The Resource Conservation and Recovery Act of 1976 (RCRA) assigns the Environmental Protection Agency responsibility for protecting the public from hazards created by industrial wastes. The Agency has understandably used its mandate to construct cradle to grave regulation of waste substances that pose health hazards. The regulations, however, are likely to hike costs of legal disposal by increasing the demand for disposal sites, while at the same time reducing the supply. The higher cost of disposal may give an advantage to larger, existing firms, may deter entry of new firms to both waste generating and disposal industries, and promote illicit disposal. RCRA therefore may have the paradoxical result of increasing public exposure to hazardous wastes.  相似文献

随着女性旅游市场的发展,女性旅游者安全问题日益明显。但目前针对这方面的研究还很有限,从世界范围看,世界各国和地区的女性旅游研究普遍存在着理论创新落后于现实发展的状况,女性旅游安全研究更是如此;从国内看,我国关于女性旅游安全研究几近空白,然而相关媒体对女性旅游安全事故的报道却屡见报端;从国外研究现状看,目前针对女性旅游安全研究的文章主要集中在旅游安全感知、风险认知、女性性旅游中的不安全行为、孕妇旅游安全的保障和风险等角度。因此,总体来讲,国内外学者对女性旅游安全研究尚处于初级阶段,研究深度和广度有待扩展和加强。
本文在搜集国内外相关资料的基础上,对近20多年来的研究成果进行了梳理、归类和总结,从女性旅游者的心理不安全感、不安全旅游行为、安全事故、安全预防四个方面对相关文献进行了分析、研究和评述,并针对目前的研究现状对女性旅游安全研究的趋势和必要性进行了预测和分析,旨在进一步丰富旅游安全的理论内容,并为女性旅游安全问题的后续研究提供建议和参考。  相似文献

Inspired by some important inter-disciplinary work in both legal studies and human geography, I explore the vision of geography - with special reference to the theorization of mobility - that appears to be expressed within mainstream legal discourse. I argue that the legal account is premised on the privileging of certain components of liberal thought, including the individual, the private sphere, and concepts of frictionless spatial mobility. I try to demonstrate that this vision is partial and selective and ignores an alternative and insistent account of the geography of social life that appears prevalent within civil society. Evidenced by the reactions of many small towns to threats of economic dislocation, the emphasis here appears to be one that elevates concepts of place and the community. Drawing upon recent higher court decisions in British Columbia concerning the meaning of section 6 (mobility rights) of the Canadian Charter of Rights and Freedoms, I argue, firstly, that the legal vision is ultimately indeterminate and contingent but, secondly, that its hegemony has certain implications for social life, social justice, and the city.  相似文献

The regulation of scientific and archaeological diving is complex but it is essential that underwater archaeologists are familiar with the requirements placed on them by legal systems. This paper outlines the history and development of current legal systems in four jurisdictions: the UK, USA, EU and Australia. This historical and legal approach informs key discussions facing maritime archaeologists; reference is made to training requirements, safety records and the question of who should be allowed to participate and who should be excluded from archaeological diving.  相似文献

研究法的价值取向有助于不断完善法律制度和法律体系,发挥、释放法的实践理性功能。我国《旅游法》按照市场经济和法治政府的要求,整合了旅游产业各要素和旅游活动全链条,构建了涵盖促进法、行政法和民事法三方面不同性质的法律规范。本文在梳理国内外旅游法价值取向研究的基础上,对日本旅游立法情况进行分析,并从比较视角对中日旅游法的价值取向进行探究,以期结合国外旅游立法成功的经验,探索我国《旅游法》实施中国际旅游规则、国外旅游立法与中国特色社会主义市场经济和法制建设的有机结合。最后基于一定的时代背景和语境提出中国旅游法的价值取向主要表现在秩序建立,权利维护,促进发展等方面。  相似文献

以原国家旅游局“旅行社责任保险统保示范项目”中的11115条出境旅游出险案例为研究对象,运用数理统计和空间计量方法,对中国出境旅游安全事故时空分布格局及形成机制进行分析。研究表明:①出境旅游安全事故总体区域分布呈现出异质性和高度凝聚的分布态势。②各类型旅游安全事故具有集中性、差异性的频次分布特征和空间集聚特征。③各大洲旅游安全事故呈现出逐年扩张的发展态势,事故高发核心区聚集性不断增强,不同区域的旅游安全事故呈现出差异化的年际变化特征,各州事故季节波动也存在异质性,但均出现下降趋势。④旅游安全事故时空分布格局形成受客源地主体因素和目的地客体因素的共同影响,不同探测因子的影响力度呈现差异化特征。  相似文献

馆藏文物预防性保护工作在我国经过了二十余年的系统性研究和应用实践,已经取得了重大进步。近年来,上海博物馆在预防性保护工作中引入风险管理理念,通过明确环境信息、风险评估、风险应对和监督检查的流程,降低文物风险,保障文物安全。本文以上海博物馆的两个临时展览为例,从环境信息统计分析、湿度阈值设定与调控策略选择、材料环境安全性评估、展柜密封性能要求等方面阐述了馆藏文物预防性保护风险管理工作的应用实践和研究思考。  相似文献

将城市扩展数量管控、土地差别化管控及土地利用分区管控等多个政策方案,嵌入元胞自动机的转换规则中,进行耦合管控效应的城市空间多情景模拟与政策分析。研究结果表明:①在城市扩展过程中,伴随着生态用地面积锐减、建设用地利用效率低下及土地利用结构不合理等风险,政策管控有利于缓解上述问题;②土地政策不能扭转景观破碎化及复杂化加剧的现象,但可以抑制其趋势;③多政策同时使用可以在保护优势斑块方面产生协同效应,其效果优于单独使用三种政策,但在遏制景观破碎化和复杂化方面不能发挥单一政策所具有的最大生态效应;④土地政策的优先级为:数量管控-> 分区管控-> 差别化管控。  相似文献

Public opinion features prominently in policy research because it sets bounds on the definition of policy problems and acceptable policy solutions. We contend that public opinion is also important for setting bounds on the level of government at which policy hazards are regulated by shaping preferences for uniformity of regulation and, relatedly, preferences for centralization. We offer a theoretical argument for why risk creates pressures for uniform standards and examine the extent to which preferences for uniformity and centralization are the product of fairly stable individual-level predispositions (e.g. partisanship and ideology) versus more fluid attitudes like perceptions of risk, which vary in response to crises, new information, and issue framing. We test our argument using survey data in the policy domain of food safety and find that individuals who anticipate greater risk from food-borne illness prefer more uniform food safety regulation, which translates into preferences for federal-level policymaking. Our results imply that contextual circumstances and strategic communications that influence risk perceptions can create not only generalized public demand for more regulatory policy but specific demand for uniform, centralized regulation.  相似文献

ABSTRACT Using New Immigrant Survey data, we identify immigrants who were unauthorized to work prior to obtaining Legal Permanent Resident status, and examine whether lacking legal status to work in the United States constrains employment outcomes of illegal immigrants. The data reveal no evidence of improved employment outcomes attributable to legal status, except among the high‐skilled. In light of evidence that unauthorized immigrants experienced increased wages as a result of receiving amnesty through the 1986 Immigration and Reform Control Act, we interpret the results as consistent with a reduced threat of employer sanctions combined with widespread availability of false work authorization documents.  相似文献

The jurist A. V. Dicey’s study of the Law of the Constitution (1885) has been since its publication the dominant analysis of the British constitution and the source of orthodoxy on such subjects as parliamentary sovereignty and the rule of law. This canonical status has obscured the originality of Dicey’s ideas in the history of legal and political thought. Dicey reworked the traditional idea of sovereignty into two separate concepts – legal and political sovereignty – in order to square the common law notion of the sovereignty of parliament with the democratic idea of the sovereignty of the people. He forged a new concept – ‘the rule of law’ – to explain the legal basis of liberty in common law countries in a manner that was both Benthamite and constitutionalist. Finally, he provided a democratic and anti-federalist rationale for maintaining the Union of Great Britain and Ireland. This majoritarian, centralist and utilitarian constitutionalism has been one of the most enduring products of Victorian scholarship. This article seeks to recover it in its original context and, in so doing, to show the value of reintegrating legal thought into the mainstream of modern British history and the history of political thought.  相似文献

社会经济活动的空间重构与交通设施配置息息相关,可达性成为优化城市空间结构,调控城市空间开发的重要手段。在以矢栅一体化的综合可达性测度并构建城市增长模型的基础上,对北京城市增长进行了成功模拟,透视了基于综合可达性导向发展模式的基本特征与主要问题,并提出了基于综合可达性的城市增长调控模式优化方案。研究发现:①城市增长密集发生在建成区周围可达性优越的区域,随着与城市中心的距离增加,城市增长的概率降低,反映了北京单中心的城市发展模式;②受城市规划与交通设施规划失调影响,可达性提升程度越大的区域并不一定带来更高的城市增长开发概率,严重削弱了可达性对城市增长的引导作用;③基于综合可达性的城市增长调控模式的优化方案,要以交通设施规划为基础,并合理耦合空间规划,才能更为有效地引导城市空间良性增长并预防规划失效。基于综合可达性的城市增长模型建立与调控模式优化方案的提出,对于确立与提升交通引导城市增长的基础性地位,优化城市空间结构具有重要的理论和现实意义。  相似文献

Abstract

This article explores China’s attitudes towards the regulation of key natural resources by international law, domestically and at the trans-boundary and international levels. It considers the impact of international law on China’s own practices, and the contribution of China towards shaping international law. The article suggests that popular conceptions of a relatively isolated, sovereign absolutist China do not accord with contemporary legal realities, including in its dealings with natural resources. While China’s construction of strong sovereignty shapes its attitudes towards legal regulation, practice also suggests that China adopts a nuanced approach which includes legal compromise, and a commitment to multilateral regulation or bilateral diplomatic settlement of issues previously within the competence of national governments. China is often an active and constructive participant in contemporary law-making, even if – like all countries – it also seeks to instrumentally use international law.  相似文献

近年来,关于如何建立有效的保护非物质文化遗产知识产权法律机制,建构相应的规则体系和理念基石,成为国内外学术界、实务界讨论的热门话题。本文在对国内外非物质文化遗产知识产权保护研究成果梳理的基础上,通过分析日本、韩国、法国、意大利等国家非物质文化遗产知识产权法律保护以及我国关于知识产权保护的立法实践,从研究非物质文化遗产概念、性质,国内非物质文化遗产保护现状入手,对非物质文化遗产知识产权保护的正当性,非物质文化遗产知识产权的权利主体、保护客体以及非物质文化遗产知识产权保护模式等方面进行归纳与总结,进而提出在非物质文化遗产可以采用或借鉴知识产权保护模式进行保护的前提下,将非物质文化遗产划入现行知识产权法的保护范围,在现有法律框架基础上确立社区或族群作为知识产权主体的权利,以及采取"适度原则",在现行知识产权框架内创设一种"传统资源权"等观点。  相似文献
