George Washington's religious beliefs have long been debated by scholars, who have insisted that he was anything from a devout Anglican to a Deist. This study argues that he was neither, instead contending that Washington had Latitudinarian tendencies, and that while he believed in God, he was not otherwise particularly religious. As some with Latitudinarian affinities, he showed no preference among varying creeds or forms of worship despite his Anglican upbringing. His personal beliefs also intersected with his stance on public religion. Washington favoured broad religious liberty for Christians and non‐Christians alike, reflecting his Latitudinarianism because he believed that denomination, dogma, doctrine, and creed were insignificant, and that it was up to the individual to decide the best way to worship God.  相似文献

Scholars have long debated John Marshall's intent in his famous opinion in the case of McCulloch v. Maryland (1819). Despite long-standing disagreement concerning the character of Marshall's nationalism and federalism, interpretations of the opinion typically rely on an incomplete picture of the case. This analysis revisits McCulloch to illustrate his support for national and state sovereignty as defined in the Constitution. It then moves beyond the opinion itself to examine Marshall's defense of McCulloch in a series of newspaper essays he authored in the aftermath of the case. Situated alongside the McCulloch opinion, these essays show that Marshall was as much concerned with defending the sovereignty of the Constitution as he was with adjudicating political authority between national and state governments.  相似文献

This analysis of Associate Justice Stephen Breyer's jurisprudence proceeds from his first book devoted to this subject, Active Liberty, a term he derives from Benjamin Constant and that Breyer defines as participatory democracy. Active Liberty and two subsequent books, as well as numerous off-bench writings, explain his jurisprudence of pragmatism, an approach he contrasts with originalism. This article addresses three general questions: Is Breyer's jurisprudence, founded on active liberty and pragmatism, fundamentally consistent with the design of the Constitution? Does his jurisprudence support his opinions in the constitutional decisions examined, a number of which are also treated in his books and articles? In a system that is designed to empower and to limit government, do his jurisprudence and judicial decisions constrain judges? This last question is especially important because of Breyer's thesis “that courts should take greater account of the Constitution's democratic nature when they interpret constitutional and statutory texts.” Breyer believes that his theory of active liberty ameliorates the democratic anomaly between a system “based on representation and accountability” that at the same time entrusts “final or near-final” authority to unelected judges who are insulated from public opinion.  相似文献

An unresolved debate in Bentham scholarship concerns the question of the timing and circumstances which led to Bentham's ‘conversion’ to democracy, and thus to political radicalism. In the early stages of the French Revolution, Bentham composed material which appeared to justify equality of suffrage on utilitarian grounds, but there are differing interpretations concerning the extent and depth of Bentham's commitment to democracy at this time. The appearance of Rights, Representation, and Reform: Nonsense upon Stilts and other essays on the French Revolution, a new volume in The Collected Works of Jeremy Bentham, containing definitive texts of Bentham's writings at this crucial period, offers an opportunity to reassess this debate. First, Bentham's most radical proposals for political reform came not in the so-called ‘Essay on Representation’ composed in late 1788 and early 1789, as has traditionally been assumed, but in his ‘Projet of a Constitutional Code for France’ composed in the autumn of 1789, where he advocated universal adult (male and female) suffrage, subject to a literacy test. Second, it may be doubted if the very question as to whether Bentham was or was not a sincere convert to democracy is particularly helpful. Rather, it may be better to see Bentham as a ‘projector’ during this period of his life. Third, the nature of Bentham's radicalism was very different at this period from what it would become in the 1810s and 1820s, for instance in relation to his commitment to the traditional structures of the British Constitution. Having said that, his attitude to the British Constitution remained complex and ambivalent. At his most radical phase, in the autumn of 1789, he advocated wide-ranging measures of electoral reform while at the same time harbouring aspirations to be returned to Parliament for one of the Marquis of Lansdowne's pocket boroughs. To conclude, it was, arguably, the internal dynamic of Bentham's critical utilitarianism, rather than the events of the French Revolution, which was ultimately responsible for pushing him into a novel form of radical politics.  相似文献

Millions were reminded on January 20, 2009, that the inauguration of an American President is as remarkable as it is routine. In this distinctly republican rite, the chief executive publicly subordinates himself to the fundamental law of the land. As the Constitution dictates, “[b]efore he enters on the Execution of his Office, he shall take the following Oath or Affirmation: ‘I do solemnly swear (or affirm) that I will faithfully execute the Office of President of the United States, and will to the best of my Ability, preserve, protect and defend the Constitution of the United States.’” 1 This display of constitutional fealty was remarkable because the variety of political systems, experiences, and cultures across today's globe graphically illustrates that the seamless and peaceful transfer of authority from one political party or individual to another, as was witnessed at President Barack Obama's inauguration and at President George W. Bush's inauguration in 2001, is not always a foregone occurrence everywhere. January's event was routine in that, from the outset of government under the Constitution and with the notable and tragic exception of 1860, the defeated party or individual has accepted, if not welcomed, the verdict rendered by the electoral process. That was the outcome even in 1800, when the notion of a violence‐free shift of control in a country founded on the principle of government by the “consent of the governed” 2 was first put to the test at the presidential level. The assumption of authority by Thomas Jefferson and the Democratic‐Republicans from John Adams and the Federalists marked the world's first peaceful transfer of power from the vanquished to the victors as the result of an election. 3 Given the stark national partisan differences that had crystallized in the short time since ratification of the Constitution and the fact that finalization of the election required extraordinary intervention by the House of Representatives to break an Electoral College tie, this outcome was a greater achievement than is sometimes acknowledged. “Partisanship prevailed to the bitter end and showed no signs of abating,” according to one historian who has recently revisited this critical and precedent‐setting election. “Over the campaign's course, George Washington's vision of elite consensus leadership had died, and a popular two‐party republic … was born.” 4  相似文献

Hermann Helmholtz made monumental contributions to the neural sciences in the second half of the nineteenth century. Among his earliest achievements were experiments that challenged vitalism, microscopic studies on the structure of the nerve cell and its processes, and the first reasonable estimates of the speed of nerve transmission based on physiological experiments. In this, the first of a two-part article, we review Helmholtz's early contributions in biographical context and with reference to Johannes Müller's own thoughts.We reveal how Johannes Müller, considered by many to be the greatest physiologist of the first half of the nineteenth century, helped to launch and shape Helmholtz's career. We also show that Helmholtz was only willing to accept some of his mentor's theories, even though he had great admiration for Müller. The point will be made that Helmholtz owed a great debt to Müller, but even from his student days in Berlin he was an independent thinker with his own agenda, and never his strict disciple.  相似文献

Walter Moyle's work, An Essay upon the Constitution of the Roman Government, is much more Machiavellian than it initially announces itself to be. Informed by James Harrington's and Niccolò Machiavelli's earlier commentaries on Rome, Moyle readily embraces that on which both of his predecessors agree—the desirability of a republic that seeks armed increase. Harrington, though, explicitly disagrees with Machiavelli's embrace of a tumultuous republic that seeks a return to its beginning through fostering fear. In contrast to Machiavelli, Harrington looks to economic and institutional arrangements that will render a republic so serene and stable that he claims immortality for it. Although initially Moyle forthrightly endorses Harrington's analysis, he ultimately relies on the harshest teachings of Machiavelli to maintain a republic, a reliance which finds him endorsing the distinctively Machiavellian directives to suspect, accuse, and punish its leaders in such a way as to return the republic to its beginnings. These teachings make Moyle's work a vessel for the transmission of a stern, aggressive republicanism. Even in this eventual enthusiastic embrace of Machiavelli's teachings, however, Moyle still displays some hesitation in citing him as the sole source for them as his attributions couple the Florentine's name inaccurately with other, more reputable republicans.  相似文献

This essay reads Godwin's second novel, St. Leon (1799), as an attempt to counter the asperity he expresses towards the domestic affections in his political philosophy of the 1790s. In St. Leon, Godwin seeks to square his newfound interest in the affections as a topic for fiction with his commitment to an anti-establishment political agenda. Though it is presented as a ‘eulogium’ to ‘the affections and charities of private life’, the narrative persistently undercuts the potential for the affections to stimulate readerly curiosity. The focus of the novel constantly shies away from the domestic scene, and instead propels the momentum forwards to the alchemical adventures that precipitate the disintegration of the very affections the novel purports to eulogise. The novel thus plays out Godwin's complicated desire to embrace, and yet simultaneously to deny, the importance of private emotions in the pursuit of political justice.  相似文献

For the past two decades relations between North Korea and the United States have become increasingly hostile. Pervasive and vociferous criticism of North Korea's dangerous and seemingly irrational behaviour has focused on Pyongyang's use of nuclear brinkmanship, violations of human rights and general disregard for the well-being of the North Korean people, as exemplified by its decision to develop a nuclear programme while the country suffered from widespread famine. However, an alternate view put forth by both American and South Korean experts on North Korea holds that Pyongyang's use of the nuclear wager primarily has been intended to demand Washington's attention in order to initiate bilateral talks and eventually normalise relations with the US. Certainly, Pyongyang's actions have been ham-fisted at times; however, its commitment to the goal of normalisation has been unwavering. The current controversy regarding North Korea's nuclear programme may serve as a necessary step to build trust between Washington and Pyongyang and might continue for sometime, given the short history of direct engagement. However, one thing is clear: neither Washington nor Pyongyang can afford to go back to the starting point.  相似文献

Abstract: 4 April 2008 marked the 40th anniversary of Dr King's assassination in Memphis, Tennessee. Since his murder we have seen Dr King's message of social justice, the growing threat of militarism, the threat the USA's burgeoning empire posed, and his goal of ending injustice boiled down to a few words spoken in Washington DC when he declared his dream to see his children grow up in a society free of race prejudice. This paper engages with Dr King's work and presents a more geographically sophisticated understanding of King's legacy than the oft repeated Washington speech. Through an analysis of Dr King's concept of the Beloved Community, I argue that Dr King's work stems from the experiences of the Black Atlantic world. Consequently, we should see Dr King's social theory as part of a larger anti‐colonial struggle which sought to integrate African American and Western notions of community, which holds contemporary importance as a counterpoint to current neoliberal conceptions of community.  相似文献

In 2008, Barack Obama pledged to transform not simply his nation's domestic orientation but also its foreign policy and its reception abroad; he would be the ‘un‐Bush’ president. The books under review each offer a preliminary assessment of how far he has departed from Bush and how far he has adapted and improved his predecessor's approach. For some, Obama has been compromised in his international agenda, like Bush before him, by domestic constraints that have afflicted every modern US president; for others, his lofty ambitions have been hobbled by the enduring realities of global politics. This review offers a typology of assessments of Obama's foreign policy and suggests which is more accurate and why.  相似文献

Abstract

In speech and deed, Lincoln's statesmanship manifests the possibility of an honorable, reasonable, and just love of country—that is, a reflective patriotism imbued by a republican love of liberty under God's Providence. In his speeches and writings, Lincoln consistently underscored that love of country must be governed by “reason,” “wisdom,” and “intelligence.” Thus, in his First Inaugural, March 4, 1861, he characteristically appealed to the combined forces of “Intelligence, patriotism, Christianity, and a firm reliance on Him, who has never yet forsaken this favored land.” Lincoln's reflective patriotism was nurtured by his gratitude to the Founders and measured by his fidelity to a national Union dedicated to the universal moral principles of the Declaration under the particular rule of law established by the Constitution. Historically, it was articulated as an alternative to rival forms of allegiance that Lincoln opposed as both unjust and unreasonable during the Civil War era—namely, sectionalism, nativism, and the imperialism of Manifest Destiny. Each of these disordered forms of love threatened the inseparable moral and fraternal bonds of liberty and Union that Lincoln sought to perpetuate through an ordinate love of country guided by wisdom and critical self-awareness. After the successful US–UN action in Operation Desert Storm in 1991, by the mid-1990s Washington's enthusiasm for multilateral action had already faded away. This was evident after the ‘Black Hawk Down’ disaster of the US Mission in Somalia in October 1993 and the release of a much more restrictive peacekeeping policy in May 1994 (PDD-25). The US inaction during the following Rwandan genocide in spring 1994 was then seen as the obvious consequence of the American ‘trauma’ in Somalia, as well as the symbol of Washington's withdrawal from peacekeeping commitments. However, in the light of new archival documents a different scenario emerges. This article shows that the consequential link, often stressed by the literature, between the Somali disaster, the release of PDD-25 and American inaction in Rwanda is much less straightforward. This suggests that the policy in Rwanda was not just a consequence of the Somali debacle and that the reasons for US inaction toward the genocide must be gauged within a broader set of factors. The study of Washington's policy in Rwanda thus becomes a significant case to investigate some broader patterns of post-Cold War American foreign policy and to re-evaluate the US peacekeeping experience of the 1990s.  相似文献

The present essay focuses on the figure of Maurice Bucaille and on his contribution to the discourse on Islam and science. Its purpose is twofold. First of all, it aims to provide the reader with a concise map of the ideas of the French author, reconstructing their core and their interrelations. Furthermore, it aims to question what I define as “the apparent naivety” of Bucaille's work, a reason why he can sometimes be too easily dismissed, by pinpointing a number of original features of his intellectual activity. My argument is that Bucaille deserves more attention for two good reasons: firstly, because of the influence that he de facto exerts on Muslim societies, secondly, because of some highly specific characteristics of his discourse. Such features not only distinguish his contribution from analogous ones, but also give rise to interpretative questions, which have as yet been either overlooked or unsatisfactorily addressed. Closely connected to this thesis is the idea that Bucaille's work constitutes a good starting point for a discussion amongst scholars of different disciplines and from different cultural backgrounds. The first section reconstructs Bucaille's life and works. The second section focuses on his method and ideas regarding science. The third section is devoted to Bucaille's conclusions following his study of the Bible and the Qur'an, and therefore deals more closely with the core of his ideas. The fourth section covers Bucaille's complementary criticism of the theory of evolution. In the fifth section I examine the possible reasons behind the scant scholarly attention concerning Bucaille. In the final section I propose an interpretative model of Bucaille's figure conceived as a system of concentric spheres and I raise, for each one of them, several questions, which have so far been, in my view, insufficiently investigated, thus setting an agenda for further scholarly work.  相似文献

Over the decades that followed the overthrow of Mosaddeq in August 1953 a narrative attributing the fall exclusively to foreign conspiracy has taken hold and become institutionalized. In this narrative the internal factors are reduced to the simplest level of abstraction. They do not exist outside foreign conspiracy! This narrative is premised on an Anglo-American coup plot code-named TP-AJAX that was attempted in the late hours of 15 August but failed. The ensuing flight of the Shah generated dynamics which led to the fall of Mosaddeq four days later. The CIA chief operative in Tehran Kermit Roosevelt was quick to take credit claiming that these dynamics were inseminated by his ingenious and spontaneous planning. For abiding internal reasons both the CIA and the MI6 headquarters preferred to claim victory rather than admit failure. Evidence that emerged following the declassification of the State Department papers in 1989 and the leak of a secret CIA internal history in 2000 produced glaring evidence that the fall of Mosaddeq on 19 August 1953 had taken Washington, even its embassy in Tehran, by complete surprise and that post facto claims by Roosevelt were inconsistent both with Washington's explicit policy directives and Roosevelt's own situation reports filed with the CIA Washington during the interval between the two events. Roosevelt later published a phantasmagorical account of the event which, together with reminiscences of a few unnamed former operatives, was given credence by Professor Gasiorowski and associates, who curiously chose to ignore archival evidence.  相似文献

Among the often-cited powers of the presidency is the power of the pulpit. Presidents attempt to influence Congress directly and indirectly through their rhetoric and its influence on national policy debates. This includes the power to shape debates through the use of frames. While much is known about framing, no past study has attempted to document all frames utilized by a policy entrepreneur in his attempt to shape the policy debate. Comprehensive understanding of frame creation is necessary to understand what frames persist and how frames are used in policymaking. This study identifies how one president, Barack Obama, framed domestic policy issues in speeches early in his administration. Identifying frames the president uses provides insights into this president's attempts to set the public agenda. The findings of this study suggest that Obama's use of specific frames is highly idiosyncratic, but that these idiosyncratic frames coalesce around identifiable policy areas, particularly macroeconomic policy. This study provides insight into how one president attempts to both frame and set his domestic policy agenda.  相似文献

A few years ago Danielle Stern suggested to her grandfather that as the oldest member of the family, he ought to put down his memories of both the family and of his law practice. Stern did, and in it he describes various members of the family, and how he came to go to Harvard Law School, graduating in 1932 during the Great Depression. Although he had been an editor of the Harvard Law Review and graduated magna cum laude, the major New York firms passed him by because he was a Jew. He did manage to get a job with a small law firm at $25 a week, and about a year later went to Washington to join the New Deal. We are pleased to present that part of Mr. Stern s memoirs that deals with his years in the Justice Department and then in the Solicitor General s office.  相似文献

Eisenhower's contributions to the modern presidency are primarily institutional and to some extent, stylistic: his reliance on the professionalism of civil servants in the Bureau of the Budget, his continuation of the annual programming process as well as the procedures for coordinating the executive branch's legislative role, his creation of a White House office to represent him on Capitol Hill, and his respect for Congress as a legislative body. What Eisenhower did not do is equally significant: he did not reject the model of an activist presidency, reverse the New and Fair Deal policies of his Democratic predecessors, or pursue his centrist agenda in a blatantly partisan manner. The Eisenhower experience demonstrates that incivility, inhumanity, and inanity are not inevitable consequences of divided government.  相似文献

Cropsey's book, Plato's World, contains his longest and most sustained reflections on a set of Platonic dialogues, but it is not the first work he published on Plato or the last he intended to write. This article contextualises Hegel's writings on international order, especially those concerning war and imperialism. The recurring theme is the tragic nature of the struggles for recognition which are instantiated by these phenomena. Section one examines Hegel's analysis of the Holy Roman Empire in the context of French incursions into German territories, as that analysis was developed in his early essay on ‘The German Constitution’ (1798–1802). The significance of his distinction between the political and civil spheres is explored, with particular attention being paid to its implications for Hegel's theory of nationalism. The second section examines Hegel's development of the latter theory in The Phenomenology of Spirit (1807), stressing the tragic interpenetration of ‘culture’ and intersubjective recognition. A recurring theme here is the influence of this theory on Hegel's interpretation of Napoleon's World-Historic mission, as that was revealed in his contemporaneous letters. Section three traces the tragic dynamic underlying the discussion of war between civilised states in The Philosophy of Right (1821). Section four examines three other types of imperial action in Hegel's mature writings, particularly The Philosophy of History (1832). These are relations between civilised states and culturally developed yet politically immature societies; colonial expansion motivated by capitalist under-consumption; and conflict between civilised states and barbarous peoples. It is concluded that it is misleading to claim that Hegel glorified conflict and war, and that he did not see domination by ‘civilised states’ as the ‘final stage’ of World History.  相似文献
