This paper analyzes the previous decade of governmental extractivism in Colombia, designed and imposed through two main power mechanisms: legislation and securitization. In examining the government's disposition and the territorialized settings of mining control, I identify two official architectures of rights: one supporting the private accumulation of capital through the foreign exploitation of mining resources and the other aiming to concede ethnic rights. While the two architectures compete in the juridical arena, a violent dispute has developed in the overlap between the geographies of mining concessions and the geographies of ethnic communities within the territorial settings of mining control. Legal and illegal military securitization has emerged as a complementary mechanism for territorial control. By looking at the case of La Toma in the Alto Cauca region, I conclude that the country's previous two presidencies have actively promoted differentiated access to and control over land-based resources, excluding Afrodescendant communities from accessing the environmental goods in their territories while favouring private actors.  相似文献

When the British Admiralty announced in January, 1854 that it intended to strike the names of the officers of Sir John Franklin's missing polar expedition off the active Navy List, it had years of legal precedent to support its right to do so. The Board used such precedent to its advantage in ending a search its members had considered fruitless since 1849, the year the expedition's food would have run out. However, in their treatment of the widows made from that decision, Board members consistently pushed against established practice in order to do what they felt was right: to give the widows as generous a pension as the Treasury would approve, and to do so in defiance of the strict rules of eligibility. In 1844, only months before Franklin and 128 men set forth to discover the Northwest Passage, new eligibility guidelines were set that both limited women's access to pensions, and hampered the Board's ability to grant them. Archival evidence that forms the core of this article shows, however, that compassionate treatment of the expedition's widows was central to all discussions of how the Admiralty might move forward on the Franklin disaster, between promoting officers in absentia in order to augment pensions, to waiving the need for proving the date of death in order for families to collect the explorers’ back pay. As this article argues, the 1854 Admiralty Board had powerfully split loyalties: on the one hand, as the press acknowledged, the Board had a duty to perform on behalf of the public, to avoid wasting the nation's money on frivolous or useless searches for men assumed to be long dead; on the other hand, it felt equally strongly the obligation to support those widows who were the product of such imperial adventuring, even in defiance of its own rules. Through an analysis of legal precedent, Naval Instructions, and private Admiralty Board documents, in the case of the Franklin expedition's widows one can perceive a few naval administrators who tried to keep some of the nation's most vulnerable citizens in view even as they managed the bottom line.  相似文献

The great land rush of the eighteenth and nineteenth centuries saw vast swathes of temperate grazing land around the world pass into private hands. Commons and common lands, however, provided a vital interim mechanism in this shift from state control to private property ownership. Commons ensured continued and widespread access to natural resources, including water, minerals, soil, grass, and timber, that was integral to the colonial settler project. The gold rush in nineteenth‐century Victoria sheds important light on this process, where almost 250,000 ha of Crown land were set aside as goldfields commons. These reserves maintained auriferous or gold‐bearing land in public hands and provided access to extensive tracts of grazing for the sheep and cattle of gold miners. In this paper, we examine how the traditional English notion of common lands was transferred to a New World environment and draw on the work of economist Elinor Ostrom to evaluate the use and function of Victoria's goldfields commons in terms of management, regulation, and sustainability.  相似文献

In 2002 the Colorado Supreme Court reversed decades of precedent in Lobato v. Taylor by awarding Hispano heirs to the Mexican-era Sangre de Cristo Land Grant renewed access rights to that grant's former communal land for grazing, timber, and firewood. Placing Lobato in historical context, this paper examines the contingent emergence of sovereignty and private property in the San Luis Valley of Southern Colorado through acts of violence, land loss, and dispossession. The paper argues that sovereignty and property, as forms of boundary drawing, are unfinished and contested projects rather than abstract, achieved universals. U.S. sovereignty in the San Luis Valley has emerged contingently through the iteration of private property, as struggles over resource access have produced sovereign effects. Such a perspective makes visible how Lobato has reiterated private property rights and U.S. sovereignty in ways that create new exclusions, even as the case returns access rights to the commons.  相似文献

Throughout 2006, Commissioner Terence Cole QC conducted an inquiry into the involvement of Australian companies in the United Nations' Oil-for-Food Programme in Iraq. The inquiry generated headlines about sanctions-busting behaviour on the part of AWB Limited and whether or not government ministers knew or should have known what was happening during the life of the Programme from 1996 to 2003. An element of the scandal that has received little attention is whether AWB Limited's behaviour was actually that extraordinary, given its status as a private company whose obligation to its shareholders was to maximise profits and which, had it not complied with the Iraqi government's demands to bypass the sanctions regime, could have cost the company a very important market. Drawing on the sanctions literature, this paper examines an essential problem at the heart of sanctions implementation; namely, that while states sign on to these international obligations, it is private companies and individuals that generally bear their cost. The paper considers legislative changes prompted by Commissioner Cole's Report but emphasises their limitations. A key and persistent difficulty for Australia and other states is that enforcing their international obligations depends on the goodwill and integrity of private actors.  相似文献

A noted specialist on Russia's industries surveys the restructuring of Russia's steel industry in response to the challenging conditions of the 1990s (collapsing domestic markets, the nonpayments crisis, and insider privatization) and its subsequent stabilization during the early years of the 21st century due to effective implementation of a "survival model" at many plants. The author examines the major elements of that model, namely an export orientation made possible by relatively low labor and energy costs, reliable access to basic raw materials, a focus on crude (rather than specialty) steel, not inconsequential investment in process modernization, and effective control exercised by new private ownership. The paper's concluding section explores the new challenges faced by the industry due to the global financial crisis of late 2008-2009, and particularly the decline in world steel and company share prices, the extreme tightening of credit, the difficulties of servicing existing levels of debt, and provisions of a government assistance program that appear to preclude major capacity closures as a means of reducing costs. This study investigates the revitalisation of the main street of Beyoglu, which was the westernised part of Istanbul's CBD in the nineteenth century. Beyoglu started to develop in the sixteenth century with the introduction of embassy buildings of European countries. Its development reached a climax during the nineteenth century as a result of increased European trade and cultural influence, remaining the most distinguished quarter of Istanbul until the 1960s. Thereafter, it suffered from decay, disinvestment and abandonment as a result of later suburbanisation and the multi-centre development of Istanbul. Revitalisation of the quarter started with the pedestrianisation of the main street. This study investigates the functional transformation and changes in land prices along the main street and surrounding neighbourhoods after the pedestrianisation. The factors which effect land prices are investigated by the use of regression analysis. According to the results, access to mass transit is the most important factor. Besides its convenient central-city location, with easy access to the city's main transportation arteries, no doubt also its distinguished architectural character contributed to its revitalisation. Although the revitalisation of the main street as a cooperative movement of public and private sectors, effectively, it was a market-lead restructuring afterwards. At the same time, international companies opening up stores reflecting the globalisation movement increased the attractiveness of the main street. The results of the study can be used by urban planners, policy-makers and investors for the revitalisation of other historical neighbourhoods in Istanbul and other cities. For further research, hierarchical analysis of spatial impacts of revitalisation areas is suggested.  相似文献

Within the context of Arctic geopolitics, the article focuses on British policies toward Spitsbergen or Svalbard over the past century. The 1920 Spitsbergen Treaty accorded Norway sovereignty over the archipelago, but it gave other signatories, including Britain, non-discriminatory access to its natural resources. It is argued that while geopolitical interests have played a role in Britain's policy-making, its main rationale has been a determination to use international law to protect pre-existing mining rights and potential future oil rights in the Svalbard area. Apart from Russia, Britain has been most active in challenging Norway's interpretation of its sovereign rights, especially the view about the treaty's non-applicability to Exclusive Economic Zones and continental shelves. It is shown that the Britain's economic focus was tempered during the Cold War by the need for Western solidarity and for supporting Norway's resistance to Soviet Spitsbergen claims. But having been instrumental in watering down Norway's sovereignty provisions in the negotiations on the Spitsbergen Treaty, Britain has never been prepared to abandon its interpretation of the treaty's stipulations on natural resources and equal access to the archipelago's maritime areas.  相似文献

Mobility is the keystone of the ‘new’ regional geography. Attention is drawn to the outpouring of work on travellers throughout history. Surprisingly, little mention is made of geographers who have crossed borders, been immigrants and have engaged in writing about movement. As is evident from Peter Scott's pocket log diary of air travel and airports, there is scope for a study of the whole range of spatial practices of individual geographers through an examination of maps, diaries, stories, books and television programs. As all geographers are travellers, it is perhaps more appropriate to create the spirit of the time so that we can position ourselves in the bigger picture and enjoy our private reveries. This paper, therefore, seeks to recreate the air transport geography of the mid-1960s and to list key changes over the following thirty years, before examining air transport geography in the mid-1990s. The European Union's (EU) pledge to assist private sector development (PSD) in the African, Caribbean, and Pacific (ACP) states is a key pillar of its bilateral trade relationship with former colonies. It is this ostensible support to PSD that allows the EU to contend that its pursuit of market opening in ACP countries under Economic Partnership Agreements (EPAs) is not detrimental to human well‐being in low‐income countries, in spite of risks of import flooding and EU monopolization of emerging sectors. This article explores the legitimizing ‘development’ rationales of EU PSD frameworks from the perspective of stakeholders in a strategic site of private sector activity in the ACP grouping. Specifically, it explores Europe's PSD agendas from the standpoint of investors, managers and workers in Uganda's cut‐flower sector, which is domestically seen as one of the sectors most likely to bring economic benefits to Uganda. Based on interviews with stakeholders in the industry, the article explores whether actors in this business sector concur with the underlying ‘pro‐poor’ rationales of Europe's PSD framework and whether Europe is seen as a meaningful partner in this prioritized site of private sector activity.  相似文献

Agricultural and rural land has become the site of considerable policy, governmental and scholarly concern worldwide because of violence and dispossession, food insecurity and contests over private property regimes. Such issues are highly gendered in territories with majorities of indigenous populations where overlapping legal regimes (statutory, multicultural, customary) and histories of dispossession have created complex spatialities and access patterns. States' formalization of indigenous rights, neoliberal restructuring and land appropriation are the backdrop to Ecuadorian women's struggles to access, retain and pass on land. Despite a burgeoning literature on Latin American indigenous territories, women are often invisible. Using collaborative research among two indigenous nationalities, the article analyses the political–economic, legal and de facto regimes shaping women's claims to land and indigenous territory. Focusing on Kichwa women in the rural Andes and Tsáchila women in a tropical export-oriented agricultural frontier area, the article examines the criteria and exclusionary practices that operate at multiple scales to shape women's (in)security in tenure. Women's struggles over claims to land and territory are also discussed. The article argues that Latin America's fraught land politics requires a gendered account of indigenous land–territoriality to unpack the cultural bias of western feminist accounts of multiculturalism and to document the racialized gender bias across socio-institutional relations.  相似文献

ABSTRACT

This paper argues that even when India had posited its peaceful nuclear explosion (PNE) of May 1974 as a mark of resistance against a prejudiced nuclear order based upon the NPT, India's policies in the post-PNE period confirmed with many aspects of the emerging non-proliferation consensus. India's response was guided by two major factors. On one hand, were its long-held principles such as the right to peaceful uses of nuclear energy (including PNE's) and the right to nuclear technology cooperation for peaceful purposes. On the other hand, were the pragmatic policy choices it had to make as advanced nuclear states worked towards a stricter non-proliferation regime. In this struggle between India's principles and its necessities, India's nuclear behavior was guided much more by pragmatism rather than by its normative preferences. Yet, even when India made major compromises on its nuclear principles in private, in public India stuck to the rhetoric of its principled opposition to the NPT regime. These tensions between India's actual practice and its public policy are evident on three major non-proliferation issues: nuclear safeguards, export controls and the danger of nuclear proliferation in its neighborhood.  相似文献

As a nascent air force, the Australian Flying Corps (AFC) relied largely upon other services for medical evaluation of its personnel. In 1918, however, the AFC experimented with a dedicated medical board to gauge the suitability of recruits and convalescents as aircrew. This article examines the formation of the AFC’s Medical Board, which was paired with another innovation: laboratory research. Conducted by the board’s head, Charles Kellaway, animal studies into anoxaemia were intended to provide a means of determining suitability of aviators for high-altitude flight. In matching data derived from cats with front-line service conditions, Kellaway sought to enshrine a particular type of ‘steady’ man to conquer the novel realm of airspace.  相似文献

Women’s history for Árpád-era Hungary (1000–1301) has generally been restricted to legal issues and the royal court. This study addresses these deficiencies by examining women in the Register of Várad in regard to three areas of investigation: marriage practices and the involvement of the Church, access women had to property and the access women had to authority. Evidence from the register indicates that by the thirteenth century, ecclesiastical ideas regarding marriage were barely making themselves felt. Ideas of consent and even the indissolubility of marriage were at times unimportant. Though priests were occasionally present at marriages, their role was not decisive. Women had three primary means of obtaining property. They could receive gifts or dower on the event of their wedding, and they could receive a portion of the patrimony. This inheritance was termed the quarta filialis as it amounted to no more than one-quarter of the father’s property. These gifts came under the control of the woman’s husband, and she could not access them until his death. Widowhood combined with guardianship of a minor son could allow women to exert considerable power and, just as elsewhere in Latin Europe, women’s access to public and private authority most approximated that of men’s as a widow. Not all women, of course, had access to such power. The Register of Várad shows numerous instances of women slaves who were under the complete control of their master.  相似文献

This article examines the extent to which home–based production in the garment sector of Ahmedabad, India, serves to empower its female participants, defining empowerment in terms of control over enterprise income and decision–making within the household. It places this question within the literatures on resource theory and bargaining models of the household, both of which posit that improved access to resources increases women's power in the household. This study highlights why access to resources may not lead so directly to improvements in women's position in the household in the Indian context. It then discusses why home–based work may be less empowering than sources of work outside of the home. The arguments about the empowerment potential of women's access to resources through home–based work are tested by examining, first, the determinants of control over the income generated by women in home–based garment production and, second, to what extent access to and control over income from this source translates into involvement in decisions which are atypically women's and yet important to their lives. The results provide a better understanding of the potential of home–based work to offer women in urban India a source of economic activity that also can translate into increased intra–household power.  相似文献

In Poland, similarly to other Central and Eastern European countries, the development of the biotech industry dates back to the late 1980s, when the first private companies were established. The political and economic transformation of 1989 enabled mass development of private enterprises, but over the course of 20 years of development, only a couple of dozens biotech firms have emerged in Poland. The spatial evolution of the industry shows a strong concentration in Poland's six largest urban centres, which are characterized by the best scientific base, access to financial capital, and a well-developed local entrepreneurial culture. Given that all biotech clusters are also important centres of the pharmaceutical industry, despite the fact that there are no strong direct relationships between Poland's biotech and pharmaceutical companies, the authors of this paper put forward the thesis that the institutional environment of the pharmaceutical sector also affects the development of the biotech industry.  相似文献

This paper explores the mythic domesticity encoded in the Children's Quarter in Golden Gate Park, San Francisco. The play area, opened in 1888, represented a new genre of gender-specific public space developed in urban parks in the late nineteenth century. In welcoming women to the public domain of the urban park, gendered spaces such as the Children's Quarter signified a complex response to changing class and gender identities in the nineteenth-century city. Imposing a domestic structure on women's public presence, the Children's Quarter modeled a middle-class domestic ideal, affirming women's essential association with the private sphere even as it welcomed them to the public sphere of the urban park.  相似文献

One of the unexplored themes in the career of Mountbatten is why more use was not made of his services in similar contexts in the years after his Indian viceroyalty and governor-generalship. This article examines his influence in private and unofficial capacities in his dealings with post-independence India and Burma in the 1960s and early 1970s. In India it considers Mountbatten's efforts on behalf of the Indian princes when Indira Gandhi's government threatened their privy purses and privileges. In Burma it discusses Mountbatten's attempts to persuade Burma to return to the Commonwealth and his influence over General Ne Win, Burma's military ruler. Mountbatten was unsuccessful in both cases. By contrast in Burma, Princess Alexandra was better placed to represent British interests, suggesting perhaps that we should look more closely at the role of members of the royal family in promoting Britain's foreign policy.  相似文献

For over 10 years, North Korea has undergone a severe economic crisis, including food shortages, which has inflicted great suffering upon the North Korean people. Given such dire realities, it is beyond all doubt that the North Korean government should actively carry out comprehensive economic reforms as quickly as possible which aim to transform North Korea's present inefficient socialist planned economic system into a market economic system. Many argue that such reforms would give rise to successful economic growth in North Korea, which could enhance the legitimacy of the North Korean regime. Yet, the North Korean regime has consistently avoided implementing economic reforms, even though it has had a number of opportunities to do so. The July 1st reforms, which were introduced in 2002, have been half-hearted and inconsistently applied. This then raises an important question: Why has the North Korean government avoided adopting comprehensive economic reforms? In other words, what is the crucial barrier that has hindered North Korea's implementation of economic reforms? This article pinpoints North Korea's unique political system—i.e. its monolithic system of political control and policy making which exhibits the highest level of power concentration in one individual among all political systems—as the biggest barrier to economic reforms. No doubt North Korea desperately needs comprehensive economic reforms, in light of its economic crisis and food shortages. Nonetheless, the current North Korean regime has avoided adopting such reforms since they will undermine North Korea's monolithic system. In conclusion, North Korea's monolithic system has been the biggest obstacle to North Korea's economic reforms.  相似文献
