Tribute to Justice Souter

When the U.S. Supreme Court Justices took their seats at the beginning of the 2009 Term, the Bench looked different. Gone from the Bench, after nineteen years, was David H. Souter. He returned to his home in New Hampshire, a state he likes enormously. Justice Souter will be missed by his former colleagues and by advocates before the Court, by legal scholars nationwide and by all who follow the Court's work and activities.     

Tribute to John Paul Stevens

Justice Stevens is supposed to be older than I am, but the evidence is mixed. I remember one morning back in June of 2009, for example, when he and I happened to get to work at just the same time. I was in a suit, but John was still in tennis shorts, after one of his four weekly singles matches at 7:00 a.m. (He usually arrived in civvies.) I asked him, how’d the game go. There was a little victory leap. “I really beat him.” John's a player.     

Tribute to William H. Rehnquist

The casket was plain unvarnished pine, and over it was draped the American flag. As my fellow Rehnquist clerks and I carried that casket up the marble steps of the Supreme Court building, to the Great Hall, it occurred to a number of us that this was very fitting. For Chief Justice William H. Rehnquist was direct, straightforward, utterly without pretense—and a patriot who loved and served his country.

Abstract

The origins of the neonatal neurological examination are described with their common basis attributable to evolutionary theory, the classical neurosciences, clinical neurology, and developmental psychology. It is shown that not only have the techniques of the bedside examination changed over the past half century but the purpose of the examination has also evolved; initially the examination was used to assess maturation of the developing infant, now it is used to determine whether cerebral pathology may be present and whether examination abnormalities are helpful in outcome assessment. The development of several of the current neonatal neurological examinations are reviewed and their clinical and scientific basis examined.

In his carrier as physician, Sigmund Freud claimed various and surprising successes in healing patients. An evaluation of those cases in which evidence independent of Freud's publications has been discovered reveals a lifelong pattern of Freud claiming successes, patients, however, not being cured, and Freud being aware of this. The elements of this pattern are matched with the components of the legal definition of fraud.
