist like Hans Kelsen, who always tried to relieve state and law from transcendental elements. The article concludes that, far from being marginal in the doctrinal dispute between Schmitt and Kelsen, references to political theology express and summarize their major controversy about the relation between state and law, as well as about the sources of the state's unity. The heart of the disputatio between the two jurists concerned the ability of the political power to emancipate itself from the juridical order. The ‘legal miracle’—in this context meaning the occasional autonomization of the state from law—was for Schmitt the manifestation of sovereign power. However, for Kelsen it represented the negation of the state's essence, whose actions must be determined only by the legal order.  相似文献

ABSTRACT

This article is based on the text of a talk at the University of Athens in October 2018, in which I drew brief cameo portraits of five historians who inspired me and whose lives I admire: David Herlihy (1930–1991), Michael Baxandall (1933–2008), Marino Berengo (1928–2000), Hans Baron (1901–1988), and Marvin Becker (1922–2004). It is difficult to find strong common methodological or ideological ground shared by all five. Their priorities were different, their guiding lights in each case came from an internal dialogue between their own passions and the inspiration they received from teachers and readings, not by the methodological preferences that dominated the profession in their lives. What, in the end, left a deep imprint on me was their character. Their commitment was to ideas and to dialogue. National, religious, ideological, or methodological differences did not cloud their judgment of others, especially of young scholars. All five, growing up in the Fascist era, were portents of the more level tones of the liberal democracy that slowly, amid myriad obstacles, set root in the decades following 1945.  相似文献

Quoting a text on Tocqueville written by Carl Schmitt in 1946, Reinhart Koselleck hypothesized about the epistemological advantage of being vanquished in writing history. This essay analyzes Schmitt's intellectual and political positions in reaction to three successive defeats: the collapse of the German Empire in 1918; the end of the Weimar Republic in 1933; and the overthrow of the Third Reich in 1945. Schmitt was a German nationalist and, at least until Hitler's rise to power, an anti‐Nazi conservative, but he easily adapted to both the Weimar Republic in 1919 and National Socialism in 1933, two political turns that coincided with significant improvements in his academic career. He felt vanquished only in 1945, after his double imprisonment, the Nuremberg trial, and finally his retirement to Plettenberg. 1945 was a watershed that he symbolized through two metaphorical figures: the reactionary thinker of Spanish Absolutism Juan Donoso Cortés and Melville's literary character Benito Cereno. Thus, the case of Carl Schmitt does not confirm Koselleck's hypothesis, insofar as the most productive and creative part of his intellectual life does not fit into an awareness of being vanquished. Koselleck's statement deals with the gaze of the ruled, whereas Schmitt belonged to a different tradition of political thinkers interested in building domination and smashing revolution (Hobbes, Maistre, Donoso Cortés). He was a thinker of action, not of mourning. Defeat did not inspire, but rather paralyzed his thought.  相似文献

The remarkable career of the nobel laureate Adolf Butenandt in Germany before 1945 and especially after the second world war is well known. But in recent years several publications have questioned his personal behaviour in the Third Reich. But all these articles interpreted Butenandts career and his attitude from our knowledge today about Nazi Germany. From archival sources this article will view on the situation in the 1930s and will show that Butenandt was originally not the first choice of the government for the position of director at the Kaiser‐Wilhelm‐Institute for Biochemistry. Finally it is shown, that Butenandt did knew what was going on behind the scenes, because through his close connections with officers of the Rockefeller Foundation he got several information on the selection.  相似文献
