The Israeli-Palestinian conflict: Is there a way out?

The blame for the inability to put an end to the conflict between Israel and the Palestinians must be shared by all parties. In Israel, Ehud Barak's attempts were courageous but he never established trust with the Palestinians. The policy of the Sharon government, based only on response to violence by force, also failed. Although he did not mastermind the Second Intifada, Arafat's attitude towards the Palestinian militant armed groups was always ambiguous and he lost any credit even among the Israeli peace camp. The Arab countries never gave more than a formal support to the Palestinians and abstained from arguing in favour of coexistence with the Israelis. The Americans, with Clinton, seriously tried their best but lacked some long-term perspective and, with George W. Bush, aligned themselves with the most radical Israeli position. Europe did support the Palestinian economy but was too divided to influence dramatically the negotiations and did not invest enough into peace-building among the peoples of the region. The only way out of the quagmire is to follow the roadmap established by the international community, represented by the 'Quartet' (the UN, the USA, Russia and the European Union) for an end both to terrorism and occupation, and towards negotiations on the establishment of a democratic and viable Palestinian State.     

Australia's embrace of investor state dispute settlement: a challenge to the social contract ideal?

This paper explores the origins of investor-state dispute settlement (ISDS) treaties and their implications for the Australian social contract. This analysis includes how and why ISDS emerged in NAFTA, was rebuffed with the failure of the Multilateral Agreement on Investment (MAI), and became incorporated into most subsequent bilateral US trade and investment agreements. The paper considers Australia's exposure to ISDS—first through using it in bilateral investment agreements in nations with inadequate governance mechanisms to support the rule of law, then turning against it when a multinational tobacco company tried to use the mechanism to overturn scientifically endorsed, democratically approved and constitutionally validated tobacco plain packaging measures. The paper concludes by exploring the hypothesis that an alternative governance vision can be achieved in which the system of investment arbitration and trade law is made coherent with presumptively more democratically legitimate normative systems such as constitutional and international law.     

E.A. Markham’s St. Caesare: the other “Ulster”?

This essay examines the invented Caribbean island of St. Caesare and its relation to the representational space of “Ulster” in Montserratian poet E.A. Markham’s collection Letter from Ulster and the Hugo Poems (1993). As the title of the book implies, it unites two of the poet’s home islands, Ireland and Montserrat. Ireland was Markham’s home at the moment when he drafted many of these poems, as he was Writer-in-Residence at the University of Ulster at Coleraine from 1988 to 1991. However, as a Caribbean writer of Afro-Irish heritage, Ireland is also home in that it represents a “hinterland”. Of the Caribbean islands, Montserrat is the most closely identified with Ireland owing to its Irish cultural inheritance, which has earned it the nickname “The Emerald Isle of the Caribbean”. This article surveys Markham’s depictions of St. Caesare and “Ulster” as analytical spaces that enable him to chart the palimpsestic topologies of Montserrat and Northern Ireland. The author argues that Markham limns St. Caesare and “Ulster” as transatlantic mirror images to allow for critical relationality between Montserrat and Northern Ireland.     

In Search of the Good Life: Life‐History of a Kenyan Indian Settler. A Sartrean Approach to Biography and History

This article recounts how a young Shi’a Muslim Indian born in north‐west India migrated to Kenya in the early twentieth century in the context of the evolving trade linking the two continents, and rose to become a successful merchant and respected member of the community. It portrays the struggles that he undertook with fellow Kenyan Indians against British colonial policies of racial discrimination and political marginalization, and shows some of the unintended consequences of these actions for the group in the post‐colonial period. Through the application of Jean‐Paul’s Sartre’s concepts of project, situation, seriality and dialectical totalization, the article attempts to capture some of the historical processes that took place during the period at four interconnected levels: individual; communal; regional; and global.
