The "Lone Dissenter"

The tenure of Associate Justice—and later Chief Justice—William H. Rehnquist on the Supreme Court spanned more than three decades. Despite his public importance, he was a quite private man. During his time on the Court, relatively few accounts appeared of what life was like inside the Rehnquist chambers, especially during his years as an Associate Justice. In the aftermath of his death last fall, former clerks have begun to reminisce about what it was like to clerk for him.

Hydrogeological Knowledge from Below: Water Expertise as a Republican Common in Early-Modern Venice**

This essay looks at early-modern Venice hydroculture as a case of episteme from below. The forms of water knowledge it developed were multilayered and collective in their essence and solidly rested on a social experiential basis that was rooted in labour (especially fishing) and practices (especially water surveying and engineering). In accordance with the city's republican esprit (and correspondent political values), its episteme emerged as the encounter and negotiation between various institutions and groups: the fishermen of San Niccolò in Venice, the practitioners of the water magistrature and political authorities. This essay explores the institutional settings of this water culture, seen as an instance of bottom-up epistemic construction. It especially addresses three historical instances: firstly, a seventeenth century program to map public waters in order to block their alienation for private fish farming; secondly, water officers’ interviews with fishermen aimed to assess the state of the lagoon hydromorphology and, thirdly, fishing regulations. Venice communitarian and circular forms of knowledge production are here contrasted to an opposite paradigm, which was embodied by the Galileian mathematician and Rome courtier, Benedetto Castelli. His interactions with the Republic of Venice on water management and his approach to hydraulic problems are revealing of an elitist and abstract understanding of scientific knowledge that guided political decisions from above without taking in any consideration the opinions of the ‘vulgar’. While his science was the expression of a top-down political epistemology, Venetian water knowledge was more egalitarian. It left room for exchange, inclusiveness and bottom-up codification; it valued the gathering of different experiences (including the fishermen's practical knowledge of their waters) and rested on a concrete and systemic (organicist) understanding of natural-anthropic processes.

Surviving Justice: America's Wrongfully Convicted and Exonerated

On Independence Day 2008, the Associated Press distributed astory about a Texas man released from prison after serving fifteenyears. He was the nineteenth Dallas County man since 2001 shownto be innocent by DNA evidence ("DNA Clears Texan," Iowa CityPress-Citizen, July 4, 2008: 7A). This was the highest numberof any county in the nation. Wrongful conviction is, however,not limited to Dallas County, TX, nor is exoneration alwaysthe result of DNA tests. Just five days earlier, The Des MoinesRegister had published a front-page story about a man spendinghis twelfth year in an Iowa prison. He had been convicted inDes Moines's Polk County of a 1996 murder, but the many redflags in the case finally warranted a hearing and a possiblereversal of     

Loving Friends: Surviving Widowhood in Late Medieval Westminster

Although medieval moralists routinely warned against women socialising with either men or women, this article argues that friendships were instrumental in helping women survive widowhood. In medieval Europe, widowhood was frequently a time of vulnerability and poverty. Unscrupulous businessmen and other opportunists often preyed upon widows. Looking at the different ways men and women in Westminster made their wills and analysing those chosen to administer them reveals that widows frequently turned to the husbands of their friends to execute their wills and oversee their estates.     

The Archaeology and Technology of Early-Modern Lime Burning in the Yorkshire Dales: Developing a Clamp Kiln Model

Abstract

Compared with commercial or field lime kilns of the industrial period, very little detailed work has been undertaken to investigate post-medieval and early modern clamp kilns apart from a few notable site-specific studies. Clamp kiln terminology thus far has been unable to distinguish between clamp, sod and sow kilns. Recent field surveying and archaeological excavation across a wide area within the Yorkshire Dales, with associated documentary and archival research, has shed new light on clamp kiln technology and morphology. The results of this work have informed the development of a provisional clamp kiln model which, it is argued, is appropriate to the Central Pennines.     

Lone Grenadier: An Episode from the Battle of Kunersdorf, 12 August 1759

This article presents the outcome of archaeological investigations carried out within the area of the Kunersdorf battlefield dating from the Seven Years War, during which the remains of a Russian Observation Corps grenadier were unearthed. The paper will discuss the identification process, context of the discovery, and will present some new archaeologically derived facts relating to the battle’s history and documentation.     

Surviving in a Competitive Spatial Market: The Threshold Capture Model

Many facility location decision models ignore the fact that for a facility to survive it needs a minimum demand level to cover costs. In this paper we present a decision model for a firm that wishes to enter a spatial market where there are several competitors already located. This market is such that for each outlet there is a demand threshold level that has to be achieved in order to survive. The firm wishes to know where to locate its outlets so as to maximize its market share taking into account the threshold level. It may happen that due to this new entrance, some competitors will not be able to meet the threshold and therefore will disappear. A formulation is presented together with a heuristic solution method and computational experience.
