The Australia-US Free Trade Agreement (AUSFTA) required extensive changes to Australian copyright law. This paper assesses the impact of these changes one decade on. It considers, first, whether the costs and/or benefits predicted in 2004 have eventuated, finding clear evidence that AUSFTA has undesirably constrained domestic copyright policy, but no clear evidence either of the feared financial costs to society, or, importantly, the touted benefits to copyright owners. The most significant impact of AUSFTA’s copyright provisions, however, appears to have been on Australia’s copyright trade policy. Pre-AUSFTA, Australia promoted multilateral standards and mostly sought to comply with, but not exceed, international IP standards. Post-AUSFTA, Australia has pursued an approach akin to that of the US: endorsing international copyright rules that are significantly stronger, and more detailed. The paper queries whether this shift has been in Australia’s national interest, and raises interesting questions of path-dependence in policymaking and trade negotiations that warrant more, and broader attention in the literature.  相似文献

The Australia–United States Free Trade Agreement (AUSFTA) came into effect in 2005. It was the second preferential trade agreement that Australia signed, after its agreement with Singapore, and marked a departure from the primacy of Australia's previous trade policy of unilateral and multilateral trade liberalisation toward preferential liberalisation. This paper assesses the economic effects of AUSFTA by applying the Productivity Commission's gravity model of trade from its Bilateral and Regional Trade Agreements review. The evidence reveals AUSFTA resulted in a fall in Australian and US trade with the rest of the world—that the agreement led to trade diversion. Estimates also show that AUSFTA is associated with a reduction in trade between Australia and the United States.  相似文献

ABSTRACT

Despite a troubled trade history dominated by disputes over agriculture, the negotiation of a European Union (EU)–Australia free trade agreement (FTA) was initiated in 2015. The initiation of these negotiations was made possible because of the shift in EU trade policy towards the negotiation of what the EU terms ‘new generation free trade agreements’. The EU has concluded FTA negotiations with South Korea, Singapore, Vietnam and Canada, and is negotiating other FTAs— notably with Japan and the USA . The EU faces many commercial challenges to its FTA negotiations that go beyond tariff reduction, including the protection of its geographical indicators, public procurement and investor–state dispute settlement. These issues are likely to be substantial features of any EU FTA with Australia. In addition to these challenges, the promotion of sustainable development interests and human rights through FTA negotiations is an important component of the EU’s approach. The EU’s position on the trade-related aspects of sustainable development and the negotiation of human rights conditionality has presented significant challenges to the EU’s trade agenda, particularly in negotiations with Canada and Singapore. This article draws lessons from the EU’s new generation trade agreement negotiations to date. It compares these negotiations with Australia’s approach to FTA negotiations, and analyses potential stumbling blocks for an EU–Australia FTA in light of past tensions in the relationship. The article argues that shifts in both EU and Australian trade policies and positive developments in the relationship mitigate past obstacles to a negotiated agreement. However, EU– Australia relations still suffer from the tyranny of distance. The resulting deficit in foreign policy salience between the EU and Australia broadens the best alternatives to a negotiated agreement.  相似文献

In this paper, I challenge the conventional view that trade agreements act as a major constraint on Australia’s industry policy options. Through a comparison with South Korea – a country with similar trade obligations to Australia – I find that the Australian government retains significant room to move in the industry policy sphere. However, Australian policy-makers appear far less willing than their foreign counterparts to use that space. To explain Australia’s comparative industry policy in-activism, I move beyond broad-brush explanations centred on ‘liberal ideology’ to explore the ideational, institutional and structural obstacles to the pursuit of a more proactive industry policy approach on the part of Australian policy-makers.  相似文献

This article compares controversial health technology provisions in two important United States free trade agreements with developed nations: Australia and with South Korea. It examines the multinational corporate forces behind the medicines and medical devices components of these texts and their likely impacts upon Australian trade negotiations with China and India. It also examines the implications of some recent changes to US trade policy for this area in subsequent bilateral deals such as that with Peru. This article argues it is important that the Australian government change policy and, like the present Congress in the United States, now systematically approach such impending trade agreements with a view to assisting the partners’ regulatory frameworks to maximally enhance national and transnational benefit from their medicines and biotechnology industries.  相似文献

Australia and Indonesia have engaged in cooperation on asylum policy since the late 1990s, bilaterally on immigration detention and people-smuggling agreements, and multilaterally through the Bali Process. Seen from a global perspective, this form of cooperation is one of many such bilateral and multilateral agreements that stymie the ability of asylum-seekers to gain effective and durable protection. This article argues that policy transfer theory can explain how these agreements are achieved, their political implications, and their outcome for the refugee regime and the asylum-seekers reliant on the regime for protection. In the case study of Australia and Indonesia, the authors argue that the cooperation is best understood as a form of ‘incentivised policy transfer’, whereby Australia has provided substantial financial and diplomatic incentives to Indonesia to adopt policies consistent with Australia's own. The implications for asylum-seekers in the Asia-Pacific region are substantial, and include an increase in the use of immigration detention in Indonesia and the introduction of border security measures that restrict the ability of asylum-seekers to reach territory where they may claim protection under the Convention Relating to the Status of Refugees.  相似文献

Economists have warned for many years that preferential trade agreements (PTAs) will not necessarily increase economic welfare in Australia given the relatively small size of the economy and the country’s lack of negotiating coin. The Productivity Commission cautioned in its major report on PTAs that there seemed to be a mindset of ‘agreements for agreement’s sake’, in part because of fears of missing out on a bandwagon that has attracted Australia’s major trading partners. Political and security considerations have played an important role in shaping Australia’s approach to PTAs. When politics trumps economics in negotiations of PTAs there is a risk of a rush to premature agreement that produces sub-optimal outcomes, that undermines broader plurilateral and global negotiations, and that introduces new and undesirable distortions in trade and public policies. Various theoretical approaches to trade policymaking provide insights into why Australian governments have been willing to conclude these sub-optimal deals.  相似文献

This article examines how contestable market theory (contestability) has come to reconfigure the economic and regulatory concept of competition in order to enhance the compatibility of Australia’s economy with international trade and investment agreements. Australia has recently negotiated and signed a raft of bilateral, plurilateral and regional agreements, including the Trans-Pacific Partnership Agreement and the Australia–China Free Trade Agreement. In order to ensure that Australia meets its obligations and commitments to these agreements, two key advisory bodies—the Harper Panel on Competition Policy Review and the Financial System Inquiry—made recommendations, the majority of which were accepted by the government, to ready Australia’s competition governance and economic policy for greater global integration. Such impact is dependent on, among other things, how domestic competition policy meshes with the free market ideology underpinning such international agreements, which favours the breakdown of barriers to markets. Less well known is the role of contestability in radicalising ideology as it countenances monopolisation and privatisation in the guise of market access by justifying the substitution of actual competition with the mere threat of competition. The article concludes that the monopoly power of transnational corporations will be enhanced through the acquiescence of governments to the new governance regime of the Trans-Pacific Partnership Agreement, which, supported by domestic policy, is set to redraw competition policy in the light of contestability theory.  相似文献

Australia is currently negotiating a framework treaty with the European Union (EU) that aims at closer cooperation on a wide range of shared policy goals. The treaty is not expected to include trade-liberalisation commitments. This article queries why this is, given the importance of trade and business relations with the EU for Australia, and the fact that the EU exerts international influence primarily as a trade power, rather than a foreign and security policy power. Since 2006, the EU has also been negotiating ‘new-generation’ bilateral free trade agreements (FTAs), focusing on tariffs and regulatory non-tariff trade barriers. It has now committed itself to FTA negotiations with many of Australia's trade partners in Asia and the Organisation for Economic Co-operation and Development. An FTA and a complementary framework treaty were concluded with South Korea in 2010, and the EU is currently negotiating a similar package with Canada. As Australia and Canada are comparable trade partners for the EU, the article argues that an FTA on the EU–Canada model could be a more effective avenue for Australia to achieve deeper engagement with the EU.  相似文献

Even as the world’s sole superpower, the United States requires the cooperation of other states to achieve many of its foreign policy objectives. The President of the United States thus often serves as ‘Diplomat in Chief’ in public diplomacy efforts to appeal directly to publics abroad. Given Donald Trump’s antagonistic approach to foreign relations and widespread lack of popularity, what are the implications for support for US policy among publics abroad – particularly among middle power states allied to the US? While previous research on public opinion relying on observational data has found that confidence in the US President is linked to support for American foreign policy goals, the mechanisms at work remain unclear. Using original data from survey-based experiments conducted in Canada and Australia, this article seeks to clarify the effect of ‘presidential framing’ (presenting a policy goal as endorsed or not endorsed by Trump) on attitudes toward key policy issues in the Canada–US and Australia–US relationships. Results point to a negative ‘Trump framing’ effect in Canadians’ and Australians’ trade policy attitudes, but such an effect is not observed in other policy domains (energy policy in Canada, and refugee policy in Australia).  相似文献

ABSTRACT

Economic diplomacy—that is, informal and formal processes and links between states and non-state actors on international economic issues—is a current focus of Australian foreign policy. The Department of Foreign Affairs and Trade’s stated economy diplomacy aims are liberalising trade, boosting economic growth, encouraging investment and assisting business. If Australia is to embrace a genuine and effective notion of economic diplomacy there are two problems to be overcome. First, DFAT’s economic diplomacy framework is incomplete and misses the bigger economic picture, particularly the role of Australia’s key economic agencies, Treasury and the Reserve Bank of Australia. Second, DFAT does not consistently apply economic principles to foreign affairs issues including trade, foreign aid and the global investment agenda. Going forward, Australia should abandon the focus on the four narrow pillars and instead focus on developing a clear, coordinated international economic strategy that articulates Australia’s core international economic objectives and priorities.  相似文献

In 2011, Australia communicated a clear choice about its strategic future. It would continue to cleave tightly to the US alliance, expand its military links and work to advance the USA's conception of regional order. Given its economic interests, why has Australia bound itself to the US alliance? What lies behind this strong commitment and what would it take for Australia to change its relationship with the USA? This article presents an analysis of the current state of the US–Australia alliance and argues that Canberra's pursuit of close relations with the USA reflects the interaction of a rational calculation of the costs and benefits of the alliance with a set of resolutely political factors that have produced the current policy setting. The article first assesses the security cost and benefit behind the alliance. It then argues that the move also derives from the strong domestic support for the US alliance, a sharpened sense that China's rise was generating regional instability that only the US primacy could manage and the realisation that the economic fallout of such a move would be minimal. It concludes with a brief reflection on what it might take to change the current policy settings.  相似文献

In recent years, Australia has had a very active agenda for the negotiation of preferential trade agreements (PTAs) whose net economic benefits remain at best unclear. There has been a strong defensive element to some of this PTA activity but the Howard government also used PTAs to pursue non-economic objectives, such as the promotion of foreign policy and security interests. This article broadly outlines Australia's PTA policy and the problems and dilemmas that it has generated. More importantly, it looks ahead to consider likely scenarios for trade policy under the Rudd Labor government. Each of these scenarios has different implications for policy strategies and outcomes. This article concludes that while there could be significant pay-offs should Labor choose to pursue its traditional preferences for non-discriminatory trade arrangements, the world has changed considerably since the heydays of the multilateral trade system. A commitment to reinvigorating multilateralism will require strong political leadership, imaginative thinking, and creative diplomacy.  相似文献

The Internet is an interconnected network and cyber security requires collective action. How that action is organised has important implications for national security, including the defence against cyber attacks and malicious activities. This article explains the origins and institutionalisation of cyber security in Australia—particularly ‘civilian cyber security’. The authors trace the origin of Australia’s first computer emergency response team and explain how this organisational form spread from the USA. Through it, Australia helped enable international cooperation. Domestically, however, the authors argue that the Australian government has struggled with the delegation, orchestration and abdication of responsibility for civilian cyber security, underinvesting in civilian organisations while overrelying on military and intelligence agencies. The history of this organisational field provides valuable insight into how to improve national policy and operations for cyber security.  相似文献

Contemporary Australian Indigenous policy changes rapidly and regularly fails to deliver its stated aims. Additionally, political and social relationships between Aboriginal and Torres Strait Islander peoples and the Australian state remain complex and contested. This article draws on critical Indigenous theory, alongside the increasingly influential scholarly paradigm of settler colonialism, to draw these two elements together. It highlights the ongoing nature of colonial conflict, and the partisan nature of state institutions and processes. While policy is usually framed as a depoliticised, technical practice of public management for Indigenous wellbeing, I suggest that it also seeks to ‘domesticate’ Aboriginal and Torres Strait Islander peoples, perform their dysfunction and demonstrate state legitimacy. This is especially the case in Australia, which has a long tradition of framing domestic welfare policy – rather than legal agreements – as the ‘solution’ to settler colonial conflict.  相似文献

Arguably, the world trading system has entered a period of greater change and uncertainty in the past two years than at any time since the end of the Cold War. At the same time, Australia faces a range of internal and external challenges to its trade policy, while having lost many of the old 'certainties' guiding its trade agenda. This article identifies four major challenges confronting Australian trade policy now and into the future: the EU agenda to inject self-serving 'governance' mechanisms into the WTO; rises in the demands and influence of developing countries within the WTO; the new trend towards bilateral free trade areas; and increasing opposition to globalisation by groups within society. It assesses the capacity of Australia's trade bureaucracy to manage these issues, warning against expecting too much of the trade policy agenda, particularly in relation to the role it plays within domestic politics in Australia.  相似文献

This paper provides an overview of Australia’s experience with trade and industry policy since Federation in light of the dilemmas facing a small, rich, remote, resource-based economy. It focuses on the attempt to diversify away from a dependence on the export of primary products and to move beyond – while still also continuing to exploit – the country’s natural comparative advantage. It examines the rise and decline, purpose and effects, of protectionism; moments of experimentation with interventionist industry policy; and effects of the mining boom. In doing so, it considers Australia’s particular economic circumstances and factor endowments in light of competing notions of comparative advantage and the appropriate role of government in promoting economic development and competitiveness.  相似文献

When the talks for a Trans-Pacific Partnership (TPP) were launched in 2010, there appeared to be a coincidence of interests between the American and Australian governments in negotiating a high-quality, ‘21st-century’ trade arrangement that would multilateralise the bilateral and minilateral trade agreements that have proliferated in the Asia-Pacific region in the last 15 years. As the negotiations progressed, however, a divergence between American and Australian interests became apparent. Protectionist interests in the United States have prevented the administration from improving on market access agreements in the current preferential trade agreements with TPP partners, thereby undermining the multilateralisation objective. Some of the elements of the US template for 21st-century trade agreements, notably enhanced protection for intellectual property, and the inclusion of investor–state dispute resolution, clash with Australian trade priorities. Moreover, the central role of the TPP in the US ‘pivot to Asia’ has led to perceptions that it is part of a strategy to encircle China: consequently the TPP may force Australia to make the very choice between China and the United States that the government wishes to avoid.

ABSTRACT

The Brexit vote will fundamentally transform the European Union (EU) and will change how the UK relates to Europe and the rest of the world. What are the implications for Australia at this critical juncture? The UK has been a major player in the Australia–EU relationship, and Australia will now need to recalibrate its approach to both the UK and the EU across a range of policy areas. This article examines the future of Australia–UK and Australia–EU relations in the wake of Brexit, and assesses Australia’s options going forward. The authors advance three considerations. Firstly, Australia’s national interests are best served by adopting a pragmatic rather than nostalgic approach towards future relations with the UK and the EU. Secondly, Australia should avoid pursuing one relationship at the expense of the other and creating a zero-sum dynamic. Finally, Australia’s future strategy must consider broader global developments, such as events within its own region and the US presidency.  相似文献
