Les représentations de l'Allemagne dans la presse sportive française: l'exemple des rencontres de football France-Allemagne dans les années trente

ARP (la Société Civile des Auteurs, Réalisateurs et Producteurs) is one of the most significant cinema lobby groups in France today. Among its most important manifestations are the annual Rencontres de Beaune, a series of debates that attract some of the most influential figures in both the cultural and political domains internationally. This article aims to document the political successes and impact of ARP through a presentation and analysis of the 2000–2004 Rencontres Cinématographiques de Beaune.     

Logique, Probabilité et Rhétorique dans l’Argumentation Juridique

Judicial reasoning has often been seen as mere rhetoric. Yet, as I argue here, this reasoning actually stems from the exigencies of truth. This in turn requires questioning the relationship between logic and rhetoric in the legal field. The logic referred to is probability, which is most appropriate to pragmatic rationality. Hence, to shed light on judicial reasoning, this essay puts the relationship between judicial logic and probabilistic logic in historical perspective whilst taking into account the existing literature on the topic.     

Hasard vécu et nécessité subie dans leAnton Reiser de Karl Philipp Moritz

The distinction between literary chance and chance as experience (E. Köhler) allows the originality of Moritz’s autobiographical novel to be disengaged. This study of the motif of chance in book II ofAnton Reiser shows the establishment of a narrative method characterized by repressing the literary treatment of chance and maintaining of chance as a category of lived experience. In this text, the fortunate and unfortunate chances do not found the literary necessity of an exemplary destiny, but are the occasion for throwing light on the double determination, exterior and interior, that affects the character’s existence, an existence that is experienced under the sign of a radical contingency. It is in this first obscurity that psychological analysis operates, not to establish the horizon of Providence, but to disengage the general lessons of an existence, and to give to its hero, at this moment, the consistency of a novelistic character.     

L’eugénisme et la protection de l’espèce humaine dans les lois bioéthiques Vers une nouvelle construction juridique de l’homme

The aim of this study is to bring to the fore some issues concerning human rights unleashed by the bioethical laws of July 1994, regarding the application of biotechnologies to reproduction. To achieve this aim, an analysis is offered of the legal arrangements, set by law in order to determine the procedures related to the selection of embryos and the transformation of their genetic characteristics. These analyses are then compared to the eugenic procedures instituted in the West during the first half of the xxth century. As a result, the idea is challenged, that eugenics is a category fit for the characterizing the biopolitical project contained in the bioethical laws. To conclude, the aim is made that what is a stake, as far as human rights are concerned, is the fate of the idea of man and of the subject of rights that is involved in these laws.

The numerous treatises on reason of State are part of a genre which theorises political actions a posteriori. It is not possible for reason of State to be expressed directly and publicly ? How is it staged by the State itself ? Courtly literature, with its subtle dialectic of imitation and idealization, contains abundant material exemplifying this manifestation as representation, all the more significant when it concerns an interregnum. The minor age of the prince, his crowning and the ceremony of his coming of age are essential moments which are surrounded by the rhetoric of praise and during which the State institutes in the prince both the faculty of reason and its own reason: a panegyric reason of State.     

Libertés et Sûreté les Mutations de L’État de Droit

The right to safety submits the State to the law even when it can legitimate attacks on liberties apparently contrary to the State of law. We propose to analyze here the mutations of the State of law, notably since the externalisation of the state of exception after 2001 and the appearence of regimes of suspicion such as the expression of three legal processes distinct from suspension, skirting and diversion. It is a question of recalling how, beyond the distinction between authoritarian and liberal policy, a double movement, internal and international, of constitutionalisation and internationalisation of the systems of law constitues a ferment of resistance, limited but already effective to all reasons of State.

La tristesse qu’elle a exprimée n’est pas de simples expériences ou émotions personnelles, mais de la recherche et de l’interrogation profonde vers l’identité du《je》 et de l’《autre》
