Abstract

Numerous new bridges were needed when the railway line from London to Holyhead in Wales was built in the 1840s. The project's chief engineer, Robert Stephenson, chose a cast iron girder design to cross the river Dee just outside Chester, and the bridge was finished in November 1846. About six months later, on 24 May 1847, a local train was crossing the final span when one of the girders failed suddenly, sending most of the train crashing into the river below. Five lives were lost. The accident created a national furore, and Stephenson came close to being accused of manslaughter for the design. We have reviewed the witness evidence and concluded that the bridge probably failed by fatigue due to a defect at a sharp corner in a flange on a girder. The corner was present in a cavetto moulding, which had presumably been added as an artistic flourish.  相似文献

Abstract

The Alcester Waterworks Company supplied a small town in Warwickshire with water from 1879 until 1947. Always a miniscule concern, the company used very simple technology throughout its existence. The introduction of a gas engine as a replacement for a waterwheel as a source of power for pumping produced a reduction in pumping expenses which transformed the company's financial affairs. The surviving remains of the company's installations give a picture of the simple technology used and allow some tentative conclusions to be made about the causes of the difficulties with pumping which the company experienced in its early days.  相似文献

Abstract

The extent of customary land in Samoa and the laws pertaining to its protection create a presumption of state dependence on the regulation of custom in effecting state policies within local contexts. The principal means of regulating custom in Samoa has been and continues to be through state court adjudication of conflicts over customary land and chiefly titles. The transitive nature of ‘custom’ and conceptions of ‘custom’ in Samoa created an opening for court influence in the construction of custom, if not custom's partial reinvention through the agency of the courts. This occurred principally through the courts’ privileging principles of English common law in confirming asserted land rights generally considered unenforceable at the time of Samoa's political partition. The courts re‐interpreted as customary, conceptions of land rights the colonial state's influence attempted to effect within Samoan society. But the source of the changes, and the courts’ role in promoting them, tended not to be equally reflected upon. To the extent such influence is ignored in analyses of Samoan land tenure and customary law, and reproduced within state policies and court adjudication of conflict, custom's social construction is left unexamined, assumed to be more general than it is, and likely to exacerbate tensions and conflict within Samoan society rather than reduce them.  相似文献

ABSTRACT

Amongst Britain's former colonies the independent countries of the Commonwealth Caribbean represent something of an anomaly in so far as the majority of them remain constitutional monarchies and continue to retain the Judicial Committee of the Privy Council (JCPC) as their final appellate court, even though the region has had its own final appellate court – the Caribbean Court of Justice – since 2006. This is in marked contrast to Britain's former colonies in Africa and South Asia, the majority of which switched to republicanism soon after independence and at the same time abolished rights of appeal to the JCPC. This paper seeks to uncover the reasons for this anomaly by examining how the path that led to independence was shaped by a particular conception of Dominion status and by the willingness of nationalist leaders to embrace a dual identity: equal parts West Indian nationalist and Empire loyalist. It will also examine the phenomenon of the ‘postcolony’; being the persistence of the colonial order following the acquisition of constitutional independence. The paper has three aims. Firstly, to contribute to a better understanding of the impact of Dominion status and all that it symbolised in a region which is often overlooked in the scholarly literature on this topic. Secondly, better to understand the competing political forces that led three countries in the region to adopt republicanism, but inhibited its adoption elsewhere in the region. Thirdly, and finally, to enhance discussion of the complex nexus between republicanism and the abolition of rights of appeal to the JCPC where political and juridical considerations do not neatly align.  相似文献

Abstract

This article examines the South African Islamic anti-apartheid organisation, the Call of Islam, in order to understand how progressive South African ‘ulama navigated the contested territory of Islam through an interpretation of the Qur'an that demanded a Muslim alliance with the oppressed in the anti-apartheid struggle and a South African Islam. The emergence of the United Democratic Front (UDF) in 1983 in reaction to the apartheid government's Tricameral Parliament created a space in which South African Muslims could enter the national anti-apartheid struggle according to their religious rather than ethnic identity. To illustrate the historical development of the Call of Islam and its affiliation with the UDF, the article will first outline the formation of the UDF in the Western Cape, the geographical area with the largest concentration of Muslims in South Africa. The focus will then turn to the impact of the UDF on the Cape's Muslim community, particularly the divide that developed amongst its ‘ulama over the stance of Muslim participation in the anti-apartheid struggle. The following section will analyse the emergence of the Call and how the questions of its founders concerning the religious Other led to an examination of Islam in its South African context. The final section will then look at the sources that the Call used to show it was indeed because of their South African Islam that they affiliated with the UDF and the oppressed.  相似文献

Abstract

Red, in all its various shades, was a colour with many associations at the court of Henry VIII. This article presents a thematic analysis of the key circumstances when red clothing was worn at Henry VIII's court, namely the robes worn at sessions of parliament by the nobility and secular clergy, the livery issued at coronations, as well as livery given to members of the king's household and his army in 1544. In addition, the king wore red for key days in the liturgical year as his medieval predecessors had, while it also formed part of his everyday wardrobe. Red was also significant for others at the Henrician court, including the secular and ecclesiastical élite. As such, it was a colour that was associated with wealth, status and parliamentary authority.  相似文献

Abstract

This article examines the experiences of former pupils at the Foundling Hospital who served as British Army regimental bandsmen. It is based on interviews conducted by the author, published written accounts and documentary evidence in the Foundling Hospital Archives. The formative experience of institutionalisation at the Foundling Hospital is considered in the first section. The second section describes the transitional process of leaving the Hospital and enlisting in the Army. The final section discusses institutional experiences in the Army and how these affected the former pupils' life choices. It will be argued that the Hospital's authoritarian regime placed significant limitations on the children's social horizons and produced a strong orientation toward institutional life. It will be shown however, that the experience of serving in Army bands at a time of tremendous social change allowed former pupils featured in this study to make alternative life choices which short circuited this institutional bias.  相似文献

Abstract

'Adversarial Map-Making in Pre-Reformation Lancashire'. A map in the National Archives dated to 1531 showing part of the Fylde in Lancashire has been published on several occasions; but its relationship to another map in the National Archives has not previously been recognised. These two maps were made by the opposing parties in a dispute before the court of the Duchy of Lancaster, and may be the earliest examples of adversarial map-making in a case before an equity court. The case concerned land which had apparently long been regarded as intercommon, but which was now being claimed to be in exclusive ownership. The newly recognised map was made to illustrate recently acquired documentary evidence as to the ownership of the land in question. This map appears broadly trustworthy, and was accepted as such by the court; but the defence map seems rather to have been designed to mislead. In recent years the defence map has been regarded as evidence for the appearance of the locality concerned in the 1530s, but this study shows that it was in fact regarded by the court as unreliable, thus highlighting the need to treat all maps other than those actually commissioned by the courts themselves as partial and therefore suspect.  相似文献

Abstract

This essay examines late nineteenth- and early twentieth-century handcrafted Irish lace as material object related to both its conditions of production and its consumption with an emphasis placed upon the consumption of what was consistently referred to in the contemporary press as 'real lace'. Why, for example, would a woman specifically choose handmade Irish lace for her elegant court gown or bridal costume? What might have influenced a consumer to select Irish lace rather than imported lace? Did the wearing of 'real' Irish lace have any symbolic or social meaning beyond adornment? Might the relationship between patrons and workers be viewed through the lens of today's fair trade movement, thereby expanding the consumers' intentions and complicating the workers' conditions?  相似文献

ABSTRACT

This article highlights the importance of various (im)mobilities that were induced by the massive 7.8-magnitude earthquake that struck Nepal on 25 April 2015. It analyzes over 120 news articles published in the immediate aftermath of the earthquake, arranging these into a mobility-centric narrative that highlights the politics of movement in the disaster’s wake. Drawing on the theoretical and methodological “mobilities turn”, I introduce the concept of linked (im)mobilities to demonstrate the complex dialectics structuring (im)mobilities after the disaster. More specifically, Nepal’s post-earthquake (im)mobilities intersected with one another and with a variety of geographic and political factors to produce a mutually constitutive web of contingent movements. Attending to these not only underscores the centrality of (im)mobilities themselves. By raising questions of scale, inequality, bordering, and “islanding”, the approach advanced here widens our analytical frame. It offers a conceptual architecture capable of encompassing more factors (beyond mobility), thereby facilitating a broader understanding of the disaster event and its various outcomes.  相似文献

Summary

In this article, I seek to develop a genetic/diachronic approach to the phenomenon of authorial revision, and to the interpretation of texts that exist in multiple versions. In all such cases, the reconstruction of textual meaning cannot be separated from the reconstruction of the process through which the text in its ‘final’ form came into being; furthermore, an understanding of the author's intentions in (re)writing cannot be entirely separated from an understanding of his/her motives for (re)writing. This article is divided into three sections. In the first section, I consider recent trends in editorial and literary theory that aim at characterising texts in terms of processes rather than products, in order to uphold the equal dignity of each version without losing sight of its connectedness to other stages in the history of the text. In the second section, I discuss how Quentin Skinner's views on meaning and context apply to cases of authorial revision, and I suggest that some key aspects of Skinner's contextualism need to be reconsidered. In the concluding section, I focus on a case study in order to demonstrate the operational value of such a genetic and motive-based approach to authorial revision: more particularly, I seek to show how a close examination of Jean Bodin's rewriting practices in the Methodus (1566–1572) and the République (1576) can throw new light on his shift from a concept of limited sovereignty to one of absolute sovereignty.  相似文献

Abstract

A considerable number of I. K. Bruner's railway bridges are still operational, varying in size from the great Royal Albert Bridge over the Tamar to a host of small masonry bridges for accommodation roads over or under his broad-gauge main lines and subsidiary routes like the Taff Vale Railway. There were, however, few bridges built by him apart from his railway works, and it could have been safely assumed that all such bridges which survive would have been clearly recognized as having been built by him. Yet this has not been so with one particular road bridge, for which Bruners responsibility has been either doubted or ignored, even though it survives in excellent working order. The Egyptian time system of dividing the night into 12 “hours” so that the length of the “hour” varied with the seasons made the perfection of any clock difficult. However, the flowerpot-shaped outflow water-clock possibly invented by a court official, Amenemhet, during the reign of Amenhotep I, had the potential of being accurate to within about 15 min. While there is good evidence that the decan star-clocks were used to indicate astronomical night (that is the hours between sunset and sunrise, excluding twilight) our analysis of the Karnak clock suggests that water-clocks of the Eighteenth Dynasty may have been used for timing civil night (sunset to sunrise). Our analysis of the later Ptolemaic water-clock fragments indicates that they were used in Lower Egypt and that they also timed civil night. The Ptolemaic outflow water-clocks were basically the same as the earliest known water-clock described in Amenemhet's epitaph, modified in height and monthly scales for use in Lower Egypt. Ktesibios' invention of a simpler and generally more accurate inflow water-clock, of which there is only one very late Egyptian example, probably quickly supplanted the outflow clock.  相似文献

Abstract

After virtually every major disaster of the last decade there has been a full scale investigation resulting in a lengthy report and a comprehensive list of recommendations. The philosophy of this investigative process, as it is for those incidents with less serious consequences, is that we must learn from experience to prevent future crises from occurring. However, there are barriers to such learning in organisations. This review discusses the different approaches to safety and attempts to show how such 'safety cultures' influence an organisation's attitude to safety management. Three safety cultures are outlined: occupational safety management, risk management and crisis management. Each of these cultures is then linked to a different underlying model of human error causation. This review illustrates how the model of human error causation adopted by an organisation has a profound influence on its choice of remedies for accidents and on its ability to learn from near misses (failures without serious consequences). It is argued that there are major benefits to be gained if an organisation adopts a system induced error perspective on the human error causation. Some of the problems which can occur when an organisation tries to respond to a safety issue are described. These include: overconfidence, an inappropriate emphasis on hardware reliability, a reductionist approach to finding a solution, complacency, and the failure to identify the underlying causes of the accident. A number of major accidents (the Clapham rail crash, the Zeebrugge ferry disaster and the Hillsborough Stadium tragedy) illustrate the key points of the theory.  相似文献

Zechariah's first vision (Zech 1,8-17) and its portrayal of angelic beings offer important criteria for determining earlier shapes of the cycle of the night visions. At a primary level, the first night vision consisted of a question-answer communication between the prophet and a celestial messenger designated ??? (1,8.9a.10.11b). At the next stage the angelus interpres had been added, partly absorbing the function of the ??? (1,9b.14), before the angel of Yhwh was inserted (1,11a.12-13). The first part of the paper deals with the general impact of archaeological and anthropological theories on law. The more specific problems related to the use of archaeological and anthropological evidence in aboriginal rights litigation are the subject of the second part. Abstract

Operation Chastise, more often known as the 'Dambusters raids', was one of the most audacious aerial military operations of the Second World War, in that it made use of operationally untested technical innovations under extreme logistical constraints. Of particular interest is the scientific environment in which the mission was implemented. Here I review the principal scientific innovations that were necessary for the realisation of the mission. These went beyond the rotating depth charge itself. Simple but nevertheless ingenious methods for altitude and range finding were devised for low altitude flying, and the new system of two stage blue day–night flying was implemented for simulated night flying. Even drugs to combat airsickness during low altitude flight in turbulence were tested. The diverse technical expertise that was necessary for the original idea to be transformed into a logistical reality in less than three months provides a particularly lucid instance of effective scientific management in a framework of rapid technological change. I also describe an expedition inspired by these developments, which fifty years on used a dedicated low altitude night flying microlight aircraft (the Barnes Wallis Moth Machine) to catch insects over a rainforest canopy, illustrating the legacies that such missions can leave.  相似文献

This article concerns itself with the Buddhist doctrine of upāya (“skilful means”). Rather than provide a historical analysis of the concept, this paper first of all outlines some of the presuppositions that affect both its working in a traditional Buddhist context and its interpretation in modern academic enquiry. It is argued that these contexts differ significantly and that they lead to quite different understandings of the role and function of the concept itself. Then, through reference to the Tibetan dGe lugs pa tradition and the background of Tibetan doxography, it is suggested that there are certain dangers in over‐emphasizing the concept of upāya in isolation. Most notably, if the doctrine of upāya is simplistically posited as some sort of aphilosophical praxis against rational enquiry, then there is a danger of not taking the tradition's own scholastic endeavours seriously enough and downplaying the status of rational enquiry in the tradition itself.  相似文献

ABSTRACT

Established as a multiethnic and multilingual empire, the Qing dynasty used Manchu, Chinese, and other languages in its government. Influenced by nationalism, the court attempted to establish Manchu as the “national language.” Yet over time, the “national language movement” resulted in Chinese being adopted as the “national language.” Occurring in the twilight years of the Qing, this transition reflected the moribund fate of the Qing empire against the rising tide of Chinese nationalism at the turn of the twentieth century.  相似文献
