This article investigates the legal provision for two adult, unmarried women to create a “perpetual society” with one another found in the customary code of 1725 for the French province of Brittany. This arrangement allowed women who shared a household to designate one another as primary heir and to protect their community property from the claims of others. Evidence of this arrangement demonstrates that single women in some places had options outside of marriage and the convent. The contracts filed by the women also reveal the extent to which this arrangement went beyond considerations of property to express both affection and loyalty. Available to siblings as well as to pairs of unrelated women, this union is likely not the equivalent of same-sex marriage. It does however broaden our knowledge of the meaning of marriage, partnership, and kin in early modern Europe.  相似文献

In the Lio region of Flores Island patrilineal groups coexist with taboos on animals and plants inherited through females, a combination previously interpreted as reflecting a system of double unilineal descent. Drawing on ethnography from the Lio district of Mego, maternal taboos are shown to accompany similar prohibitions conceived as a property of patriclans, most of which, however, are incumbent not on male clansmen but on their wives. As is further demonstrated, both sorts of taboo reflect ideas about female bodies and blood, particularly as women and their children are transformed through marriage into members of patrilineal groups dominated by men. Also discussed is whether variability in the way taboos are currently inherited in Mego may reflect recent social change, and how matrilineally inherited Lio prohibitions can be seen as an instance of complementary female and male principles equally operative in the social life of other eastern Indonesian societies.  相似文献

Micro‐finance programmes are currently dominated by the ‘financial self‐sustainability paradigm’ where women’s participation in groups is promoted as a key means of increasing financial sustainability while at the same time assumed to automatically empower them. This article examines the experience of seven micro‐finance programmes in Cameroon. The evidence indicates that micro‐finance programmes which build social capital can indeed make a significant contribution to women’s empowerment. However, serious questions need to be asked about what sorts of norms, networks and associations are to be promoted, in whose interests, and how they can best contribute to empowerment, particularly for the poorest women. Where the complexities of power relations and inequality are ignored, reliance on social capital as a mechanism for reducing programme costs may undermine programme aims not only of empowerment but also of financial sustainability and poverty targeting.  相似文献

This article analyses sources relating to the 1768 Northampton borough election to determine the ways in which women were involved in pre‐reform elections. Although there has been literature relating to the participation of women in pre‐reform elections, it has largely focused on elite women. Through a case study of the 1768 election this article will suggest that non‐elite women were involved in a variety of ways. In particular, it will show that these women acted as witnesses during the polling and provided evidence relating to men and their eligibility to vote, and suggest that female householders had an impact upon the election through their property ownership. Through their role as householders, women were able to participate in elections through the exchange of property and enabling men to vote. The activities in which Northampton women were involved had further implications concerning home and its use as a public space.  相似文献

Civil law rules were adopted in Florida that granted married women property rights long before legal reforms occurred in northern states. This article analyzes white wives' property and law in Florida between 1820 and 1860. Initially, married women's property rights were inadvertently protected by treaty law and limited to women who married before 1818. Wives' right to own separate property in Florida was subsequently reconfirmed in statute and extended to include later marriages. In contrast, nonwhites generally lost the rights and property they had enjoyed under Spain's civil law in the same period. This contrast reveals that in Florida (and other southern borderlands) it was not concern for women, or simply legal precedent, but the desire to incorporate new territory and expand slavery that influenced the development of marital property law. This challenges previous histories, which have excluded the earlier acts in the Southern borderlands and emphasized those passed in the Northeast beginning in the late 1840s. While those later acts were influenced by the early woman's rights movement and by concern for families reduced to poverty during the rise of market capitalism, this case study indicates that expansion of United States territory and slavery were responsible for the earlier married women's property rights in southern borderland territories such as Florida.  相似文献

Over the past twenty years, patriarchy has become a vitally important analytical concept for historians of women, gender and masculinity. By contrast, misogyny has been under‐explored, despite being an equally prevalent historical phenomenon. This article offers a cultural history of seventeenth‐century masculinity based on an analysis of the humorous jokes and stories found in jest‐books, a genre that appealed in particular to male adolescents and young men in their twenties. It argues that patriarchy and misogyny should be treated as separate analytical concepts and cultural phenomena that appealed to different sorts of men. While patriarchy offered a code of manly behaviour for middling‐sort married males to aspire to, misogynistic humour appealed predominantly to youthful single males, who were as antagonistic towards patriarchs as they were towards women. In articulating such an argument, this article engages with debates about manhood, misogyny and the reception and creation of everyday culture in early modern society.  相似文献

Who gets what, why and how, when Chinese villagers' land is enclosed? Focusing specifically on changes in women's property rights and drawing on data from Zhejiang province, this article shows that state, village and household institutions interact to produce significant gender disparities in both the compensation paid to expropriated villagers and the registration of ownership of household assets. Yet it would be incorrect to conclude that, dispossessed, women thereby lack agency. Analysis of women's responses to expropriation suggests that by selectively deploying laws, rules and norms in different settings, women are influencing not only compensation distribution, but also the terms under which the state compensates villagers for their expropriation and the gender relations in which property is embedded.  相似文献

This article seeks to contribute to the literature on the meanings of domestic spaces by furthering understandings of the sorts of roles that space plays in shaping women's leisure experiences. The study researched a group of 15 women who live in disadvantaged areas of Dublin city and care for dependent children. Focus groups and structured conversations revealed the poverty of the spatial capital available to these women, depicting local environments as difficult and stressful, and to be endured rather than enjoyed. They further revealed the extent to which the women's lives were shaped by their obligations as care-givers. Within the home itself, private domestic spaces were found to be deeply embedded with powerful ideologies of motherhood that did not necessarily evaporate in the simple absence of obligations imposed by children. Instead, they tended to serve as constant reminders of how things ‘should be’, consequently constraining some women's abilities to divest themselves of care-giving duties and engage in self-focused recreation. Some of the women studied were able to move beyond obligation, and for them leisure represented modest yet significant opportunities to self-determinedly relax, reclaim and even luxuriate in certain spaces within their homes. Similarly, once relieved of child-caring responsibilities, leisure encounters within the local environment afforded some women new insights into familiar spaces.  相似文献

However private they may seem, emotions depend for their meanings on the communities in which they are expressed. But if emotions are shaped by and for their communities, how can we account for emotional change? After briefly surveying how historians have (1) defined the communities in which emotions have been expressed and (2) explained how and why emotions have changed, this article turns to the community of the Waorani of Amazonian Ecuador. It explores whether anthropological explanations of emotional change in that “test case” may help the historian. The answer is not entirely positive. The article concludes with some thoughts about what sorts of collaborations between historians and anthropologists might be more productive for emotions studies.  相似文献

White middle-class American women were heavily involved in lobbying for and implementing Indian reform legislation during the late nineteenth century. The General Allotment Act mandated the break-up of reservations and imposed upon Native peoples the twinned institutions of private property and male-headed families in the hopes that they would assimilate to American 'civilisation'. White women thus appeared to be imposing their own gender norms on others as they sought to inculcate the characteristics Native people would need for American citizenship. They negotiated this paradox of imposing classed, gendered and racialised hierarchies in the name of equality through spatially articulating hierarchies of race, class and gender. Rather than appeal to the conventional liberal dichotomy of public and private, the author reads these activists as authorising their political activity through the dualism of civilised and savage. The latter spaces produced oppression, which was understood as the inability to participate in politics as much as exclusion from participation in politics. It was the maternal duty of white middle-class women to civilise people, thus delivering them from oppression, through transforming the spaces in which they lived.  相似文献

This article traces the strategies that women deployed, and the resources upon which they drew, in order to challenge the East India Company (EIC) and ultimately lay claim to property that they believed was rightfully theirs. It focuses on three women, Elizabeth Dale, Rebecka Duteil and Mary Goodal, who navigated the EIC, parliament and the courts in seventeenth-century London to try to secure their inheritance from husbands and siblings. It offers a fresh perspective on early modern women's public lives by focusing on a wide array of agentic strategies that women employed in their encounters with various institutions. Using a range of sources, including company records, petitions, court depositions and wills, it argues that exploring women's interactions with the EIC, especially in their role as adversaries, enriches understandings of women's agency in early modern England. This article suggests that such a lens can further nuance how we understand the inherent tensions of early modern women's public lives: as inflected by global as well as local contexts and shaped by conflict as well as collaboration.  相似文献

Women’s history for Árpád-era Hungary (1000–1301) has generally been restricted to legal issues and the royal court. This study addresses these deficiencies by examining women in the Register of Várad in regard to three areas of investigation: marriage practices and the involvement of the Church, access women had to property and the access women had to authority. Evidence from the register indicates that by the thirteenth century, ecclesiastical ideas regarding marriage were barely making themselves felt. Ideas of consent and even the indissolubility of marriage were at times unimportant. Though priests were occasionally present at marriages, their role was not decisive. Women had three primary means of obtaining property. They could receive gifts or dower on the event of their wedding, and they could receive a portion of the patrimony. This inheritance was termed the quarta filialis as it amounted to no more than one-quarter of the father’s property. These gifts came under the control of the woman’s husband, and she could not access them until his death. Widowhood combined with guardianship of a minor son could allow women to exert considerable power and, just as elsewhere in Latin Europe, women’s access to public and private authority most approximated that of men’s as a widow. Not all women, of course, had access to such power. The Register of Várad shows numerous instances of women slaves who were under the complete control of their master.  相似文献

This article suggests that marriageable young upper-class women can be taken as indicators of the longue durée of the ancien régime mentality and the stepwise advancement of the bourgeois mentality. This is so because of factors that made such women particularly prone not to break with established conventions. Source materials in this analysis are taken from contemporary non-fiction texts in which 19th-century St Petersburg and Helsinki serve as the scenes and in which marriageable young women feature as the protagonists or objects of appraising gazes. It is suggested that the differences emerging around the mid-19th century between the two societies with regards to the habitus and education of upper-class girls and marriageable women can at least in part be explained by different institutional settings vis-à-vis land, labour and the status of the bourgeoisie.  相似文献

At West Nggela, access to high value marine invertebrate stocks is controlled by consanguineal corporate groups holding primary rights (which include rights of exclusion) over reefs bearing these stocks. Disputes over primary rights appear to result in a breakdown in management practices, resulting in overfishing and severe depletion of stocks. An understanding of the common causes of disputes is therefore of considerable importance to marine resource management, and development, in this region. This paper outlines first the essential, or ‘ideal’, processes of descent reckoning and property transfer that underpin the Customary Marine Tenure (CMT) system at West Nggela as they are presented to ‘outsiders’ such as government officials and anthropologists. It then deals with some of the many exceptions to this norm, and the ways these variations can contribute to disputes over primary rights to property. The pressures of economic development, and the resultant commodification of resources and property, in our view catalyse the conflict between the ideal, simplified model and the complexity of actual praxis in respect to property rights. Recent dramatic increases in the perceived value of many properties as a result of proposed lucrative developments may underlie present day conflicts which in the past would not have arisen. Examples are drawn from interview data as well as case studies of two formal property disputes which were heard in local courts at West Nggela in 1995.  相似文献

Couchsurfing is a social-networking site for hospitality exchange. To promote the site, the organizer, Couchsurfing.org, creates the discourse of Couchsurfing cosmopolitanism to emphasize the value of sharing with strangers and tolerance of cultural difference in Couchsurfing practice. This study argues that the discourse production is under a patriarchal system, in which the experience about women’s fear of men’s harassment and according practice are concealed. By conceptualizing the sexed-and-gendered body in Couchsurfing, this study exposes the power, knowledge and social relation in the cross-cultural context of Couchsurfing, represented not only in women’s feeling, performance and interaction but also in their embodied cosmopolitanism. The comparison between with Western-European and East-Asian women’s experience is also included in the analysis. It highlights the effects of the gender role inscribed on women’s body which makes a difference in women’s cross-cultural interaction as well as their embodied cosmopolitanism.  相似文献

The first group of Australian women missionaries arrived in Korea in 1891, representing the Presbyterian Women’s Missionary Union of Victoria. Their pioneering work was soon hindered by tensions that arose between themselves and a male cleric authority in the field. The article investigates this dispute, which lasted for several years and eventually entangled not only the individual Australian missionaries but also their home organisations as well as North American missionaries. It argues that Australian women missionaries’ involvement in this public dispute is a rare but significant example of a paradox in the foreign missionary enterprise, which imposed patriarchal order and at the same time established conditions that helped women enter the public space and even challenge the male-centred gender order. The article goes on to identify some distinctive characteristics of the Australian women’s missionary work.  相似文献

This paper aims at understanding why Rousseau excluded women from citizenship. Citizenship, for Rousseau, is not a matter of right, not even a matter of behaviour (of how to behave individually to be a good citizen). It is a matter of social condition. How should society be constituted so that there can be citizens? The answer to this question is that there must be women in the private sphere so that there can be citizen in the public sphere. The paper begins with Montesquieu's model of the republican condition of women, considers the way Rousseau updated this model, and concludes with the idea, that much more than the male figure of citizenship (which remains a stereotype), the woman, in Rousseau, is the true figure of modernity.  相似文献
