This article explores the interplay between transitional justice and ‘everyday’ political economies of survival in post‐conflict Acholiland, northern Uganda. It advances two main arguments. First, that transitional justice — as part and parcel of conventional liberal peacebuilding packages — promotes a repertoire of normatively driven policies that have little bearing on lived realities of social accountability in post‐conflict settings. Second, that in transcending the epistemological and ontological boundaries of transitional justice and using concepts developed in the critical peacebuilding literature — the ‘everyday’ and ‘hybridity’ — a nuanced understanding of this dissonance emerges. Based on extensive fieldwork in Acholiland in the period 2012–14, using a range of qualitative research methods, the author examines the means through which people negotiate social and moral order in the context of post‐conflict life and analyses the tensions between these forms of ‘everyday’ activity and current transitional justice policy and programming in the region.  相似文献

Nationalism is arguably one of the most detrimental peace‐breaking factors in conflict‐affected societies. This article examines how ethno‐nationalist elites, subterranean movements, and ordinary people can become blockages to sustainable peace and reconciliation after violent conflict. It argues that peacebuilding and state‐building imposed from outside as conflict transformation approaches without acceptable peace settlement and resolute solution of the disputes among parties in conflict risk enabling the co‐optation of power‐sharing arrangements by ethno‐nationalist elites, contestation of peace and reconciliation by subterranean mono‐ethnic movements, and the occurrence of vernacular peace‐breaking acts. This negative mutation of nationalism not only harms peace, justice, and development but also undermines the rights and needs of distinct identity groups. Under these conditions, escaping the nationalism trap in conflict‐affected societies requires seeking political change through post‐ethnic politics and reconciliation through everyday pacifist acts undertaken by the affected communities themselves. The article draws on Kosovo to illustrate empirically the dynamics of peace‐breaking and practices of everyday nationalism. It seeks to bridge debates on nationalism and post‐conflict peacebuilding and offer alternative pathways for rethinking strategies of peace in divided societies.  相似文献

2003 marked the Centenary year of the High Court, an anniversary which provides an opportunity to revisit debates about its role in the Australian system of government. The first section of this article canvasses debates around this question, culminating in a consideration of the High Court's ‘new politics’. This sets the framework for an examination of events in 2003 from the perspective of the interaction between the judicial and other branches of government, in particular the executive. The article analyses the implications of executive interventions in relation to the judiciary, as well as important cases brought before the High Court. It argues that conflict between the executive and judicial branches is only likely to increase where contradictions of purpose arise between international legal norms and obligations, the rule of law and domestic policy objectives. This article is the third in a series of reviews of the High Court from a political‐science perspective published in the Australian Journal of Political Science.  相似文献

Many scholars have examined the implications and effects of a putative dichotomy between public-as-masculine and private-as-feminine spheres on community activism, and suggest that women's community activism blurs this ideological divide in numerous ways. This article draws on a case study of a siting conflict in St. James Parish, Louisiana, to examine how, in the process of blurring boundaries between gendered spheres of interest and activity, predominantly women environmental justice activists contended with differently gendered contexts. Concepts of performance and performativity shed light on how gendered hierarchies of public and private sphere activism both constrained and enabled the protest group's political practice.  相似文献

This article examines the relationship between public opinion and foreign policy making in Australia by turning to the findings of a national survey of Australian public opinion on the Israel–Palestine conflict. The survey findings suggest that the Australian government's policy on the Israel–Palestine conflict is inconsistent with public opinion, and such disparity is explained here in terms of the lack of public attachment to the conflict, the limited media and the absence of any notable public advocacy for policy change. This explanation is informed by in-depth interviews conducted with current and former members of parliament and senior public servants. The article also explores the implications of the survey's findings in relation to the significant political changes taking place across the Middle East region. It suggests that these events may be creating an impetus for policy change that endorses Palestinian self-determination, for which there is significant support among the Australian public.  相似文献

This article examines Wang Jingwei's ideas on nation and race before the 1911 Revolution. It has often been agreed by scholars that there was a strong current of anti-Manchuism among the revolutionaries and as a result, on the eve of the 1911 Revolution, the revolutionaries remained divided as to whether the new Republic should inherit all the territories ruled by the Manchu dynasty and whether it should include the Manchus into the nation. It was only in the reformist camp led by Kang Youwei and Liang Qichao that the Manchus were unambiguously regarded as part of the Chinese nation. This article suggests that in the revolutionary camp before the 1911 Revolution, it was Wang Jingwei who broke new ground in mapping out a place for the Manchus after the revolution. He stood out among the revolutionaries in the clear formulation of the idea that the new Chinese nation should be composed of different nationalities including the Manchus. This article also suggests that although Sun Yat-sen had an influence upon Wang Jingwei's political thinking during the Tongmenghui (Revolutionary Alliance) times, Wang's intellectual talents and resources enabled him to outgrow Sun's framework and develop his own ideas. His concepts on race and nation and perceptions of Han–Manchu relations owed a considerable debt to the Swiss legal scholar, Johann Kaspar Bluntschli. Wang Jingwei has been a much reviled political figure in twentieth century Chinese history. His contribution to the formulation of a racial identity for the new Chinese nation has long been underrated, and this article attempts to throw light upon this aspect of his political thought.  相似文献

The key concerns in work on the politics of the Middle East in the past decade have been economic and political liberalization/democratization (or the absence thereof) and security, both domestic and international, along with a continued focus on the Arab‐Israeli conflict. There has been an increasing recognition that these issues are strongly interrelated. Europe cannot avoid concerns over economic and political stability in the region affecting its own interests. Together with economic reasons for engagement with the region, this has brought about a desire to see economic and political reform take place. The Euro‐Mediter‐ranean Partnership Initiative (EMPI) is one result of this. The background against which these policies, concerns and hopes are evolving is ‘globalization’, both of the discourse of ‘democracy’ and in the growing hold of liberal market economics internationally. Recent research on the politics and political economy of the region, and on EMPI, however, shows that a combination of political‐economic and related political‐cultural factors, along with the Arab‐Israeli conflict, continue to hamper political and economic reform in the Middle East, and that European policy as currently conceived is unlikely to affect this greatly. Yet such recent work also shows that aspects of globalization are changing the environment in which Middle Eastern regimes are having to function, while at the same time offering civil society new tools. Middle Eastern societies do, to varying extents, possess the necessary ‘spaces’ and traditions for human ‘agency’ to escape the constraints of domestic and international ‘structures’ and evolve new political cultures‐including democratic ones. Existing judicial or legislative institutions may acquire volition of their own and reinforce this process. There is nothing in ‘Islam’ that necessarily obstructs such possibilities. And supposedly ’obsolete‘ monarchies might yet be among the most successful types of regime in coping with such change.  相似文献

Nicetius of Trier was one of the most temperamental bishops to have a place in the writings of Gregory of Tours. In the tradition of St Martin, Nicetius represented one extreme of the relationship between ecclesiastical and secular authority in sixth-century Gaul. He stands out as an example of conflict between those two spheres, in both contemporary and modern portraits. This article attempts to place Nicetius within a tradition of episcopal behaviour that undermines the element of conflict. By focusing on the judicial functions that Nicetius fulfilled in the context of penance and oath swearing, it argues that Nicetius was less an extreme example of spiritual audacity than he was an exceptional model for commonplace virtues of the ideal bishop. The date 15 August 2015 marks the 10th anniversary of the Helsinki Peace Agreement, which ended a major thirty‐year conflict between the Free Aceh Movement and the Government of Indonesia. In this article I argue that much greater acknowledgement should be given to the creative responses that ordinary conflict survivors have brought to the process of post‐conflict social recovery. The article briefly discusses some observations on resilience made through 17 months of ethnographic fieldwork with Acehnese conflict survivors. I conclude that while Acehnese resilience is impressive, there remains a need for greater recognition of the experiences of conflict survivors, both to support justice for survivors and to enable a deeper understanding of ongoing political complexities in Aceh.  相似文献

The rubric of sustainable development has now gained wide theoretical and political acceptance in the global community. However, after the Rio Declaration, each nation must now confront the specific question of how to decide between those industries and activities that are sustainable and those that are not when conflicting social and ecological interests are at stake. Any fundamental change to resource allocation will have social distributional consequences, and the issue of justice therefore becomes a critical element of any sustainability formulation. This paper contributes to this debate by exploring the potential for a politically grounded theory of justice in and to the environment. More specifically, we argue for a situated analysis that nevertheless retains the postulate of a neo-Kantian universal ethic as the foundation for global institutions that could integrate and safeguard the principles of justice and ecological responsibility underpinning most notions of sustainability. We show this by locating the question of justice in a particular conflict of interest, that between the Australian mining giant Broken Hill Proprietary, Ltd., and the traditional landowners of an area on the Ok Tedi river in Papua New Guinea.  相似文献

ABSTRACT

This article examines the repositioning of the Catholic Church in the aftermath of the Philippine Revolution of 1896–98, during the transfer of Spanish to American colonial rule. It reviews the consultations between the outgoing Spanish bishops and the Vatican’s Apostolic Delegate, Placido Chapelle, in January 1900, and the subsequent religious settlement promulgated in the Vatican’s Apostolic Constitution for the Philippine Church, Quae mari Sinico, in 1902. The Delegate’s identification with the Spanish bishops and their opposition to Filipino nationalist aspirations and the Filipino secular clergy confirmed the anti-Filipino position of the Church in the American colonial period. Both the Filipino bishops and the American bishops opposed independence and distrusted the nationalist leaders as anti-clerical Masons. This is followed by a discussion of the claimed reconciliation of Church and Filipino political aspirations in the post-Vatican II period in the 1960s, which culminated in the Church’s role in bringing down President Ferdinand Marcos in 1986. Committed to a theology of social justice, the bishops now aligned the Church with progressive democratic nationalists. In its successful opposition to the Marcos dictatorship in the name of “People’s Power,” the hierarchy claimed that through the “Miracle of EDSA” the Church had identified with and indeed represented the political will of the Filipino people.  相似文献

The importance of international communication and media to the study of international relations has long been recognised. This paper focuses on coverage of the Arab-Israeli conflict in the late 1960s and early 1970s by the Reuters news agency, one of the most important international providers of news. The voluminous academic discussion of international media coverage of that conflict has related primarily to exploration of news content. This article breaks new ground by evaluating through archival documentation some organisational, commercial, and editorial aspects involved in the actual process of news production. It studies the efforts by Reuters to overcome staff ‘bias’ and market ‘sensitivity’ and to provide publicly perceived ‘objective’ coverage. This it does in respect of a conflict separating the political and emotional loyalties of media and institutional subscribers in the Middle East region and around the world. It examines in particular the problems created by the national affinities of local staff employed in the region and the effect of political considerations and market pressure on regional dissemination of media information.  相似文献

The article examines the contents and the historical background of five early specimens of diplomatic correspondence on the Pashtun tribal territories. Written in Persian by the Khatak chief Afzal Khān (d. circa 1740/41) these letters supplement the author’s Pashto account of his political conflict with the Khatak spiritual leaders, the sheikhs, in 1724. While in the letters the tribal chief appealed for judicial settlement of the conflict via legal procedure in the Sharia Court of Peshawar, in verbal negotiations he sought extrajudicial administrative arbitration or tribal practices of reconciliation according to the Pashtun customary law. The article conttrunains new materials for the historiography of Pashtun tribes and for comparative study of conflict patterns in Muslim tribal societies.  相似文献

Abstract

Quantitative methods of content analysis have become established in most subfields of political science, but remain relatively unutilized in studies of political theory, despite the exclusive focus of that subfield on textual sources. This article develops a variation of content analysis—termed usage analysis—and employs it to resolve a standing debate in scholarship on Cicero's political theory regarding the synonymy of the major Latin terms for the state (civitas and res publica). The resulting distinction between these concepts then informs an exposition of Cicero's ideal state not as the Roman Republic itself or the mixed constitution alone, but as a universal, everlasting political society supported by justice, a mixed constitution, and active citizenship.  相似文献

This article explores the ways in which the idea of social justice has been utilized during this century as an idée-force in Chilean politics. It stresses the Catholic background of the concept and shows how it has been adapted to the political objectives of several doctrinal streams. The idea of social justice has been a powerful ideological instrument for governments in their attempts to deal with the social expectations of the electorate and to create a broad consensus between different political and social sectors. This idea has also been historically related to an active state role in the search for equity through income distribution and the adoption of progressive social legislation. While the recent military government (1973-90) radically reformulated both the social function of the state and the official definition of social justice, the current democratic authorities seem to have readopted the idea of social justice as a key element in their ideological discourse.  相似文献

The ‘conflict between politics and justice’ has been a central feature of the Italian ‘transition’ for reasons that touch on the essence of the so-called Second Republic. Apparently dominating the political agenda, it also functioned as a cover for a resurgence of coercive forms of social control in Italy. In response to the social transformations taking place throughout the western world, from the late 1980s the Italian prison system had been expanding and was used to target social marginal groups, especially foreigners and drug addicts. This paper examines how these changes took place, the juridical measures that gave rise to them and their political motivations in the period from the crisis of the First Republic to the declaration of a ‘state of emergency’ in the prison system which (at least for now) seems to have brought to a close the openly populist use of the criminal justice system.  相似文献

Abstract. This article argues that the emergence and development of subaltern political process is a significant conflict dynamic found in the escalation of ethnic nationalist movements. These ethnie‐defined modes of political participation are in turn an expression of the autonomous nature of ethnic nationalism, but occur ‘underneath’ and often antecedent to the organised violence and militancy which distracts most analyses of these conflicts. The article discusses this process of insurgent political mobilisation as a response to the structural paralysis of the post‐colonial state, using the ethnic nationalist conflict in Indian Jammu and Kashmir as the central case study. In its discussion of this case, the article seeks to argue that the presence of such subaltern political process provides additional empirical evidence of the autonomous nature of ethnic nationalism, and its capacity to carve out alternative options for democratic action and popular participation.  相似文献
