The Paraguayan parliamentary coup against Fernando Lugo in 2012 fired the opening shot (following the CIA-induced removal of Honduras’s Manuel Zelaya in 2009) in the series of reversals of ‘pink tide’ politics throughout much of Latin America, most notably Brazil. But the Paraguayan case, argues art critic and former Minister of Culture Ticio Escobar, also has several particularities, such as the incapacity of Left and Right alike to construct enduring hegemonies after the collapse of the Stroessner dictatorship in 1989, as well as the increasingly potent shadow cast over the national political landscape by narco-capital. The still-unresolved massacre of peasant protesters at Curuguaty, which sparked Lugo’s overthrow only a week later, functions as an almost Brechtian theatricalization of these force-fields that have dominated Paraguay ever since the Triple Alliance War (1865–1870).  相似文献

The law and constitution of the family has been targeted for transformation in recent years, leading most notably to the Supreme Court's decision in Obergefell v. Hodges, mandating same-sex marriage as a matter of constitutional law. In this essay I undertake a thought experiment, asking how advocates of traditional marriage ought to want the law of marriage to change in light of this development. I begin by reviewing the argument for legal change sketched by Aquinas and then applying it to developments concerning marriage in modern America. Next I sketch the natural-law argument on behalf of traditional marriage. Finally, I turn to the case of Michael H. v. Gerald D., in which the Supreme Court upheld a statutory reiteration of the common-law presumption that the husband of the mother is the father of her child, against a challenge from the biological father, suggesting that this case, long admired by conservatives, needs to be reconsidered—and that the dissent in the recent Indian Adoption Case recognizing a constitutional right of biological parents might prove useful to the restoration of marriage law.  相似文献

The Neiden Case reburial from Finnmark, North Norway, marks the closure of a process initiated with a controversial excavation in 1915 when 94 skeletons were brought to University in Oslo. The skeletons formed part of a monumental work in physical anthropology by the Norwegian anatomist Karl Emil Schreiner concluding that the Sámi belonged to a somewhat infantile proto-Mongolian race. There is little doubt about unethical aspects of the excavation as well as the exceedingly dubious character of racial research on the Sámi prior to the Second World War. However, considering the handling of the case, opposing facts and opinions, lack of knowledge and other uncertainties, ethical implications seem far from obvious. With regard to the dead themselves the reburial may even be considered unethical. This paper emphasizes the complexity of the ethics of reburials with particular attention to the dead, their graves and belongings.  相似文献

This article reports results of a follow-up study to my book Keeping a Watchful Eye (1990), updating it with data from the 1990s. It examines whether congressional oversight has increased or decreased relative to earlier periods, how the variables that predicted oversight behavior in the period from 1961 to 1983 worked in later years, why changes have occurred, and what they mean. It also examines whether there was something distinctive about oversight in the 1990s when Republicans dominated both chambers. Results indicate that the amount of primary-purpose oversight continues to be quite high and that the model developed in the book to explain committee oversight behavior remains remarkably effective. What has changed is a large drop in legislative hearings and meetings (where oversight behavior often occurs), something that the data show actually predates the Republican 104th Congress. However, the Republican takeover did lead to a more oppositional oversight context–to more oversight hostile to the basic goals of programs and agencies.  相似文献

Herrera reflects on the committee’s deliberations in how to approach developing a framework for ethics in tune with the aims and ethos of WAC. He points out the importance of a foundation of meaningful principles, embedded in the thread of the actions of individuals acting in specific cultural and historical social contexts and based on core values that at the same time acknowledge the contradictions inherent in diverse standpoints. Causal process tracing (CPT) has emerged as an important method of causal inference in qualitative social science research, most notably in case study research designs. There is now a considerable literature on the aims, philosophical groundings, and methods of process tracing. This paper reviews the CPT literature to assess what new directions it may suggest for policy studies. The first part of the paper sets out the methodological advantages CPT offers in building and testing theories of policy change, most notably in supporting a theoretical pluralism to address the problem of complexity in policy studies. Building on recent scholarship across the social sciences, the second part examines step by step the recently minted “best practice” for undertaking CPT in policy studies. This part includes discussion of the possible pitfalls of CPT as a method; common errors involved in its use are set out and minimization strategies offered. In particular, while acknowledging the usefulness of Bayesian tests for causality as heuristic devices, we emphasize the limitations of applying such tests in practice. Possible correctives are suggested. The final part of the paper speculates more generally on the potential of CPT to improve our investigation of patterns of policy change over time.  相似文献

Both the European Union and NATO are now committed in principle to substantial enlargement. It remains doubtful, however, how far member governments are making a success of further enlargement, let alone thinking through its strategic implications. Yet the process of dual enlargement will define the future security, political and economic structures of the European region. During the past year west European governments have extended promises of eventual membership to the western Balkan states and to Turkey; while the future positions of Ukraine, Russia, the Caucasus states and the southern Mediterranean associates all raise delicate policy issues. Hard choices remain to be made about the adaptation of these organizations to eastern enlargement, and about the management of relations with the near neighbours who will remain outside.  相似文献

A diaspora of Polynesian travellers on foreign ships began with the foreign discoverers. Jem, a young Tahitian boy, lived in Sydney for some years before shifting to New Zealand. There he married and became a Māori chief. He helped Revd Samuel Marsden in 1814 and later joined a private ship on a disastrous expedition to get sandalwood from the New Hebrides in 1829–30. About 350 Rotumans, 120 Tongans, 500 Hawaiians and various others, including some Māori, died, mostly from fevers caught at Erromanga. Conventional accounts of justice suppose the presence of a stable political society, stable identities, and a Westphalian cartography of clear lines of authority–usually a state–where justice can be realized. They also assume a stable social bond. But what if, in an age of globalization, the territorial boundaries of politics unbundle and a stable social bond deteriorates? Can there be justice in a world where that bond is constantly being disrupted or transformed by globalization? This article thus argues that we need to think about the relationship between globalization, governance and justice. It does so in three stages: first, it explains how, under conditions of globalization, assumptions made about the social bond are changing; second, it demonstrates how strains on the social bond within states give rise to a search for newer forms of global political theory and organization, and the emergence of new global (non-state actors) which contest with states over the policy agendas emanating from globalization; and third, despite the new forms of activity identified in the second stage, the article concludes that the prospects for a satisfactory synthesis of a liberal economic theory of globalization, a normative political theory of the global public domain, and a new social bond are remote.  相似文献

From a specific point of view, mediation is the process whereby a third party helps to change their attitude from an adversarial one to a collaborative one which allows them to work together in finding and creating solutions to their conflict. Mediation deals with conflict from its own perspective and it has its own status as a dispute resolution process in the systems of justice, where it is recognized. The Philosophy of Mediation has been developing as a discipline, which analyses the status of mediation as knowledge. It studies its nature, its constituent elements, its ontological foundations and its connection with other disciplines. This article argues that it is possible to include certain basic principles of the philosophy of María Zambrano in the Philosophy of Mediation framework. Those elements are essential for understanding the world of human conflict since they provide a new perspective from which to see dispute resolution methodologies. They can be summed up in the idea of including the hidden as the substrate of the visible, revealing the underlying forces of human existence. Within the context of the mediation, the understanding of these forces could help to resolve conflicts.  相似文献

ABSTRACT. This article argues that understanding national identity requires a reappraisal of friendship as a political sentiment. Although studies of nationalism underscored the transformation of face‐to‐face interactions into ties between ‘distant others,’ they failed to acknowledge how sentiments of friendship may be involved. First, following theorising in political philosophy, the Aristotelian paradigm of civic friendship is conceptually applicable to modern civil society based on characteristics such as volition, commitment and sentiment. Second, feminist scholarship has delineated how an implicit discourse of male fraternity underlies the historical realisations of the modern social contract and mediates the notions of both patriotism and nationalism. Finally, networks of male associations and transformations in collective affection from small settings to large‐scale societies contributed to the magnification of a politics of friendship. Consequently, rather than viewing fraternal friendship as a relic of traditional societies, it should be studied as a unique aspect of modern nationalism.  相似文献

Since the 1980s and early 1990s, there have been few constructive developments towards a comprehensive and coherent productivity-enhancing agenda. Labor governments have often provided rhetorical support but have fought over whether industry policy represents a new protectionism or market-enhancing development policy. The Coalition in opposition and in office has generally opposed the idea of industry policy, but has continued to support ad hoc and costly policy interventions. Australia's 20 years without a recession has disguised the need to reconsider industry policy and questions of economic diversity. This article argues that dealing with problems of economic structure – particularly resource dependence and climate change adaptation – requires a revitalisation of the industry policy debate. It tracks the theory and practice of industry policy in Australia and concludes that advocates for industry policy must formulate new policy ideas outside the framework of the traditional divide between intervention and free markets.  相似文献

What is the relationship between changes in interest group resources and the proposal and adoption of state policy? Using a dataset of proposed and enacted teacher policies across five legislative cycles in all 50 states and measures of interest group relative and absolute resource strength, I estimate a series of within-state fixed effects models that gain identification from changes in interest group resources and teacher policy over time. I find that legislatures propose more unfavorable and fewer favorable policies toward teachers' unions in states where teachers' union opposition interest groups are expending more election (but not lobbying) resources over time. Further, I find that more unfavorable and fewer favorable policies are adopted in states where teachers' union opposition groups are growing in election resource strength. Expanding on prior empirical work, this study suggests that interest group resources matter for policy change and highlights the importance of capturing interest group resource dynamics over time.  相似文献

This essay uses retranslation studies to trace the defanging and domestication of Samad Behrangi’s The Little Black Fish, a children’s story once hailed as a major revolutionary and literary text. Behrangi’s book is the only modern Iranian prose work to have been translated multiple times both before and after the Islamic Revolution of 1979. The study compares the texts from several of these retranslations, by considering whether they have been domesticated for their English readers, as well as their context, by looking at the cultural impact of such factors as the Islamic Revolution and US?Iran relations. It looks at how various translators and publishers have interpreted the story and how their perspectives reflect Iranian history, the influence of Middle East studies, and the interests of the Iranian diaspora. The result sheds light on translation norms, as well as on the circulation and interpretation of Iranian literature in the global context.  相似文献
