The purpose of this article is to analyze the interaction between different interpretations of Islamic jurisprudence in Iran and state law. It focuses on the public legal discourse about the new Family Draft Law in 2007–08, especially Article 23 regulating polygamous marriages and removing necessity for the first wife's permission. The participants in this public legal debate, which took place on the internet and in the media, were civil society organizations, especially women's organizations, the Shiite clergy, and state representatives. The article argues that even in a non-democratic, theocratic state such as the Islamic Republic of Iran, public discourse promoted by the named actors can challenge and influence state legislation. The removal of Article 23 from the Draft confirms this argument, but in the law of 2013 the requirement for the first wife's permission is not found. By looking at the arguments brought forward in the public discourse, the article demonstrates that the arguments are mainly “Islamic,” and none refers to international human rights, as this seems to be a kind of taboo in the political discourse. 相似文献

In nineteenth-century Italy notions of femininity and, no less, masculinity influenced the ways in which crime was viewed. The result was that criminality was perceived, judged and explained differently according to the sex of the offender. At every stage in the penal process, cultural understandings of what women were like, and how they ought to behave, operated to define the appropriate response to their misconduct and to structure their punishment. These 'gendered' aspects of criminal justice have influenced the practices of prosecution and sentencing, and, most clearly of all, the special regimes and attitudes adopted in women's prisons: throughout the century male prison regimes emphasized discipline and deterrence, while female prisons developed individualized programmes of 'moral regeneration'. This article deals with the history of the first prison destined exclusively for women - which was opened in Turin in 1821 - with the circumstances which brought about its creation as well as with its organizational structure and its aims. Its promoter - both in money and in spirit - was a woman, named Giulia Falletti di Barolo Colbert. Giving special consideration to the ideals of its foundress, this article examines how nineteenth-century perceptions of the female criminal differentiated the nature and purpose of penal servitude for women. 相似文献

This article retraces Annarita Buttafuoco's work as a historian of the women's political movement in Italy through a brief survey of her essays and books. These covered more than two centuries of history, ranging from the echoes of the French Revolution in Italy and the constitution of the Jacobin Republics to the struggles for female suffrage and emancipation in the liberal era down to the period after the Second World War and the founding of the Italian Republic. Emphasizing the originality of both the sources and the methodological approaches she used, the article offers a critical appreciation of Annarita Buttafuoco's research and her role in organizing and shaping collective research projects. It is focused on three specific issues: the history of women as conscious historical subjects, the history of women's political movements not only in their social and political contexts but also in relation to institutional networks and the practices of citizenship. 相似文献

Using three contemporary Irish novels: Down By the River and The Light of Evening by Edna O'Brien and My Dream of You by Nuala O'Faolain as well as Irish Medical Journal, I suggest that representations of female cancers are images of female pathology that reify and question disease as limitation of autonomy. Tracing the image of reproductive cancers through parts of the Irish cultural artifacts displays how both the fiction and Irish medical discourse attend disproportionately to female reproductive cancers. The texts construct female bodies as sites of pathology through textual representations of reproductive cancer and build upon Irish metaphors of landscape as female, which conceptualize women's (immobile, permeable) bodies as the site of invasion. Thus, fiction and health genres construct (and restrict) gender autonomy through two versions of border control: movement across body borders and movement across spatial, especially geopolitical, borders. 相似文献

The debate concerning the attitude to work of medieval and renaissance merchants has been one of the most intense in twentieth-century historiography. Arising from the publication of the classic works of the sociologist Max Weber, the debate entered the field of historiography proper after the appearance of articles by Werner Sombart and Henri Pirenne. In the 1950s and 1960s, the works of Yves Renouard and Armando Sapori centred discussion on the development of a specifically mercantile culture in the Italy of the Middle Ages and the Renaissance. In this historiographic context, the article below is an attempt to approach, through original sources, the figure of the merchant in late medieval Barcelona. These sources are inventories, wills, and marriage contracts, through which is offered a three-dimensional analysis of the professional culture of such a merchant; the concept of professional space; the organisation of time; and the bearings of his commercial and patrimonial investments. The result of this analysis is an attempt to reinterpret the decadence of Barcelona at the end of the fifteenth century through the notion of work entertained by those involved in commerce, attempting by this means to merge the consideration of economic and cultural matters. It is also a proposal for a model of analysis of professional categories, which on so many occasions have been left to one side because of the preponderance of more traditional questions such as those concerning society, economics or politics. 相似文献

Before the Food and Drug Administration approved in 1960 the distribution of oral contraceptives, the most popular form of birth control in the United States was the condom. Scholars have often downplayed men's involvement in the history of birth control, relegating knowledge and use of contraceptive technology to a separate "female domain." This article explores the role of condoms in the evolution of the American birth control business, attitudes toward public health, and everyday sexual behavior, and suggests why the full complexities of the history of birth control are best captured by an approach that is attentive to broad gender dynamics as well as to the diversity of technological change. 相似文献

The fusion of law and ethics in cultural heritage management: The 21st century confronts archaeology

AbstractArchaeologists around the world face complex ethical dilemmas that defy easy solutions. Ethics and law entwine, yet jurisprudence endures as the global praxis for guidance and result. Global legal norms articulate ‘legal rights’ and obligations while codes of professional conduct articulate ‘ethical rights’ and obligations. This article underscores how a rights discourse has shaped the 20th century discipline and practice of archaeology across the globe, including in the design and execution of projects like those discussed in the Journal of Field Archaeology. It illustrates how both law and ethics have been, and still are, viewed as two distinct solution-driven approaches that, even when out of sync, are the predominant frameworks that affect archaeologists in the field and more generally. While both law and ethics are influenced by social mores, public policy, and political objectives, each too often in cultural heritage debates has been considered a separate remedy. For archaeology, there remains the tendency to turn to law for a definite response when ethical solutions prove elusive.As contemporary society becomes increasingly interconnected and the geo-political reality of the 21st century poses new threats to protecting archaeological sites and the integrity of the archaeological record during armed conflict and insurgency, law has fallen short or has lacked necessary enforcement mechanisms to address on-the-ground realities. A changing global order shaped by human rights, Indigenous heritage, legal pluralism, neo-colonialism, development, diplomacy, and emerging non-State actors directs the 21st century policies that shape laws and ethics. Archaeologists in the field today work within a nexus of domestic and international laws and regulations and must navigate increasingly complex ethical situations. Thus, a critical challenge is to realign approaches to current dilemmas facing archaeology in a way that unifies the ‘legal’ and the ‘ethical’ with a focus on human rights and principles of equity and justice. With examples from around the world, this article considers how law and ethics affect professional practice and demonstrates how engagement with law and awareness of ethics are pivotal to archaeologists in the field. 相似文献

During the last few decades, many studies have documented the considerable participation of women in the economy of past societies, even though women were bound by rules and laws that discriminated against them and denied them the rights of citizenship. Thus historians, and especially those in the field of gender history, have increasingly recognized the importance of interweaving two realms, those of work and of property. As part of this effort, this article focuses on eighteenth- and nineteenth-century Rome and shows that over a long economic period, women's position was defined by a complex interaction between their status as workers and as owners of property. 相似文献

Abstract Francesco Crispi has often appeared a paradoxical figure. In the earlier part of his life he was a revolutionary republican and a friend of Mazzini. After 1860 he accepted the monarchy, but remained very much a man of the Left and in many ways a quintessential democrat. Yet he ended his career as an authoritarian Prime Minister, a vigorous opponent of the Far Left, and an imperialist, who prorogued parliament and contemplated dispensing with representative government altogether. This article contends that Crispi's career has more coherence than is commonly suggested; it focuses on an important but hitherto neglected aspect of his thinking, namely the problem of how to achieve a sense of national consciousness in Italy through ‘political education’. The article traces the development of the idea of national political education throughout Crispi's career and argues that his two terms as Prime Minister in 1887–91 and 1893–6 can only be fully understood in the context of his long‐standing concern with this problem. 相似文献

Abstract Within heritage studies the relationship between national heritage and national identity is frequently taken as axiomatic. The construction of a national heritage is an important part of nation‐building, and historic buildings and monuments can be powerful symbols of a nation's aspirations and identity. Yet this relationship has received relatively little empirical investigation. This paper reports an exploratory study of the heritage/national identity relationship in Romania which focuses on just one Roman monument – Trajan's bridge. For many Romanians the monument is a powerful symbol of their identity representing Dacian and Roman origins, Latinity, and the continuity of Romanian settlement in Transylvania. The monument was also seen by some as an important symbol of Romania's attempt to construct a post‐Communist identity, and to forge closer links with western Europe. However, the meanings of the monument are not shared by all Romanians, and in particular are strongly contested by Romania's Hungarian minority. 相似文献

An interesting case study in the history of welfare systems is the comparison between France and Italy. In fact, in the 1940s both countries had to tackle a very similar dilemma: the corrective reform of their existing welfare or the institution of reforms in line with the ‘universal’ model. This was a crucial turning point. Understanding these dynamics means grasping the significance of one of the most important moments in the history of the welfare state. The proposed reforms were ultimately rejected. Why? The aim of this article is to try to provide an answer to this question, examining the issue at various levels. It highlights the interactions between the top-down choices (the theoretical reflections and the political decisions) and grassroots dynamics (of social groups), and illustrates the decision-making process that led to the final outcome. This article brings an anthropological approach to bear on the question of ‘children's voices’ and, particularly, on the stories told by some young migrants about their recent arrival as asylum-seekers in Britain. Young migrants' narratives are examined as situated and self-conscious claims to a certain identity as child refugee. The question of why a particular narrative of ‘arrival in Britain’ was offered by a diverse group of young migrants and asylum seekers is discussed. These stories present a view of their tellers as alone and irreconcilably detached from past lives and relationships. These narrative repertoires as well as their telling draw from and elaborate certain views of the ‘proper refugee child’ that circulate through various regimes of immigration, welfare and emancipatory community work that all involved these young people. An approach to the stories as accomplished as well as situated performances that collapse the ordinary division between stories as ‘facts’ or ‘fictions’ is introduced. In this sense, the ‘children's voices’ heard in this study are recognised as situated and interested products of a research relationship. 相似文献

Abstract Over the past three centuries Italy has been the focus of numerous studies by French historians, who have taken advantage of the great wealth of sources available there. While no new synthesis has yet been achieved, we can identify certain main lines of development in French historiography. In the late 1970s and into the 1980s international relations and, especially, the relations between France and Italy were given the greatest attention, before a new focus on forms of sociability and political pedagogy began to be more common. However, the shifting of focus of historical studies to the centres of political decision making often coincided with less attention being paid to social stratification. Beyond these major themes, some researchers have reconstructed ‘global’ historical models, which have been characteristic of the renewal of post‐war French historiography. 相似文献

Feminist scholars have documented with reference to multiple empirical contexts that feminist claims within nationalist movements are often side‐lined, constructed as ‘inauthentic’ and frequently discredited for imitating supposedly western notions of gender‐based equality. Despite these historical precedents, some feminist scholars have pointed to the positive aspects of nationalist movements, which frequently open up spaces for gender‐based claims. Our research is based on the recognition that we cannot discuss and evaluate the fraught relationship in the abstract but that we need to look at the specific historical and empirical contexts and articulations of nationalism and feminism. The specific case study we draw from is the relationship between the Kurdish women's movement and the wider Kurdish political movement in Turkey. We are exploring the ways that the Kurdish movement in Turkey has politicised Kurdish women's rights activists and examine how Kurdish women activists have reacted to patriarchal tendencies within the Kurdish movement. 相似文献

In 1749, the house of commons appointed a committee of enquiry into the lands and trade of Hudson's Bay. This was the climax to nearly 20 years' work by the Ulsterman, Arthur Dobbs, which focused first on renewed search for a northwest passage and later widened to attempt to expand trade and settlement by challenging the monopoly of the Hudson's Bay Company. Dobbs's Irish patriotism, linked by support for union with Britain with his remarkably expansive vision of British empire, became concentrated on this campaign with a zeal and tenacity which overrode contrary evidence based on experience. Propaganda pamphlets, mobilisation of compatriots, merchant and political contacts, briefs for MPs, marshalling of evidence and witnesses for parliamentary committees, 30 petitions from a variety of places, organised by Liverpool and Bristol merchants who took the lead in the final campaign: all were used to attempt to influence parliament. This was an impressive mid-century effort to promote British commerce and manufactures, actively supported by the parliamentary opposition which was reviving under Leicester House leadership. Yet, while this campaign could shape the report of the committee of enquiry, the House itself was not so easily moved, especially when public expenditure was likely to be involved. A motion arising from the report was decisively defeated. The impressive campaign came to nought. While it indeed reveals powerful visions of commercial and imperial expansion in the mid 18th century, the outcome suggests that realism and scepticism prevailed at the heart of the state. 相似文献
